Earlier this week, I received the attached letter from Indian River County
Director of Community Development Robert "Bob" Keating relative to the
status of the City of Sebastian's resubmitted grant proposal seeking
Metropolitan Planning Organization (MPO) funding from the Florida
Department of Transportation (FDOT) to finance beautification efforts to
benefit Sebastian Boulevard/County Road 512. As referenced in the
second paragraph, FDOT has (once again) determined the project to be
eligible for respective funding opportunities. At this time, FDOT requires
applicants to respond to various items that deem further clarification. In the
case of the City of Sebastian, a written response stating that we will work
with Indian River County to establish an interagency agreement governing
maintenance activities, applicable project cost revisions, as well as an
anticipated project length (number of miles of roadway to be benefited). In
an effort to satisfy a respective August 16th deadline, a letter outlining this
information will be delivered to the MPO office next week. If all goes well,
improvements can be initiated in Fiscal Year 2006/2007.
Programming Efforts for Laconia Street Expansion Pro,qram
Earlier this week, my office hosted a meeting with representatives from
Indian River County relative to implementing an extension program involving
Laconia Street from the current termination point of Concha Drive, south to
County Road 510. After a substantive discussion regarding the matter, a
consensus was expressed on part of both parties that such an initiative is an
excellent idea in terms of long-term traffic management objectives. As
such, a presentation by MPO Program Manager Phil Matson will be offered

publicly during your August 25th regular meeting in an effort to educate City
Council relative to various avenues and funding opportunities to implement
this project in a timely fashion. A possible focus in this regard will be to
establish a joint city-county partnership to finance and implement
improvements accordingly, without having to engage the lengthy process
typically associated with an MPO funding arrangement. After this
discussion, City Council will possibly be able to offer additional formal
direction as to time frame scheduling and other applicable logistics.
Municipal Complex Monthly Expenditure Report
The attached July 31, 2004 spreadsheet report represents the most recent
summary of total expenditures related to the development and construction
of the Sebastian Municipal Complex. As referenced in the total budget
column, overall project costs total $11,461,800 (including all items as
referenced in the first Municipal Complex Monthly Expenditure Report
provided via the May 21, 2004 City Council Information Letter- bond
proceeds, Bureau of Historic Preservation Grant, etc., as well as a recent
$6,500 adjustment to finance costs associated with shuffleboard court
installation. Therefore, a $6,500 reduction is to be facilitated at the close of
the project, to reflect an original total budget equating to $11,454,800).
Expenditures to date for the project total remain at $6,668,087.29. The
current outstanding encumbered amount equals $3,664,024, which
represents various related purchase orders, leaving an unencumbered
balance totaling $1,122,688.71 to cover additional expenses until the project
has been completed. Once again and as such, staff therefore remains
confident that total expenditures will not exceed the aforementioned total
project budget. In addition, I anticipate announcing a time and date for a
dedication ceremony date by earlier October, to include both overall agenda
and scheduling details associated with the event.
Waste Mana.qement Consumer Price Index Adjustment
My office has recently received the attached letter from Waste Management,
Inc. Florida Government Affairs Director George Geletko announcing the
company's intention to incorporate a Consumer Price Index (CPI) into waste
collection rates effective October 2004. As referenced in the
correspondence, the existing franchise agreement with the City of Sebastian
allows Waste Management to engage such an adjustment to help defray
respective business expenses. Quarterly bills governing residential rates

will therefore be $33.21, a $.96 adjustment from the current bill totaling
$32.25. Additional rate structures for various commercial service programs
are also listed. This arrangement represents a very common practice/
industry standard for solid waste service providers that do not enjoy a
mandatory collection agreement with a jurisdiction (the previous franchise
agreement with Capital Sanitation contained a similar provision, to be
executed via a notification process to the city - if it was ever decided that the
contract clause was to be exercised).

