MINUTES OF REGULAR MEETING
JUNE 16, 2004
1. Chairman Van Buskirk called the meeting to order at 2:00 p.m. with a salute to the flag.

3. APPROVAL OF MINUTES: Regular Meeting 04/21/04
The minutes were approved as written by a voice vote 7-0 with a correction ora typo on
the second page (Cosco spelled Costco)
NOTICED HEARINGS:
Chairman Van Buskirk noted that the first item on the agenda has been postponed
until the August meeting at the request of the respondent. Mr. Stringer informed
the Board that the loud music item would be heard through the County court
system not in front of the Sebastian Code Enforcement Board

The following items, conditions, or actions, is hereby declared to be and
constitute a nuisance:
(1) Accumulations of trash, litter, debris, garbage, bottles, paper, cans, rags,
dead or decayed fish, fowl, meat or other animal matter, fruit vegetables,
offal, bricks, concrete, scrap lumber or other building debris or other refuse of
any nature;
(2) Any condition, which provided harborage for rats, mice, snakes, and other
vermin

Chairman Van Buskirk swore in Code Enforcement Officer, Antoine Van Melt, who stated his
qualifications and presented the City's case to the Board. Pictures taken by Officer VanMeir
were given to the Board for their review. Officer VanMeir stated upon questioning that these
photos fairly and accurately represent what he saw upon his inspection of the property.
Chairman Van Buskirk swore in Mr. Jeffrey Blossom. Mr. Blossom stated that he & his wife
had hired a handyman to clean up the property. He said that some progress had been made but
the job was never finished. He hired another company and promised the Board that the property
will come into compliance with code by the end of this week.
After a discussion, MOTION made by Chairman Van Buskirk reference Case #04-13681 to find
Mr. & Mrs. Blossom in violation according to Section 39-66-3.(1)(2) of the City of Sebastian
Code of Ordinances with an extension of five (5) days to bring the property into compliance. If
the property is not in compliance at the end of those five days, then a $250.00 per day fine will
be imposed until the code is complied with, second by Ken Cosco

Chairman Van Buskirk stated to Mr. Blossom that the property must be in compliance by
6/23/04, or else the daily fine will begin. Mr. Blossom stated he understood but that it would be
cleaned up by the end of this week.
CHAIRMAN'S MATTERS- Chairman Van Buskirk informed the Board that Salvatore
Neglia resigned his position with the Code Board to take a spot on another board. He said
he appreciated the good job Mr. Neglia has done for the Code Board and the City of
Sebastian. Chairman Van Buskirk introduced the newest alternate member to the Code
Enforcement Board, Charles "Ed" Dodd.
The chairman stated he had attended Code Board meetings in Vero Beach & the county.
When a motion was made it got very confusing, that is why he is making motions using
the case number and trying to be very clear in his wording.
7. MEMBER'S MATTERS- Mr. Anderson stated he will be away for the next two months,
Mr. Clement will be away for the next meeting.

7. CODE ENFORCEMENT OFFICER'S MATTERS: None
8. CITY ATTORNEY'S MATTERS: Mr. Stringer explained that the code officers can not
go on private property to inspect, they need a warrant. The city is starting the process of
obtaining an inspection warrant for the first time.
Being no further business to come before the Board, Chairman Van Buskirk adjourned the
meeting at 2:24 p.m.)
