HomeMy WebLinkAbout05/10/20021225 Main Street [] Sebastian~ Florida 32958 Telephone (5611 589-5330 [] Fax (561) 589-5570 City Council Information Letter May 10, 2002 City Wide Park Development Plan As a productive workshop recently took place between the Parks and Recreation Advisory Committee, city staff and interested residents, arrangements are underway to finalize completion of a parks development plan, anticipated to be presented for your consideration during your May 22nd meeting. This program would therefore outline policies, principles and timeframes associated with both active and passive park development, whereby respective expenses are to be financed via the community's parks and recreation impact fee account. As the aforementioned April 29th workshop was very well received publicly, no great concerns are anticipated. Sebastian Police Department Assistance with Animal Control As referenced by Mayor Barnes during his presentation relative to vicious dog problems in the community, additional issues regarding safety and prevention are necessary for consideration, so as to work to protect citizens as best as possible. As such, I wish to advise both the City Council and residents that the Sebastian Police Department (SPD) is being formally directed to assist individuals experiencing such problems. Although the City of Sebastian adheres to respective provisions of the Indian River County Animal Control Ordinance, no prohibitions exist for direct enforcement (as was recently demonstrated via the efforts of Sebastian police officers via two vicious dog attacks in recent months). This clarification was established during our meeting with both Sheriff's Office and Indian River County representatives regarding this matter. Accordingly, the SPD will work in conjunction with the Indian River County Animal Control Division to assist with resolving such matters in the future. I therefore wish to encourage residents to contact both SPD and City Hall to address relevant concerns, as well as feel free to report concerns (potential and/or existing) to the Animal Control Division, as combating related problems remains a responsibility of both parties. City Council Information Letter May 10, 2002 Page 2 Skydive Sebastian A few days ago, you received a copy of the attached letter from Mr. Solomon Zoberman, a staff attorney with Buckingham, Doolittle and Burroughs legally representing Skydive Sebastian relative to matters with Sebastian Municipal Airport. In response, I wish to advise that my office has once again initiated an invitation to amicably discuss transitional issues, namely the prospects outlined in the city's most recent consent to designate a building/facility location adjacent to a redesigned landing area as highlighted in the recently adopted master plan. As referenced in Mr. Zoberman's letter, Skydive Sebastian is interested in exploring this possibility. A likely scenario in this regard may be a proposal to modify existing agreements to accommodate this arrangement. However, I do not anticipate recommending drastic adjustments, but to simply establish an overall good tenant-landlord relationship. I will keep you advised as to progress in this regard, as various meeting dates have been proposed to Skydive Sebastian representatives for consideration. Funding for Airport Regional Noise Study Please find the attached memorandum as compiled and delivered by Jason Milewski that outlines official funding dynamics relative to an airport regional noise study to be sponsored by the Florida Department of Transportation (FDOT) Aviation Section. Although the Sebastian Municipal Airport will not likely be adversely impacted by such an exercise (or the results thereof), we will be required to provide our full cooperation, to gather and analyze data in an effort to determine regional solutions to noise issues at general aviation use airports in the Florida southeast region (FDOT District 4). Contrary to various published newspaper reports outlining the prospect of communities being required to help fund this endeavor, FDOT will be financing the entire project. Confirmation in this regard was provided directly by FDOT Aviation Coordinator Rebecca Rivett. I will therefore provide you with future updates relative to the regional noise study, to possibly include a public presentation to outline logistics accordingly. In the interest of fully exploring any reasonable proposals for amicable settlement ,and without waiving any rights or remedies available to Skydive, it would appear that the proposal alluded to in your letter may constitute the be~dnning of a workable solution. A primary concern presented by you and your representatives involved the necessity for the parachute landing area to be adjacent to your facility. AN IS~ Memorandum TO: FROM: DATE: RE: Terrence Moore, City Manager Milewski, Airport Mana~ Jason 5/9/02 FDOT Regional Noise Study As you are aware, earlier this year we had received word from the Florida Department of Transportation (FDOT), Aviation Section that they were going to conduct a Regional Noise Study. This study, requested by airport managers along the Treasure Coast, was to include airports from Indian River (including Sebastian Municipal Airport), St. Lucie, and Martin Counties. Its purpose is to gather and analyze data in an effort to determine a possible regional solution to the noise issues at the respective airports. Lately, there has been some misconceptions and inaccurate information provided in recent articles of the Press Journal about this study, particularly how it will be funded. A few weeks ago, there was an article that stated FDOT was not going to fund the entire study and that any airports that wished to participate would need to contribute their share to the total cost of the study. After discussing this with Rebecca Rivett, Aviation Coordinator with FDOT's Aviation Section, I was inforn~ed that the reported information was inaccm'ate. The fact is that FDOT will be funding the entire project and airports are not expected to have to contribute dollars. FDOT and the consulting firm who was chosen for the study are currently determining the scope of the project. Provided that both parties agree on the scope of services and the fees are not unreasonable, FDOT will fund the study itself. In fact, though the most recent Press Journal article implies otherwise, this has always been the case. I will keep you informed of future progress as this plan develops.
