Skydive Sebastian
In response to Wednesday evening's inquiry by Councilmember Ray
Coniglio relative to the status of Skydive Sebastian of South Florida, Inc.
and respective relocation efforts, please be advised that staff has been
working diligently for over two years to seek a formal commitment from
representatives of the company regarding the City of Sebastian's offer to
reserve property adjacent to a newly designated parachute landing area as
outlined in the Sebastian Municipal Airport Master Plan unanimously
adopted in February 2002. As some of you may recall during the master
plan adoption process, officials from Skydive Sebastian expressed an
interest to maintain their facilities as physically close as possible to the new
landing area. As such, the City of Sebastian made an offer to reserve
property that directly abuts the parachute landing site (please reference
letter dated February 28, 2002 from my office and response letter dated
from Skydive Sebastian legal counsel at the time, Buckingham, Doolittle
and Burroughs, LLP dated April 29, 2002 that expressed "...the proposal
alluded to in your letter may constitute the beginning of a workable
solution."). As also referenced in the attached correspondence, property
has therefore been reserved for Skydive Sebastian to specifically
accommodate their relocation interests accordingly. After nearly two years
of holding the property, staff recently initiated dialogue with representatives
of Skydive Sebastian in an effort to secure a firm commitment as to whether
or not they are still interested in relocating from their present lease site to
the reserved parcel. As such, as reported via the April 16, 2004 City
Council Information Letter, we requested a timely response to this effect.
Since then, we have received a letter from Attorney Peter Feaman that does
not accurately reflect previously addressed terms and conditions discussed
regarding the aforementioned relocation opportunity. In fact, it references
for the absolute first time, an expansion of Skydive Sebastian, and

therefore, the prospects of maintaining the existing lease, as well additional
acreage adjacent to the new landing area. As this response was offered by
Skydive Sebastian's legal representation, it became appropriate for City
Attorney Rich Stringer to provide clarification on our behalf. This was
accomplished via the attached letter compiled and delivered by him last
Friday, which simply states that reserved property was for purposes to
accommodate relocation activities, if they so choose to accept the
opportunity to do so. Therefore, the City of Sebastian is by no means
requesting Skydive Sebastian to vacate Sebastian Municipal Airport. City
administration simply needs to be informed as to their intentions; for their
facilities to remain at the present location or to relocate them to the reserved
parcel adjacent to the newly designated landing area as amicably addressed
over two years ago.
Clarification from School District of Indian River County
Asbury Subdivision Parcel North of Sebastian Elementary
After recently learning of presentations by residents to Sebastian City
Council about alleged interest on part of the School District of Indian River
County to purchase the proposed designated Asbury Subdivision Parcel
located north of Sebastian Elementary School, Assistant Superintendent of
Operations Mr. Greg Smith delivered the attached letter that clarifies their
position regarding this matter. The correspondence specifically states that
this information is incorrect in that no priorities exist for the School District to
acquire this land. Their focus in terms of planning for the purchasing of
additional property is to accommodate future school development activities.

Improvement Program
Utility Master Plan Capital
The attached electronic mail message from City Engineer David Fisher
outlines the current overall schedule for the implementation of the Sebastian
Master Stormwater Management Plan Capital Improvement Project
Schedule. This timetable was recently finalized as a result of staff and
representatives from Camp, Dresser and McKee and WCG NeeI-Schaffer
meeting to concur and establish a comprehensive implementation game
plan. As also referenced in David's synopsis, a progress report regarding
both the program and implementation of the various specific projects as

governed by the capital improvement schedule wilt be offered publicly later
this year, after certain tasks, including applicable surveys, geotechnical
reviews and notably, engineering designs have been completed.
Recommendations Re.qardin.q Driveway Permit Fees
As referenced in the 2003/2004 City of Sebastian Proposed Annual Budget
Letter of Transmittal, a goal of the Department of Engineering was to
ascertain the most productive and yet, cost effective means of engaging
engineering inspection services in our community. This exercise involved
analysis regarding the need for additional personnel to maintain respective
levels of services. However, before offering recommendations to City
Council to fund an addition engineering inspector position for this purpose, it
became imperative to fully ascertain respective costs of conducting
business in this regard, as well as determining what actual expenses should
be. Currently, the City of Sebastian charges $50 for its driveway permit
application. This fee assists (to some degree) with defraying costs for
necessary engineering review activities relative to new construction projects
in the community. As such, Mr. Fisher has recommended to my office a fee
adjustment to $90 to $100, consistent with charges imposed in all other
Treasure Coast Area counties and cities. A presentation that outlines final
recommendations will therefore be offered publicly during your June 9th
regular meeting.

