ANNOUNCEMENTS:
Chmn Smith welcomed Mr. Lawrence Paul to the commission. He announced that Mr.
Keough is excused and Mr. Simmons would be voting.
APPROVAL OF MINUTES: 4/15/04

A voice vote was taken. Motion carried,

NEW BUSINESS:
ACCESSORY STRUCTURE REVIEW - SECTION 54-2-7.5 -649
CARNIVAL TERRACE - 24' x 30' DETACHED GARAGE - WILLIAM &
PAT HEINZ
Mr. William Heinz. 649 Carnival Terrace, Sebastian, Florida presented his application.
This garage will be used to house his older, classic 1985 Chevy pick-up truck. Ms.
Bosworth added that the garage would closely match the house in design and color. The
building permit would not be completed until Engineering approval for the second
driveway is obtained. He meets setbacks and is not near the easements. Staff
recommends approval. Mr. Mahoney asked why the garage doors face east/west and

the driveway is north/south. Mr. Heinz responded that this would allow for airflow and
there would be electricity to the garage for lights. Mr. Paul asked if the existing trees
would remain and Mr. Heinz said they would remain and additional plantings would be
installed.
MOTION by Simmons/Faille
"1 make a motion that we approve the 24' X 30' detached garage at 649 Carnival Terrace
as listed."

B. QUASI-JUDICIAL PUBLIC HEARINGS -
CONDITIONAL USE PERMIT - NEW MODEL HOME PERMITS -
MARONDA HOMES AT 891,901 AND 867 ROSELAND ROAD
Chmn. Smith opened the public hearing at 7:08 p.m. and asked if a representative was
present. Ms. Bosworth said it is the board's discretion if they wanted to wait to see if
someone shows up late or table to the next meeting. Chmn Smith said they would move
on with the agenda.
CONDITIONAL USE PERMIT - MODEL HOME RENEWAL - HOLIDAY
BUILDERS - 1078 & 1080 BARBER STREET
Ms. Bosworth reported that there have been no complaints, violations or problems at
these model home sites for the four years they have been in existence. She explained
that although the application noted one address, it is for both models on lots 1 and 2.
Staff recommends approval.

"1 make a motion that we approve Holiday Builders model homes permit for another year
at 1080 and 1078 Barber Street."

Ms. Bosworth stated that there have not been any complaints, violations or problems at
this site. The parking is on the lot next door. They have done a nice job on landscaping.
Staff recommends approval.

Barber Street."

The vote was 7-0. Motion passed.
Chmn. Smith asked Ms. Bosworth what should be done regarding Maronda Homes and
she suggested it be rescheduled to the next meeting and offered to answer questions
from people who came out tonight.
Ms. Linda Smith, 910 Roseland Road, Sebastian, Florida, wanted to make the
commission aware of traffic problems the model homes have already created. People
have parked on their front yard and also on the side street obstructing the line of sight for
traffic. Ms. Bosworth reported that the parking is not finished and the model home
permit is not released until a parking inspection is completed. It was suggested that "no
parking" signs could be put up in front of the Smith's property. Mr. Mahoney asked
about the notation on the application of a sales office. Ms. Bosworth explained they can
go up to the binder part but it is not the office where contractors pick up checks.
CHAIRMAN MATTERS: NONE
MEMBER MATTERS:
Mr. Mahoney asked about Hurricane Harbor paving and landscape. Ms. Bosworth said
they recently submitted a landscape plan. Mr. AIIocco asked if the Best Western started
building again and Ms. Bosworth said they had.
DIRECTOR MA'I-rERS:
Ms. Bosworth explained ex-parte communications as driving by the site, get out and
walk around the site, if you meet with a developer or applicant on any project, any
correspondence you received at your home regarding a quasi-judicial application, and
any internet communication. If you get an e-mail you can either bring us a printed copy
or forward it to Susan or myself. City Clerk Maio is formalizing a policy and we will get a
copy to the commission when it is completed.
ATTORNEY MATTERS: NONE
Mayor McCollum addressed the commission. He responded to a letter from Chmn.
Smith and stated that Planning and Zoning commissioners should be receiving updated
copies of items that have gone before them and sent on to City Council.
Chmn Smith adjourned the meeting at 7:26 p.m.
