Permit Extension - Riverview Park Boat Dock Construction
As referenced in the attached memorandum as compiled and delivered by
City Engineer David Fisher, please be advised that the City of Sebastian
was successful in securing the necessary revised permits and extensions
from United States Army Corp of Engineers and the Florida Department of
Environmental Protection to implement construction of the Riverview Park
Boat Dock/Pier and Shoreline Renovation Program on Indian River Drive.
As such, the Departments of Engineering and the Office of the City Manager
will begin commencement with a comprehensive bid/proposal solicitation
process. Respective recommendations to City Council will therefore be
offered publicly in the coming weeks.
Discretionary/Infrastructure Sales Tax Revenue Bond
As recommendations are being offered publicly during Wednesday
evening's meeting relative to commissioning a construction management
firm to assist staff with implementing the recently authorized New City Hall
and Police Station Expansion Program, I wish to offer a brief update relative
to the construction bond financing initiative. The Office of the City Manager
and the Department of Finance are working diligently with representatives
from Kirkpatrick Pettis (i.e. Jeff Larson) and Nabors, Giblin & Nickerson,
P.A. to prepare recommendations for City Council authorization of
applicable financial transaction matters during your March 26th Regular
Meeting. As referenced in the attached electronic mail message from
Director of Finance Mark Mason, this date is appropriate to allow adequate
time to assemble necessary legal and financial documentation to market
and sell the revenue bond. As such, in an effort to ensure a solid comfort
level 'across the board', we anticipated all proper dynamics to be positioned
prior to the March 26th session.

Sebastian Stormwater Passive Park
As reported last week, the St. John's River Water Management District
(SJRWMD) has initiated tasks to assist with the development of the 160 +
acre Sebastian Stormwater Passive Park. Earlier this week, a meeting took
place here at City Hall with representatives from SJRWMD to discuss more
recent specifics relative to the project. Agency staff now anticipates that the
park will become fully functional within the next three years. During the first
year of full operation, the park will be managed and maintained by
SJRWMD. During the following year, the City of Sebastian's Stormwater
Utility will assume respective management and maintenance duties. In
addition to the aforementioned tasks having already been initiated, various
relatively minor adjustments to the park development plan became
necessary. Once respective revisions have been made, I will forward
individual copies of updated drawings for your review and edification.
Sebastian Stormwater Master Plan Model
As discussed during your January 22nd Regular Meeting, revisions to the
draft Sebastian Stormwater Master Plan Model (SMPM) were made in an
effort to also incorporate implementation of Miami curbing and other long
term applicable capital improvement programming throughout the City. You
will notice a transmittal in next week's meeting agenda packet
recommending authorization of a change order to the existing master
planning agreement with Camp, Dresser and McKee - to include tasks to
represent the City of Sebastian in working with the SJRWMD for their
approval, as well as necessary staff training regarding application and
administration of the SMPM to implement necessary projects. Given the
positive dynamic currently underway in this regard, it will soon become
imperative to receive full and succinct direction from City Council as to
whether or not the master plan model is to be formally accepted and/or
adopted. As such, I will need to seek respective direction during your March
12th meeting. In addition to the incorporation of the Miami curbing in
planning activities, I also hope to offer additional commentary relative to
applicable long-term capital programming efforts (i.e. recommendation
process for scheduling, funding, etc.). Any of you may therefore feel free to
speak with me individually about concerns that you may have prior to the
March 12th session, in an effort to ensure a solid comfort level accordingly.

We have now received the necessary permits and extensions from ACOE and FDEP and
are currently proceeding to put the entire subject package out to bid for construction. We
are making some changes to the specifications to upgrade some of the materials in the
project but the package should be ready sometime next week to be advertised.
In 'concert with Mike Kiefer of Kimley-Horn, we now also intend to apply for a modification
to the design to allow easier access to boats at the waterline. We will not, however, delay
the out-to-bid package while waiting for further discussion and approval on the
modification. If the modification is ultimately approved after further discussion and
"negotiation" with the permitting agencies, we can then make such modifications to the
construction contract in the form of a change order.

Following conversations with Disclosure Counsel and Jeff, the bond reso and series reso will be presented at the March
26, 2003 council meeting. We are delaying the resolutions since the need (council elections) has passed and it will give
everyone enough time to put together the documents necessary to sell the bonds. The actual sale date will be
determined by several factors, the most critical being the drawdown schedule. This will obviously be dependent on who
the construction manager is.
