HomeMy WebLinkAbout01212004 CEB CITY OF SEBASTIAN CODE ENFORCEMENT BOARD COUNCIL CHAMBERS 1225 MAIN STREET SEBASTIAN, FLORIDA 32958 MINUTES OF REGULAR MEETING JANUARY 21, 2004 Attorney Stringer explained to the Board that he would be attending a meeting in the Building Department but would be available if needed by the Code Enforcement Board Chairman VanBuskirk called the meeting to order at 2:00 p.m. The Pledge of Allegiance was .led by the Chairman. ROLL CALL: Present: Ronald VanBuskirk, Chairman William Simmons Ken Cosco Salvatore Neglia Eva Schofield Robert Manuel, Alternate Hank Buchanan, Alternate Absent: Leon Griffin Fred Clement Also Present: Code Enforcement Officer Warren Linquist Code Enforcement Officer Antoine VanMeir Records Supervisor, Barbara Quinn Code Enforcement Board Secretary, Shirley Lynch 4. APPROVAL OF MINUTES: Regular Meeting 11/19/03 & Special Meeting 12/03/03 Minutes to both meetings approved by a voice vote 7-0. (Alternate Board Members Robert Manuel and Hank Buchanan are voting in place of the absentee members) 5. NOTICED HEARINGS: VIOLATION HEARING- CASE #2003-15531 SANDY PINES LTD- 102 FLINT STREET SECTION 66-3(12) CODE OF ORDINANCES INOPERABLE, JUNK OR ABANDONED VEHICLES AND VESSELS ON EXTERIOR PORTION OF RESIDENTIAL PROPERTY Chairman VanBuskirk swore in Code Enforcement Officer Antoine VanMeir. Mr. VanMeir gave his credentials and presented the City's case. Officer VanMeir explained that he received complaints on the inoperable vehicle through concerned citizens and the City Code Enforcemem Board Regular Meeting January 21, 2004 Page 2 of 4 Manager's office. At~er his investigation of the situation, the occupant was advised of the code violation and was issued a Notice of Violation on 11/10/03. According to Florida Statute Chapter 162, both the occupant and the owner of the property were notified of the violation and of today's hearing in compliance with City Ordinances. Neither the property owner nor the resident were in attendance at the meeting. A discussion by the Board members followed. MOTION made by Robert Manuel to give the occupant and property owners thirty (30) days from January 21, 2004 to rectify the violation or they will be subject to a $250.00 per day fine. BROWN-382 MANLY AVENUE SECTION 54-2-7.20 CODE OF ORDINANCES DISPLAY OF BUILDING NUMBERS REQUIRED Officer VanMeir presented the City's case against the respondent. His investigation was initiated on 11/17/03; on 11/30/03 he revisited the site to fred the tenants moving out. He sent a certified mail, return receipt requested to Pamela Brown which came back as undeliverable. He returned to the property on 1/14/04, spoke to the new tenants. On 1/12/04 the building numbers were afl'reed on the house. The respondent was not in attendance at this meeting. After a discussion by the Board a MOTION was introduced by Sal Neglia to find the property owner in violation with no fine at this time, however; if there is another violation, the owner will be liable for fines up to $500.00 per day, second by Ken Coseo ROLL CALL VOTE: William Simmons-aye Ken Cosco- aye Chairman Vanltuskirk- aye Sal Neglia- aye Eva Schofield- aye Robert Manuel- aye Hank Buchanan- aye Code Enforcemem Board Regular Meet'rog January 21, 2004 Page 3of4 MOTION CARRIED 7-0 CHAIRMAN'S MATTERS: Chairman VanBuskirk introduced Shirley Lynch as the new Code Enforcement Board Secretary. He also noted that Eva Schofield is now a member of the Board taking Jayne Barczyk's place and introduced Hank Buchanan as the new alternate. Mr. VanBuskirk called for the annual election of the Chairman and Vice Chairman positions. For Chairman: MOTION by Ken Cosco nominating Ron VanBuskirk as Chairman, second by Robert Manuel ROLL CALL VOTE: William Simmons-aye Ken Cosco- aye Chairman VanBuskirk- aye Sal Neglia- aye Eva Schofield- aye Robert Manuel- aye Hank Buchanan- aye MOTION CARRIED 7-0 For Vice Chairman: MOTION by Sal Neglia nominating Bill Simmons as Vice Chairman- Thero was no second MOTION by Ken Cosco nominating Sal Neglia as Vice Chairman, second by Eva Schofield ROLL CALL VOTE: William Simmons-aye Ken Cosco- aye Chairman VanBuskirk- aye Sal Neglia- aye Eva Schofield- aye Robert Manuel- aye Hank Buchanan- aye MOTION CARRIED 7-0 7. MEMBER'S MATTERS: Eva Schofield questioned if there is anything in writing that states who is responsible to maintain drainage ditches and easements along property lines. Code Enforcement Officer Warren Lindquist replied that yes, indeed there is an ordinance which states the property owners take care of the swale and drainage ditches in the side, fi.om and rear yards. He further stated that if it is a collector ditch the City will maintain it. Mr. Ken Jones can inform her which ditches the City takes care of. Upon questioning, Mr. Lindquist stated that each neighbor takes care of the ditch and easement to the center of each. Sal Neglia stated that there was a discussion about this at the last City Council meeting. He stated that the City will be buying a piece of equipment and will then take back the chore of cleaning all the ditches and easements. CODE ENFORCEMENT OFFICER'S MATTERS: Officer VanMeir read an article that was in the Vero Beach Press Journal about a Veto Beach Code Enforcement Officer. It stated that this officer had a case load of 218 for the year. Mr. VanMeir compared that figure to the 400-500 cased the City of Sebastian compiles for a month. He further stated that the Veto Beach officer was not certified by the State of Florida nor did he have a background in law enforcement. The starting salary for Code Enforcement Officers in Veto Beach is $32,718 while the City of Sebastian has a starting salary of $22,000. Chairman VanBuskirk stated that both Officer VanMeir and Lindquist are doing a very good job. A discussion followed about keeping up with the violations as the City increases in size. Officer Lindquist stated that both he and Officer VmuMeir are reactive to telephone complaints and proactive by looking for violations as they travel the City. He mentioned that they are having a hard time keeping up with the violations now. A discussion of trailers being parked at Winn Dixie followed. 9. CITY ATTORNEY'S MATTERS: City Attorney Stringer was not in attendance. 10. PUBLIC INPUT: The chairman asked if the members wanted to leave this as a line item on the agenda of the meeting. It was the opinion of the Board that the agenda should be left as is. 11.