Earlier this week, I hosted a telephone conference with Indian River County
Administrator Joe Baird in an effort to initiate additional dialogue relative to
existing concerns regarding the water utility rate equalization charge being
levied against customer bills in our community. I then invited Mr. Baird to
briefly join us during the June 9th meeting to publicly address City Council to
outline the rationale associated with this arrangement, as well as to
entertain questions and/or concerns accordingly. His discussion will
therefore be scheduled via the presentation section of the agenda.

Rate Adjustments from Comcast Cable
I received the attached letter from Comcast Cable advising the City of
Sebastian of price adjustments to basic and extended cable service to take
effect beginning July 9th. The notice includes charts that outlines both
current and new prices for respective subscription charges, all of which
range in net adjustments totally $.15 to $1.50 per month. As Comcast
satisfied the City of Sebastian's franchise agreement requirement to inform
both administration and customers of such changes within a sixty (60) day
timeframe before new rates are implemented, no City Council meeting
presentations regarding this matter will take place.

I understand that a citizen represented to the Sebastian City Council that the Indian River
County School Board had identified "Ashbury Park" as a priority for purchase as a school
site.
That information is incorrect. I was approached by an interested party who gave me a
drawing of the property, and asked that the District consider the property as a school site.
I told her that we would do so, as we will consider any viable property offered to us for
consideration of future school sites. Our priority is for a site in a differem location and
no priority has been placed on the Ashbury site.

The current overall schedule for this entire package of eight different projects calls for:
· Surveys, geotechnical studies, and environmental assessments to be complete by mid-July 2004
(about 2 months from now).
· Conceptual design and model update to be complete by October 2004 (about 5 months from now).
· All necessary land acquisition to be complete by later this year.
· Progress report to be offered publicly to be facilitated by Winter 2004.
· Design drawings to be complete by Early 2005.
· Permitting to be complete by Spring 2005.
· Construction contract bidding process to be complete by Summer 2005.
· Construction on all fronts to take place beginning Summer 2005 and to be complete by Fall 2006
(a construction period of about 14 - 15 months or so).

Proposed Increase in Driveway Permit Application Fee

As we have discussed at length in recent months, this is to confirm our request to raise the Driveway Permit
application fees from current $50 to the $90-$100 range. This increase will better reflect the Engineering
Department's actual cost of the field inspections and internal administrative procedures related to these
permits which are required for every building project in the City and, as you know, continue to dramatically
increase in volume.
The proposed $90-$100 range is consistent with what is currently being charged by other counties, cities,
and agencies in the Treasure Coast area.
Thank you for your further guidance and assistance in putting this increase into effect.

Dear Mr. Feamon:
City Manager Moore &nd Airport Director Milewski have discussed your letter of April
30, 2004 with me. My personal recollections, as well as the extensive correspondence on
this matter (inctuding some written by you), reflect that the subject under discussion has
always been the relocation of the Sk'ydive Sebastian facilities, not the expansion of the
same. The City is not interested in such an expansion.
I do not dispute that your chent has every right to continue in the current lease. In the
alternative, it can relocate its facilities to the area offered by the City, but it is within the
purview of the City to condition that offer on the phase-out of the current facility.
Il'your client feels that the relocation makes financial sense, then please inform me within
the established time parameters that this option will be pursued. If your client feels that the
relocation does not make economic sense, then continue with the existing lease and the
City will place the alternative site back on the market. If you feel that the City's actions
somehow constitute a taking, we do not have much further to discuss, so the third option
for your client is to address these matters to a judge. It is time for a decision.

