HomeMy WebLinkAbout03171999 CITY OF SEBASTIAN CODE ENFORCEMENT BOARD MINUTES OF REGULAR MEETING MARCH 17, 1999 Chron. Neglia called the meeting to order at 2:57 pm. The Pledge of Allegiance was said. ROLL CALL: PRESENT: Ms. Barczyk Chmn. Neglia VChmn. Cosco Mr. Schofield Mr. Davis (a) Mr. Cavallo Mr. Connelly Ms. Griffin(a) Ms. Men'iff ALSO PRESENT: Tracy Hass, Growth Management Director Rich Stringer, City Attorney Kay O'Halloran, City Clerk Kathy Brauer, Code Enforcement Officer Tim Zelinski, Code Enforcement Officer Ann Brack, Recording Secretary ANNOUNCEMENTS: Chmn. Neglia introduced the newest Board member, Mr. Adrina "Al" Davis. He noted that, since all members are present, Mr. Davis would not be able to vote but he should participate in discussions. APPROVAL OF MINUTES: (2/17/99) Mr. Stringer noted that on page three of the minutes of 2/17/99, he passed responsibility to Mr. Hass for checking into aidng these meetings over Falcon Cable TV. MOTION by Cosco/Barczyk I make a motion we accept. A voice vote was taken. The vote was 7 - 0, motion carried. There was a spelling correction to Mr. Davis' first name -Addna. OLD BUSINESS: Mr. Cosco referred to his motion on page two (2) of the minutes of January 20, 1999, which was corrected as follows: CODE ENFORCEMENT BOARD MINUTES OF REGULAR MEETING OF MARCH 17, 1999 MOTION by CoscolConnelly I would make a motion that we find them in non-compliance and without a fine, I guess, Case #98-014310, find them in violation, without a fine, and the Board has the option of fining them on a repeat basis. Discussion: It was determined to add "refrigerator with a door on it is serious, I would say up to $250 dollars per day" (to the above motion). Mr. Connelly withdrew his second on the motion, and Chmn. Neglia seconded the amended motion. All members voted "yes" - 6 - 0 motion carried. NEW BUSINESS: A. Violation Hearing - Case #99-14606 - David Beach - 217 Delaware Avenue - Section 98-36(b) and 86-47, Code of Ordinances Mr. David Beach, 217 Delaware Avenue was present and, along with Kathy Brauer was sworn in at 3:03 pm. Ms. Brauer noted that Mr. Beach is now in compliance on this violation. Mr. Beach gave an explanation of the presence of the subject vehicle. Ms. Brauer gave information about finding this violation on 2/18/99 and submitted two photos as Exhibit #1. She issued a notice of violation on 2/24/99 with five days to correct it After five days, the vehicle was still there and she went through the process to bdng him before the Board. She then noted that he had come into compliance sometime between 3/2/99 and the morning of 3/17/99. Mr. Beach noted that he put it in his garage on 3/16/99. MOTION by Connelly/Cosco I move, in the matter of Case #99-14606, David Beach, 217 Delaware Avenue, being in violation of Section 98-36(b) and 86-47 our Code of Ordinances, is in violation as charged by our Code Enforcement Officer and that we let him go with the advisement that future similar violations may result in him being fined. Discussion: There was discussion on designating an amount for any future fines for repeat violations. Mr. Connelly preferred not to include this issue in the motion. ATTORNEY MATTERS: Mr. Stringer passed out copies of the Florida Statute that covers abandoned refrigerators, etc., to Board members. He noted that this issue is covered by State Law, and in emergency situations, the Police Department should be contacted. He then commented that a violation of this Statute is a second-degree misdemeanor. Mr. Connelly commented on a refrigerator that he has seen on Schumann Ddve, apparently put out for trash pickup, with the opening and door on the ground. Ms. Barczyk suggested that, in any future cases of abandoned refrigerators, similar to the one above, this Statute could be quoted to the violator. GENERAL DISCUSSION: Kay O'Halloran, City Clerk for Sebastian, was present for a discussion on broadcasting these Code Enforcement Board meetings over Falcon Cable TV Channel 35, local access channel. She noted that these meetings may be broadcast, however, not dudng hurdcane season. She then noted the last meeting (February 17, 1999), and cautioned the Board members about their wording, and invited Mr. Neglia to her office for a discussion, then he can relay the message to his Board - in the "Sunshine". Ms. Barczyk asked if Code Enforcement has any procedure to identify certain sites that could be fire hazards dudng these extreme dry seasons, such as unimproved lots within the City. Ms. Brauer responded that the City cannot force owners of unimproved properties to clear or cut back the vacant lots. Mr. Stringer noted that it does not meet the City's cdteda of debris. He suggested contacting the Division of Forestry. Mr. Schofield recommended that all homeowners should keep their outside garden hose hooked up and ready to use should a fire threaten from surrounding properties. Chmn.