Dear Mr. Moore:
Attached please fred a copy of a July 22, 2004 letter to the MPO fi.om FDOT
regarding FDOT's eligibility determination for the Indian River County MPO's 2004
enhancement project applications.
As you can see, FDOT determined that the City of Sebastian's CR 512 Scenic
Beautification enhancement project application is an eligible project. That eligibility,
however, is dependent upon the City adequately resolving the "flags" associated with
the project. The flags are noted on page 1 of 2 of the 2004 Enhancement Eligibility
Summary Table, which was included as an attachment to the July 22, 2004 FDOT
letter to the MPO. Page 2 of 2 of that table identifies the items associated with the
flags.
According to FDOT, each of the flag items referenced above must be adequately
resolved by August 20, 2004. To meet that deadline, responses must be sent to the
MPO by August 16, 2004.
Please ensure that all items referenced on the 2004 Enhancement Eligibility
Summary Table are adequately addressed in your response to the MPO. Those items
include providing additional information on clear zones and sight Iriangies, drainage
in the median, a cost breakdown of funds, LAP certification, and maintenance for the
life of the project and facilities.
The next phase of the 2004 enhancement project application process is ranking the
project applications submitted to the MPO. That ranking will be done bythe MPO at
its September 8, 2004 meeting as part of its annual project prioritization activity.
Prior to the MPO meeting, both the Technical Advisory Committee (TAC) and the
Citizens Advisory Committee (CAC) will consider priority projects, including
enhancement project ranking, and make recommendations to the MPO. The TAC
will meet August 20, 2004 to consider this issue, while the CAC will meet on August
31, 2004.

Project Cycle applications ~d by your office. The.se_ determinations are included on the

Enhancement Projects", Topic No. 525-030-300-h, effective February 21, 2003.
Eligible projects are those ha~,a complete applicatiom meet the eligibility criteria and
implementation guidelines, and~comlmction appears to be feasible. Only projects determined to
he Eligible can be considered for inclusion in the Department's Tentative Work Program~ based
upon the MPO's final project priority list w.h_ich is due to the District Office no later than
September 30, 2004.

and requirements:

It is requested that project sponsors with pending "P" applications as indicated in the
attached Enhancement Eli~bility Summary SFreadsheet, submit revised applications and
all supplemental information included in the comments section, to the Department and the
MPO by August 20~'. The provision of ail information to the Department in an
expeditious manner will allow for the Department to change applications in "pending"
stares to "eligible" status in time for MPO consideration in their project pfioritization
process.
By September 30, 2004, M:POs are to officially noti~ the District and the project
sponsors of the final priority rankings for enhancement projects.
The project sponsor must certify ownership and po~e~sion of'the right-of-way described
in the enlaaneeanent application. This ecmification must be completed, and submitted to
the District Office, before federal authorization for construction is given. Failure to
provide this certific,,tion will re*ult in the project being determined Not Eligible.
Maintennnce Memorandum of Agreement OVIOA) is required for enhancement projects
involving landscaping mid is due prior tO the desil~ phase of the project. Federal
authorization for construction will not be given until this MOA has been executed.
Additionally, review of landscaping along state roads and at state road intersections will
require i:DOT approval for compliance with state standards. For information regarding
the MOA and review ofiandscape plans, Ms. Eliaabeth Hassett in the District
Planning & Environmental Planning Office, should be comacted. Ms. Hassett nmy be
reached at (954) 777-4219.
Using each MPO's final priority list, the District will program eligible projects within
available funding levels for the upcoming Tentative Work Program ('FY 2005/06 -
2009/10).

Dear Mr. Moore,
The Franchise Agreement for Solid Waste Collection Resolution allows Waste Management a CPI adjustment to
start October 1, 2004 to reflect changes in the cost of doing business. The adjustment for the CPI reflects with
Article 12.0 (Adjustment to Rates) page 13 of the franchise agreement.
Attached is a copy of the month of June's CPI. The net change for the preceding twelve months is 3.22% The
Agreement requires "no increase or decrease shall exceed 3% per annum". The listed rates for all collection services
below reflect a 3% increase in accordance with our 4.greemeat.
