MAY 20, 2004
Chairman Smith called the meeting to order at 7:00 P.M.

ANNOUNCEMENTS:
Chmn Smith announced that Mr. Seeley and Mr. Oakes are excused. Mr. Simmons will
be voting. Chron. Smith gave an update of former commissioner Mr. Blessing's health
condition and said he is to be admitted to Hospice on Tuesday.
APPROVAL OF MINUTES: 5/06/04
Mr. Paul asked for a clarification of ex parte communication as the minutes reflected that
driving by a site and walking around the site was also considered ex parte. Mr. Hass
responded that any communication with an applicant or their representative is ex parte
but if a commissioner did a site visit it should be mentioned but it is not considered as ex
parte communication.
MOTION by Paul/Keough
"1 make a motion we approve the minutes of 5106/04."
A voice vote was taken. Motion carried.

Chmn. Smith opened the public hearing at 7:04 p.m. Representing Maronda Homes
was Mr. Steve Torres, 750 U.S. Highway #1, Grant, Florida. Chmn Smith swore in Mr.
Hass, Ms. King and Mr. Torres, who said the parking situation is being worked on. The
driveways have been altered and parking directional signs are being installed. Mr.
Torres said he understood that the city would put up "no parking" signs across the street
in front of existing residential properties. Ms. King said the Engineering Department is '
going to review the parking situation if additional signage would be required. Staff
recommends approval of all three model home permits. Mr. Mahoney confirmed there
would be handicap parking and Mr. Paul asked about the hours of operation, which will
be 10 a.m. to 6:00 p.m.
Linda Smith, 910 Roseland Road, Sebastian, Florida said she would be happy with
anything that would resolve the parking situation. She said people are still parking on
her front yard and normal sized cars have difficulty turning around in the parking area to
pull out onto Roseland Road. Chmn Smith asked Ms. King to inform the Engineering
Department of these issues. Mr. Torres said he has been in contact with Mr. Patnode of
Engineering and his concerns were getting too close to the drain fields.
Chmn. Smith closed the hearing at 7:22 p.m.

"1 make a motion that we accept the staff's recommendation as far as approval of the
model home permits on all three with noting one exception as far as the parking input to
the property line requires a waiver."

NEW BUSINESS:
Quasi-Judicial Public Hearing - Site Plan - Administration Building
& Police Evidence Compound - Sebastian Municipal Airport
Chron. Smith opened the public hearing at 7:24 p.m. and swore in Mr. Jason Milewski,
Airport Director. Chron. Smith inquired when the police evidence compound was added
to the site and Mr. Milewski said it was always part of the project. The 10,000 SF
building will house Engineering, Public Works and Airpor[ Administration offices, with
each having the ability to function entirely independent of the other areas. The building
also offers the ability for any of the departments to expand without interfering with other
departments or the public access area. The building has two conference rooms to
support an Emergency Command Center. This area is hardened for 200 mile an hour
winds and is a FEMA rated facility. The existing rotating beacon has been incorporated
into the construction of the building and there would be no change to the current
operation of the beacon. Mr. Hass added that by moving the police evidence compound
to the airport it would free up the space the city currently occupies. Eventually the public
works compound would be moved to this facility as well and that would then help

redevelop the central corridor on CR 512. Mr. Mahoney had construction-type
questions, which Mr. Milewski answered. Location for a dumpster site was discussed.
Mr. Paul was concerned that the 30' X 30' size of impound area would be too small for
future use. He also asked about the concrete thickness of 4 inches and Mr. Moia of
Mosby & Associates said that was for the sidewalks only. The building will have
sprinklers. Chmn. Smith closed the hearing at 8:02 p.m.

CHAIRMAN MATTERS: NONE
MEMBER MATTERS:
Mr. Mahoney asked the city attorney for a definition of what constitutes a water body.
Mr. Stringer said retention ponds are counted but general wetlands are not counted. Mr.
AIIocco asked Mr. Stringer about the personal liability of commissioners stating recently
in Dade County commissioners were sued personally by an applicant. Mr. Stringer
responded that as long as commissioners are performing their duties within the scope of
the code, you have immunity and if the commission was named in a lawsuit, the city
would defend anyone named.
DIRECTOR MATI'ERS:
Mr. Hass mentioned upcoming City Council meetings. The June 3rd Planning and
Zoning meeting may be canceled.
Mayor McCollum mentioned that the PowerPoint presentation at the last City Council
meeting is public record and available at the City Clerk's office. He affirmed that
although Planning and Zoning looks at applications for their site value, the City Council
must take into account other factors such as, financial impacts.
ATTORNEY MATfERS:
Mr. Stringer said the reason so many applications have been bundled together for the
City Council meetings is that the State reviews them as one bundle so they must be sent
simultaneous to the Department of Community Affairs.
