HomeMy WebLinkAbout11192003 CEB CITY OF SEBASTIAN CODE ENFORCEMENT BOARD COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FL 32958 MINUTES OF REGULAR MEETING November 19, 2003 Chairman VanBuskirk called the meeting to order at 2:00 p.m. The Pledge of Allegiance was recited. ROLL CALL: Mr. Neglia Mr. Griffin Chairman VanBuskirk Ms. Schofield Also Present: Code Enforcement Officer Warren Linquist Code Enforcement Officer Antoine VanMeir City Attorney Rich Stringer Barbara Quinn, Interim Secretary APPROVAL OF MINUTES: 10/15/2003 Meeting The minutes were approved by a voice vote 4-0. ALARM- PERMIT # 2513 Mr. Rick Terry 564 BAYHARBOR TERRACE SECTION 39-39 CODE OF ORDINANCES EXCESSIVE FALSE ALARMS (3) Chairman VanBuskirk swore in Tamara Terry, Wife of Rick Terry. Mr. VanBuskirk questioned the address that was listed as Vero Beach and Ms. Terry indicated that it was a mailing address. Ms. Terry indicated that after each of the false alarms she contacted the alarm company who responded immediately and checked it out. She stated that after the third false alarm she had the motion detector removed and advised them to call her or her husband before dispatching to the police. Chairman VanBuskirk swore in Antoine VanMeir who indicated that it was up to the Board to decide the outcome. MOTION by Ms. Schofield. "I would like to make a motion that we impose a fine of $50.00 as the officer suggested here and they will be more careful of securing the doors and all so this doesn't happen again." Chairman VanBuskirk seconded it. ROLL CALL: Mr. Neglia -aye Mr. Griffin -nay Chairman VanBuskirk -aye Ms. Schofield -aye Motion carried 3-1 Code Enforcement Officer Antoine VanMeir instructed Ms. Terry as to how to pay the fine and he also added that he did not recommend the fine to be $50.00 that he left it up to the board to decide the outcome. VIOLATION HEARING - CASE # 2003-13720 HERBERT AND KATHRYN STURM SECTION 66-3.1, 66-3.2, 66-3.11 CODE OF ORDINANCES 549 SAUNDERS ST Attorney Stringer gave a brief background on Chapter 66 in the City Code (Nuisance Provision) and how it should be presented. Chairman VanBuskirk swore in Code Enforcement Officer Warren Lindquist. Officer Lindquist presented his case along with a power point presentation with pictures at the address in question. He pointed out the grass and weed growth that exceeded 10 inches" along with the many items laying in the back yard creating a nuisance problem to surrounding properties. Attorney Stringer briefly went over Chapter 66-3.1,66-3.2,66-3.3,66-3.11 while Officer Lindquist was trying to set up power point in order to display more pictures taken at the site. Chairman Vanbuskirk swore in Mr. Sturm. Mr. Herbert Sturm presented his case indicating that the lawn has been mowed and that the items in the back yard were being used by him for various reasons. He also argued that the city was responsible for mowing the easement. MOTION by Neglia "Yes, I'd like to make a motion on Case # 03-13720 Herbert & Kathryn S .turm. I find a violation Chapter 66-3-sec 1-2-& 11 and ifI may go on give 60 days to clean it up to come to compliance of Cities Code. Attorney Stringer indicated that under the code that if you that if these condition exist, that there are guide lines to be followed and advised that Mr. Neglia might want to modify his motion that these conditions do exist. Mr. Neglia," Under Chapter 66-3, 1,2,3, & 11, I find these conditions do exists. Chairman VanBuskirk seconded this motion. ROLL CALL: Mr. Neglia Mr. Griffin Chairman VanBuskirk Ms. Schofield Code Enforcement Meeting November 19, 2003 Page Two -aye -eye -aye -aye MOTION carried by 4-0 CHAIRMAN'S MATTERS Mr. VanBuskirk indicated that he would like to get the Agenda in the mail at least by the Friday before the meeting. MEMBER'S MATTERS Mr. Neglia suggested that the officer that responded to the alarm be present at the meeting. Mr. Griffin made a statement that he felt that Mrs. Terry had presented her case with as much information as possible and that he felt that she had done as much as she could to rectify the situation. CODE ENFORCEMENT OFFICER'S MATTERS Officer Lindquist indicated that the pictures would be on file at his office CITY ATTORNEY MATTERS The City Attorney stated that there were three types of matters that would only come in front of the Code Enforcement Board. One is the Code Enforcement Case. Alarm appeals. The third is Nuisance. It is a procedure where we find it needs to be fixed and if it isn't fixed the city goes out and fixes it. Attorney Stringer also addressed the statement that Mr. Sturm made about an Attorney cannot represent The City and Code Enforcement at the same time. Approved at the ~/~//D~/ meeting.
