A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA,
TEMPORARILY DESIGNATING A PORTION OF LACONIA
STREET FOR ONE-WAY TRAFFIC; PROVIDING FOR CONFLICT;
PROVIDING FOR SEVERABILITY; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, upon the request of concerned citizens, the City has investigated
designation of the southernmost portion of Laconia Street for one-way traffic; and
WHEREAS, the current available right-of-way for the section of Laconia Street
fi:om Concha Drive to the drainage ditch immediately south of Gladiola Street is only
sufficient for the existing 12 foot wide paved surface; and
WHEREAS, the widening of Laconia Street in this area, as well as the eventual
extension of the roadway southward, is a part of the City's long-term capital
improvement program; and
WHEREAS, the analysis of the situation by the Engineering Department and the
Police Department indicates that the preferred solution is temporary designation of the
roadway for one-way traffic northbound from Concha Drive to Gladiola Street until the
roadway is widened;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
Section 1. DESIGNATION. The City hereby designates Laconia Street for
one-way traffic northbound from Concha Drive to the drainage ditch immediately south
of Gladiola Street, and directs that appropriate action be taken as to signage and roadway
markings.
Section 2. CONFLICT. All resolutions or pans of resolutions in conflict
herewith are hereby repealed.
Section 3. SEVERABILITY. In the event a court of competent jurisdiction
shall hold or determine that any part of this resolution is invalid or unconstitutional, the
remainder of the resolution shall not be affected and it shall be presumed that the City
Council of the City of Sebastian did not intend to enact such invalid or unconstitutional
provisions. It shall further be assumed that the City Council would have enacted the
remainder of this resolution without said invalid or unconstitutional provision, thereby
causing said remainder to remain in full force and effect.
Section 4. EFFECTIVE DATE. This resolution shall become effective
upon adoption.