Dear Mr. lannacoone:
As discussed during our telephone conference Fdday, Apdl 2, 2004, please reference the
following terms as they pertain to the discussed amendment to the lease agreement between the
City of Sebastian and Skydive Sebastian of South Florida, Inc., governing property at Sebastian
Municipal Airport.
City admin(stration is prepared to recommend to City Council a lease amendment containing the
following terms and conditions. A lease of a new parcel will become effective the date of
execution of this amendment. Skydive Sebastian of South FIo[ida will therefore be granted
twelve (12) months to construct and occupy the new premises. Termination of the lease
governing the existing premises will then take effect. AIl terms, conditions and rental amounts as
outlined in the odginal lease agreement will remain unchanged.
As you will recall, the City of Sebastian initially reserved pmper~y exclusively for Skydive
Sebastian adjacent to the newly designated landing area over two years ago. This arrangement
was, of course, facilitated in response to the unanimous adoption of the most recent Sebastian
Municipal Airport Master Plan in February 2002. As time is now therefore of the essence,
Skydive Sebastian will have thirty (30) days to accept terms and conditions as outlined in this
framework. Formal acceptance of these terms must be delivered to Sebastian City Hall in writing
within this specified timeframe. In addition, Skydive Sebastian will be expected to finalize and
execute a respective amended lease agreement within a subsequent 30 day period. Failure to
meet required timeframes wilt result in the City of Sebastian having the ability to market the
reserved property to enable consideration of other lease opportunities at current market rates.
The Sebastian Management Team looks forward in working with Skydive Sebastian to implement
the aforementioned ccurse of action. Should you have questions and/or require further

Dear Mr. lannaccone:
As you will recall from previous correspondence, Skydive Sebastian of South Florida,
Inc. was offered land at Sebastian Municipal Airport adjacent to the newly designated
parachute landing area. To date, officials from the City of Sebastian have not heard
from you relative to any potential relocation plans by your organization.
As referenced in the letter delivered to you dated January 28, 2004, the reactivation of
Runway 9-27 recently began, including a formal unanimous approval by City Council last
week to enter into contract with an area construction company. Please find the attached
rendering of the tentatively reserved parcel site as previously delivered to you. The City
of Sebastian requires a written response regarding your interest in secudng this site
within the next twenty (20) days. If no response has been received during the
prescribed timeframe, we will have to consider other alternatives and/or proposals.
The City of Sebastian is most willing to assist business partners in the community to the
extent possible while public goals and objectives are being implemented. Should you

Dear Mr. lannacoone:
The City of Sebastian is currently finalizing preparations for the rehabilitation of Runway
9-27 at Sebastian Municipal Airport. As you may recall from previous correspondence,
reservations have been made for both a newly designated parachute landing area, as
well as a pamel to house facilities for Skydive Sebastian, if so desired. Airport Director
Jason Milewski and myself are therefore available to meet with you and/or other
representatives from your business to address applicable logistics accordingly, including
respective timeframes governing such potential relocation activities. Please contact
either of us within the next fifteen (15) days so that we can schedule a meeting in an
effort to amicably move forward in this regard.

Dear Mr. Moore:
Skydive Sebastian of South Florida, Inc., ("Skydive") has forwarded your February 28, 2002
correspondence to Mr. James T. Iannaccone for response. In the interest of fully exploring any
reasonable proposals for amicable settlement ,and without waiving any rights or remedies
available to Skydive, it would appear that the proposal alluded to in your letter may constitute
the beginning of a workable solution.
Whether the City's proposal ultimately proves to be viable depends in great part upon whether
the City is willing and able to adequately address Skydive's concerns in terms of available lands,
specifics regarding suitability of the City's proposed redesignated landing area for such use, and
applicable time frames. In any event, since the City has indicated its willingness to reserve for
and lease to Skydive, lands contiguous to the proposed Redesignated landing area, so as to
accommodate facilities needed to properly service Skydive customers at such newly designated
landing area, Skydive is certainly interested in exploring that proposal.
Please provide us with dates and times when you would be available to meet with Skydive
representatives at City of Sebastian offices to discuss these matters further.

Re: Adiustment to Redesipnated Parachute Landing Area
Dear Mr. lannacoone:
As the City Council recently adopted the newly revised Sebastian Municipal Airport
Master Plan, as well as formally offered you the opportunity to work with city
administration to adjust to respective realities outlined in the plan, [ wish to address
various opportunities available to assist Skydive Sebastian of South Florida, Inc. with the
transition to the future designated parachute landing area.
A primary concern presented by you and your representatives involved the necessity for
the parachute landing area to be adjacent to your facility. You will be pleased to know
that property is available adjoining the redesignated area, large enough to accommodate
your existing facilities. The City of Sebastian therefore has the ability to reserve this
property for Skydive Sebastian, should there exist interest to relocate any necessary
structures at your expense. In addition, my office is willing to work with your
organization to formalize a modified lease agreement to this effect. As such, you may
feel free to contact my office at your convenience by calling (772) 388-8203 to further
dialogue accordingly, as I am also available to host personal meetings as necessary.
