City Council Information Letter

Sebastian Preserve Residential Development Proposal
As I am sure that each of you realize by now, the Planning and Zoning
Commission voted last week to recommend denial of the proposed
Sebastian Preserve Subdivision. The expressed rationale for rejection
includes concerns about lot sizes as well as setback widths. Previous
updates were offered to City Council regarding the evolution of the scope of
development, as well as staff diligence to negotiate removing components
of the proposal to construct multiple family housing, villas and smaller town
houses. The project now consists of all market rate, single-family homes
containing approximately 50% passive preserve amenities within its
boundaries. As such, both Tracy Hass and I will host additional discussions
with representatives of the U.S. Land Company during the next few weeks in
an effort to address and resolve concerns raised by the Planning and Zoning
Commission - via possible additional modifications to their proposal prior to
forwarding the matter for City Council review and consideration. It is
therefore currently anticipated that a respective presentation will be offered
during your March 24th regular meeting.
Waste Management Services for Payin.q Customers Only
A few days ago, representatives from Waste Management, Inc. advised my
office that garbage collection services were inadvertently being provided to
households who have not paid respective bills for the benefit. As such, a
few residents offered inquires as to why trash has not been picked up at
their homes during the past week or so. Via Waste Management's
customer service department, responses to these complaints resulted in a
mere explanation that they were not current with their payments and
therefore no obligation exists relative to continuing the service until
outstanding balances have been satisfied. My request to Waste

Management was to continue to offer as much professional courtesy to all
residents as much as possible. However, the City of Sebastian obviously is
unable to continue to respond to households who have not paid for the
service.
Florida Power and Li.qht - Assessment of Recent Ve.qetation
Trimming and Cooperation of Private Homeowners
A couple weeks ago, I informed City Council via an information letter report
about Florida Power and Light Company's efforts to respond to specific
complaints relative to tree trimming and other vegetation removal activities
deemed necessary to help facilitate installation of electrical infrastructure
along various streets throughout the community. The attached electronic
mail message from External Affairs Manager Nick Blount summarizes a
recent visit to Rolling Hill Drive. Their assessment is that most of the
aforementioned trimming activities occurred on vacant parcels owned by
individuals unable to be contacted in advance regarding this matter. In an
effort to educate respective property owners relative to FPL's efforts, as well
to solicit permission and consensus accordingly, the attached letter (as
accompanied with the e-mail message) is to therefore be delivered within
the next few days to respective property owners. Additional updates
regarding this exercise, as well as other efforts to maintain aesthetically
pleasing thoroughfares during the course of FPLs expansion program will
continue to be provided periodically.
Skydive Sebastian
The attached letter to Mr. James lannaccone of Skydive Sebastian was
delivered yesterday afternoon via certified mail in an effort to receive a firm
response relative to the City of Sebastian's offer of property adjacent to the
newly designated parachute landing area. The difference with this particular
correspondence is that Sebastian Municipal Airport (SMA) is requesting that
a response as to whether or not the property will be used is delivered within
the next twenty days. This action is imperative because other parties are
expressing more interest to lease property at SMA. According to policies of
the Federal Aviation Administration governing property at general aviation
airports, the City of Sebastian has to authorize formal agreements for such
uses. We are therefore not at liberty to leave property available to a tenant

in perpetuity without written agreement and/or consent. Our efforts in this
regard are simply to honor applicable tenets and rules.
Civil Engineering Consultin.q Services Selection Process
In an effort to offer recommendations to City Council relative to civil
engineering and architectural services, please be advised that staff will be
interviewing eight (8) firms early next week per requirements of the
Competitive Consultants Negotiations Act. The attached list outlines the
names of firms selected for review. It is therefore anticipated that one
engineering firm as well as possibly one architectural firm will be selected -
providing the City of Sebastian with the option of assigning projects to
companies other than just Kimley-Horn. A respective staff presentation
summarizing the selection and ranking process will likely be offered during a
March regular meeting.

At the request of you and the commission, I have visited Rolling Hills
Drive with our arborist. Most of the situations where we trimmed or topped
trees, leaving the trunks, were on vacant lots where we were not able to
make contact with the owners. Since the trees are on private property, I
suggest we send the attached letter to the property owners explaining what
we have done and what we would like to do. If you have any other thoughts,
please call me or reply by email.

Recently, Florida Power & Light completed the construction of a new electric
distribution line along the north side of Rolling Hills Drive between Barber Street and
Laconia Street. This project was necessary to provide relief for existing circuits that had
become overloaded. This will reduce the probability of electrical outages, particularly in
the high usage times of the year.
In order to provide the necessary clearance to the new line, it was necessary to trim pine
trees near your front property line. We know that when your lot is cleared for building,
these trees will most likely be removed. In order to improve the overall aesthetics to the
street, FPL is offering to remove and dispose of these trees at this time. If you are
agreeable to this, please sign the authorization form enclosed and return it to the above
address.

Re: Opportunity for Relocation of Skydive Sebastian Facilities
Dear Mr. lannaccone:
As you will recall from previous correspondence, Skydive Sebastian of South Florida,
Inc. was offered land at Sebastian Municipal Airport adjacent to the newly designated
parachute landing area. To date, officials from the City of Sebastian have not heard
from you relative to any potential relocation plans by your organization.
As referenced in the letter delivered to you dated January 28, 2004, the reactivation of
Runway 9-27 recently began, including a formal unanimous approval by City Council last
week to enter into contract with an area construction company. Please find the attached
rendering of the tentatively reserved parcel site as previously delivered to you. The City
of Sebastian requires a wdtten response regarding your interest in securing this site
within the next twenty (20) days. If no response has been received during the
prescribed timeframe, we will have to consider other alternatives and/or proposals.
The City of Sebastian is most willing to assist business partners in the community to the
extent possible while public goals and objectives are being implemented. Should you
