Ancillary Information - Stop Si.qn Installation Process
Despite our efforts to publicly communicate the City of Sebastian's policies
and processes relative to reviewing and facilitating requests for stop sign
installation (during the August.14, 2002 Regular City Council Meeting), a
number of residents and concerned individuals remain under the impression
that such arrangements are made without substantive justification. In an
effort to once again clarify respective rationale, please find the attached
memorandum as compiled and delivered, per my direction, by City Engineer
David Fisher. The report outlines the methodology for placement of stop
signs, including applicable guidelines offered in the most recent edition of
the United States Department of Transportation Manual on Uniform Traffic
Control Devices (MUTCD - December 2000). Section 2B.05 of MUTCD
offers municipalities and state governments guidance in this regard, notably
the ability to install signage on streets and thoroughfares that have
experienced high speeds, restricted views, and/or numerous crash records
indicating a need for control by stop signs. As also referenced in the
attached correspondence, stop signs that were installed in recent months
were deemed warranted by this criteria, following citizen requests and
assessments performed by both the Department of Engineering and the
Sebastian Police Department. As such, in the event any of you are
questioned as to why "all of a sudden" stop signs are being installed
throughout the community, you may feel free to refer to this memorandum,
including the enclosed relevant excerpts from MUTCD.
Update- Historic District Nomination Process
Earlier this week, a deliberation meeting was held with our historic
preservation consultant Anna Jackson relative to the status of the Sebastian
Historic District nomination process. Representatives from the State of

Florida Bureau of Historic Preservation recently visited the City of Sebastian
to conduct further review and analysis of the proposed designated area, in
preparation for a respective presentation to the Florida Historic Preservation
Board of Directors hearing scheduled to take place in Tallahassee Tuesday
March 25th. As referenced in the attached electronic mail message from Ms.
Jackson, notification letters will also soon be mailed to property owners in
the potential district - in an effort to inform them about the possible
designation. Such an arrangement is appropriate in confirming community
support for the proposal. Respective objections that may arise in this regard
will of course be communicated in advance of our Tallahassee appearance.
Additional Planting for United States Highway One and
Schumann Drive Medians
As a result of the recent cold snap in the area, the Department of Public
Works was forced to postpone additional planting and landscaping activities
to accommodate Schumann Drive and portions of United States Highway
One (US 1) medians. As referenced in the attached memorandum compiled
and delivered by Terry Hill and Chris McCarthy, respective plant and sod
installation is anticipated to resume later this month, well after concerns
have been alleviated relative to additional adverse weather. A species list
referencing groundcover, tree and shrubbery is also included in the
aforementioned memo.
Official Award Notice- Community Development Block Grant
As reported a couple weeks ago, the City of Sebastian was notified of
success in securing its $700,000 Community Development Block Grant
Award to help finance implementation of the Louisiana Avenue Area
Improvement Program. The attached official award letter was received by
my office yesterday afternoon, including a contained reference that
respective contract and several required forms will soon be forward to my
office. As such, as soon as this documentation has been received, a
recommendation for authorization to execute will be forward for City Council
consideration during the next following regular meeting.

Further to our discussion regarding methodology for placement of STOP signs, this is to confirm
that we follow the guidelines of the most recent edition of the MUTCD (Manual on Uniform Traffic
Control Devices endorsed by the US Department of Transportation and a number of other
agencies).
The MUTCD, in section 2B.05, gives the following guidance.
"STOP signs should not be used unless engineering judgment indicates that on.e or more
of the following conditions exist:
A. Intersection of a less important road with a main road where appficafion of the
normal right-of-way would not be expected to provide reasonably safe operation;
B. Street entering a through highway or street;
Unsignalized intersection in a signalized area; and/or
High speeds, restricted view, or crash records indicate a need for control by the
STOP sign."
The most recently installed STOP signs in the City are
· On George Street at Dyke Street, Seaside, and Breakwater Terrace;
· On Skyline at Sunrise; and
· On Laconia at Bevan-Periwinkle and at Tulip.
All of these signs were installed after citizen requests and a follow-up study by the Police
Department that in fact indicated there existed a need for STOP sign control at those locations.
Let it be noted that the City of Sebastian now has approximately 18,000 residents and
approximately 24,000 vehicles with daily increasing use on our approximately 140 miles of roads
and at well over 1000 intersections. As we are now only about 50% built out, we can expect more
situations in the future, not less, that will require additional STOP sign installations.

I think I've finally caught my mistake, and therefore you should receive this email.
I spoke with Gary Goodwin shortly after our meeting today about the revisions to the NR nomination. He
informed me that a notification letter will be mailed near/on February 17th to every homeowner located in
the potential NR district informing them of the potential listing. I just wanted to give you that heads up.
Gary also mentioned that the NR review committee meeting would be taking place March 2$th at 12:30 in
the R.A. Gray Building on the 3rdFl. I'll let you know if anything changes.

