HomeMy WebLinkAbout03092004REGULAR MEETING MARCH 9~ 2004 Meeting was called to order by Chairman Nicolini at 7:00 P.M. The Pledge of Allegiance was said. ROLL CALL: Present: Chmn. Nicolini V.C. Garland Mr. Conover Mr. Wolfe Also present: Mr. Morris Mr. Gilligan Mr. Schmitz Mr. Davis (Alt.) George Bonacci, Building Director/Official Richard Stringer, City Attorney APPROVAL OF MINUTES: Regular Meeting of 12/9/04. MOTION by Morris/Garland I make a motion that we approve the minutes of the meeting held 2/10/04. A voice vote was taken, motion carried 7 - 0. OLD BUSINESS: None. NEW BUSINESS: Experior Exam Street, David V./Electrical Contractor - B & L only. Chmn. Nicolini swore in Mr. Street. It was noted that Mr. Street was approved to take the Master Electrical Exam at the December, 2003 meeting. MOTION by Conover/Garland I make a motion that we approve Mr. Street to take the Business & Law Exam for the Electrical Contractor. ROLL CALL: Mr. Schmitz - yes Mr. Gilligan - yes Mr. Conover - yes V.C. Garland - yes Motion carried 7 - 0. Mr. Wolfe - yes Mr. Morris - yes Chmn. Nicolini - yes For matter of record, the Master Electrical and B & L Exams will be taken at the same time. Once both are passed Mr. Street will be licensed as an Electrical Contractor. Chesnut, Kenneth/Residential Contractor - trade only. Mr. Chesnut was not present at the meeting. Loucks, Bradley/Plumbing Contractor Chmn. Nicolini swore in Mr. Loucks. V.C. Garland told the Board that he has known Mr. Loucks for a number of years, that he had worked with him at Maxwell Plumbing. He felt he was an outstanding individual and probably has more experience than most men have in the field. MOTION by Morris/Wolfe I make a motion that we approve Mr. Loucks to take the Experior Exam for a Plumbing Contractor license. ROLL CALL: Mr. Conover - yes Mr. Morris - yes V.C. Garland - yes Mr. Wolfe - yes Mr. Schmitz - yes Mr. Gilligan - yes Chmn. Nicolini - yes Motion carried 7 - 0. May, William B./Tile & Marble Chmn. Nicolini swore in Mr. May. V.C. Garland noted that there were two verification of experience forms filled out by different companies but both have close to the same dates. Mr. May explained that one was a full time job and the other part time. MOTION by Schmitz/Garland I make a motion that we approve Mr. May to take the Experior Exam for Tile & Marble. ROLL CALL: Mr. Conover - yes Mr. Morris - yes Mr. Schmitz - yes Mr. Gilligan - yes Chron. Nicolini - yes V.C. Garland - yes Mr. Wolfe - yes Motion carried 7 - 0. VIOLATION HEARINGS: Shannon Cook/1063 Persian Lane Chmn. Nicolini swore in George Bonacci, Building Official. Mr. Bonacci told the Board that on or about January 22, 2004, we received a call from Gammas that they had hired ASAP Aluminum to do a screen enclosure at the rear of the house and to close in a front porch. They were concerned about not having a pemfit for the job although Mr. Cook said he would get one, so they called our Department. They said that Mr. Cook was on the job so he (George) went out there. Shannon Cook was in front of the house so he was told to leave since he was not licensed in the City of Sebastian and there was no permit on the job. He was very cooperative and left. ASAP was qualified by Joseph Ackerman. Approximately two - three years ago, Mr. Ackerman did not renew his license so he was no longer active. Mr. Cook continued doing business. I asked Mr. Cook almost three years ago to have Mr. Ackerman come in so that this could be taken care of. He never came in. When Mr. Gamma called us, Mr. Cook suddenly found Mr. Ackerman, who presently lives in South Carolina, he came in and registered his business with us and got licensed with us. But the violation was prior to the company being re-instated. Mr. Cook was acting as a contractor without a license. Mr. Cook was operating out of his house, answering the telephone "ASAP Aluminum." He had advertising in the phone book, but a letter from the phone book company says it was in error. He also did not have an occupational license to do business out of his house. Mr. Bonacci explained that once there is a contractor license that the qualifier can give a letter of authorization naming a person or persons who can act in their behalf. He told the Board that Mr. Cook is no longer permitted in the Building Department, but since there is a third party involved, that person can act in Mr. Ackerman's behalf with a letter of authorization. Shannon Cook asked permission to speak to the Board. Chmn. Nicolini swore him in. He explained that the ownership of the business is a three way ownership. The qualifier and two managers. Mr. Shannon said that he told Mr. Gamma he was not licensed yet.. He took the job under the pretense that he was going to get a permit. Mr. Gamma was pressuring me so I did the front enclosure which was the size of a sliding glass door trying to buy myself another week. He admitted he was wrong but that he was busy in the County where he is licensed and didn't think he needed Sebastian. In regards to the advertising in the phone book, the Board did not feel the copy of a letter from the BellSouth Yellow Pages was specific about having put in the wrong physical address for ASAP. The Board Secretary said that she spoke with Mr. Russ Watson who wrote that letter. He did verify that it was their mistake in using the wrong address. MOTION by Conover/Morris I make a motion that we find Shannon Cook in violation of 26-171 (a), unlicensed contractor and 26-172(1), willful disregard of the building codes. ROLL CALL: Chmn. Nicolini - yes Mr. Morris - yes Mr. Gilligan - yes Mr. Schmitz - yes Mr. Conover - yes V.C. Garland - yes Mr. Wolfe - yes Motion carded 7 - O. MOTION by Morfis/Schmitz I make a motion that in violation of 26-171(a), unlicensed contractor we fine him $250.00 and in violation of 26-172(1), willful disregard of the building codes we fine him $300.00, a total of $550.00 and that this fine be paid within 90 days. Chmn. Nicolini asked if he wanted to put anything in the motion about the advertising, and Mr. Moms said no. ROLL CALL: Mr. Schmitz - yes Mr. Gilligan - yes Mr. Conover - yes V.C. It was noted earlier that ASAP is to pull an after the fact permit for this job and that it is to be doubled feed. BUILDING OFFICIAL MATTERS: None.. ATTORNEY MATTERS: None. BOARD MATTERS: None.
