Chairman Van Buskirk called the meeting to order at 2:00 p.m. with the pledge of allegiance. 2. ROLL CALL: Present: Chairman Ronald Van Buskirk Mr. Kenneth Cosco Mr. Fred Clement Ms. Eva Schofield Mr. Hank Buchanan, Alt Mr. Howard Brauer, Alt Absent: Mr. Leon Griffin Excused: Mr. Carl Anderson Also Present: Code Enforcement Officers'. Antoine Van Meir Warren Lindquist City Attorney Rich Stringer Code Enforcement Board Secretary Shirley Lynch Chairman VanBuskirk stated alternate members, Mr. Buchanan & Mr. Brauer will be voting in place of Mr. Griffin & Mr. Anderson 4. APPROVAL OF MINUTES: Regular Meeting 06/16/04 The minutes were approved as written by a voice vote 7-0 5. NOTICED HEARINGS: A. VIOLATION HEARING-CASE 02004-19158 MATTHEW GUTHRIE- 425 PINE STREET SECTION 54-3-12.4 LAND DEVELOPMENT CODE Chairman VanBuskkk swore in Code Enforcement Officer Antoine VanMeir who gave his credentials. He said that 425 Pine Street was brought into compliance and will get a permit from the City Engineer Department to place a culvert in the swale line to constrnet an accessory driveway- Mr. Guthrie removed the work done and brought the swale back into a 3 to 1 slope and reseeded it. This item was removed from the agenda. B. VIOLATION HEARING- CASE #2004-18390- EDWARD & MARILYN H1NO- 509 BREAKWATER TERRACE SECTION 66-3.(12) CODE OF ORDINANCES Code Enforcemem Meeting August 18, 2004 Page 2 of 3 Officer VanMeir said he spoke to Mr. Hino this morning and told the board the Mr. Hino would not be in attendance at this hearing. Officer VanMeir handed out photographs taken of the problem being solved. The 1~ photo shows the location of the propemy; the 2na photo shows the house on the property with the track in the vicinity; the 3~a photo shows the track & license plate with a currem decal that expires 12/04. He stated that originally the truck was up on blocks, with no tires and no truck bed. The owner's intent was to restore the vehicle and use it for transportation. It took time to bring them into compliance. Officer VanMeir reported at this time all tires have air in them, the bed is back on the track and physically, looking at the vehicle, you cannot say that it does not run. The violation was brought to hearing because it was not registered. The lights work, it runs, it looks like it is street operable and it no longer detracts from the property values. Steps have been taken to remove this vehicle from the junk vehicle category. Officer VanMeir suggested the Board find them in violation but coming into compliance before the hearing. A discussion followed on if this motion is passed and they go out of compliance again, they would be subject to fines immediately instead of having to wait to bring them to a hearing MOTION made by Howard Brauer giving them 30 days to come into compliance, seconded by Fred Clement. A discussion followed. Chairman VanBuskirk added to Mr. Brauer's motion, regarding Case #2004/18390, finding that Mr. & Mrs. Edward Hino were in violation but at this time on August 18, 2004, they are in compliance. VIOLATION HEARING-CASE #2004-1205/20427 EDWARD O'CONNELL- 53 BLUE ISLAND STREET SECTION 39-39 CODE OF ORDINANCES Mr. & Mrs. O'Connell came before the board and were sworn in by Chairman VanBuskirk. Mrs. O'Connell stated that they never had a problem with the burglar alarm system in the eight years that it was installed until the battery went dead. They were told by the alarm company that the hattery was supposed to recharge itself. After the second false alarm, they were told it was because the batteD, was dead and that the battery should be changed every 5 years. They are asking the board to dismiss the second false alarm. A discussion followed. MOTION made by Chairman Van Buskirk regarding Case #2004-1205/20427 to dismiss the second false alarm, with a second by Ken Cosco ROLL CALL VOTE: Chairman Van Buskirk Aye Ken Cosco Aye Fred Clement Aye Eva Schofield Aye Charles Dodd Aye Hank Buchanan Aye Code Enforcement Meeting August 18, 2004 Page 3 of 3 Howard Brauer Aye MOTION CARRIED 7-0 CHAIRMAN'S MATTERS- Chairman Van Buskirk asked City Attorney Stringer if the loud music citation would be returning to the board. A discussion followed. Mr. Stringer stated it would not be back before the board. The Chairman welcomed Mr. Dodd as the newest regular member to the Code Enforcement Board and introduced Mr. Brauer as the new alternate member. A discussion followed on the wording for motions. Mr. VanBuskirk stated it is very important to use case numbers and dates and put as much information in the motion as possible. Ms. Schofield asked if there were alarm awareness classes- She was told that Indian River County Sheriff's Department holds these classes 2 times a month. A discussion followed on adding attendance to this awareness class as part of the judgment. 7. MEMBER'S MATTERS: None CODE ENFORCEMENT OFFICER'S MATTERS: Officer VanMeir asked if the board would consider adding an item on the agenda to include additions and deletions of agenda items. That way he could let you know what items on the agenda have been removed and for what reason. He feels this would save time. The board agreed. 9. CITY ATTORNEY'S MATTERS: Mr. Stringer told the board that during the budget hearing last night, the budget was amended to add a third code enforcement officer. 10.