We have held off on planting any landscape material due to the unusually cold
weather recently. I am compiling Price Quotes now and will send them out next
week. ! expect to start planting in the last week in February when I hope we will
no longer have to worry about frost that would damage new plants. The median
on U.S. 1 by Strunk Funeral Home and Coastline Tire will also have new
landscaping. I have listed below some of the landscape material that will be

Affairs (DCA), your FFY 2002 Community Development Block Grant (CDBG) application has scored within
the fundable range for an award of federal funds in the amount of $700,000.00. While a final award is still
subject to appeals, I congratulate you on preparing an application that addresses your community
development needs, especially those of Iow and moderate income households.
The contract and several required forms will be forwarded to Mr. Terrace Moore, the contact
person listed in your application. I encourage you to have your staff expedite preparation of the forms,
signing of the contract and return of these documents to DCA for processing pending completion of the
appeals process. A Notice of Administrative Rights is enclosed to assist you in understanding the appeals
process and associated time frames that may impact your award.

NOTICE OF ADMINISTRATIVE RIGHTS
You have the opportunity for an administrative proceeding pursuant to Section 120.569, Florida Statutes,
regarding the agency's action. Depending upon whether you allege any disputed issue of material fact in your
petition requesting an administrative proceeding, you are entitled to either an informal proceeding or a formal
hearing.
If your petition for hearing does not allege any disputed issue of material fact conceming the Department's
action, then the administrative proceeding will be an informal one, conducted pursuant to Sections 120.569 and
120.57(2), Florida Statutes, and Chapter 28-106, Parts I and 1II, Florida Administrative Code. In an informal
administrative proceeding, you may be represented by counsel or by a qualified representative, and you may present
written or oral evidence in opposition to the Department's action or refusal to act; or you may exercise the option to
present a written statement challenging the grounds upon which the Department has chosen to justify its action or
inaction.
If you dispute any issue of material fact stated in the agency action, then you may file a petition requesting a
formal administrative hearing before an administrative law judge of the Division of Administrative Hearings,
pursuant to Sections 120.569 and 120.57(1), Florida Statutes, and Chapter 28-106, Parts I and II, Florida
Administrative Code. At a formal administrative hearing, you may be represented by counsel or other qualified
representative, and you will have the opportunity to present evidence and argument on all the issues involved, to
conduct cross-examination and submit rebuttal evidence, to submit proposed findings of fact and orders, and to file
exceptions to any recommended order.
Mediation is no~t available with respect to this action.
If you desire either an informal proceeding or a formal hearing, you must file with the Agency Clerk of the
Department of Community Affairs a written pleading entitled, "Petition for Administrative Proceedings" within 21
calendar days of receipt of this notice. A petition is filed when it is received by the Agency Clerk, in the
Department's Office of General Counsel, 2555 Shumard Oak Boulevard, Tallahassee, Florida 32399-2100. You
may also file the Petition by facsimile transmission to (850) 487-6769. If you choose to file by facsimile
transmission, you are responsible for verifying that the complete document was received by the Office of the
Agency Clerk prior to the deadline.
The petition must meet the filing requirements in Rule 28-106.104(2), Florida Administrative Code. If an
informal proceeding is requested, then the petition shall be submitted in accordance with Rule 28-106.301, Florida
Administrative Code. If a formal hearing is requested, then the petition shall be submitted in accordance with Rule
28-106.201 (2), Florida Administrative Code.
The petition must include the signature of someone authorized to act on your behalf. A petition must specifically
request an administrative proceeding, it must admit or deny each material fact contained in the notice of agency
action, and it must state any defenses upon which you rely.
You waive the right to an administrative proceeding if you do not file a petition with the Agency
Clerk within 21 days of receipt of this notice. In that case, you will be sent a final order by the Department
stating that you have waived your right to an administrative proceeding, and explaining that you still have
the right to file an additional appeal with the District Court of Appeal for a period of thirty (30) days from
the date the final order is issued by the Department.
In addition to the above rights, you have the right under § 120.542, Florida Statutes, to file a petition
requesting a variance or waiver from the applicable rules of the Department. Such petition must comply with the
statutory and regulatory requirements and be filed within the same 21 day period as that provided for the filing of an
administrative proceeding under § 120.569, Florida Statutes, and § 120.57, Florida Statutes, or such rights as exist
under § 120.542, Florida Statutes, are waived. Any proceeding held with respect to § 120.542, Florida Statutes,
must be a separate proceeding from the administrative proceeding under § 120.569 and § 120.57, Florida Statutes.
The granting of a waiver or variance must be based on a demonstration that the purpose of the underlying statute
will be or has been achieved by other means, and that the application of the rule would create substantial hardship or
would violate principles of fairness. The Department is not authorized to grant variances or waivers to statutes.
