Chairman Van Buskirk called the meeting to order at 2:00 p.m. with a pledge to the flag. 2. ROLL CALL: Present: Chairman Ronald Van Buskirk Mr. Kenneth Cosco Mr. Leon Griffin Ms. Eva Schofield Mr. Carl Anderson Mr. Charles Ed Dodd Absent: Mr. Howard Brauer Excused: Mr. Fred Clement Mr, Hank Buchanan Also Present: Code Enforcement Officers: Antoine Van Meir Warren Lindquist Code Enforcement Board Secretmy Shirley Lynch 4. APPROVAL OF M1NUTES: Regular Meeting 10/15/04 The minutes were approved as written by a voice vote 6-0 5. ADDITIONS OR DELETIONS TO AGENDA: Code Enforcement Officer VanMeir asked to add Douglas JeffPratt of Pelican Pub to the agenda moving it to the first case and moving case/V2004-28577 to second on the hearing agenda- 6. NOTICED HEARINGS: A. VIOLATION HEARING-CASE #2004-21801 DOUGLAS J. PRATT (PELICAN PUB)- 1318 US HIGHWAY 1 · SECTION 54-4-18.7 LAND DEVELOPMENT CODE SITE PLAN VIOLATION- REQUEST FOR TIME EXTENSION Chairman VanBuskirk swore in Mr. Platt At the 10/15/04 meeting after a discussion and deliberation of the facts, the Code Enforcement Board made a motion which passed unanimously regarding case #2004-21801 finding Mr. Pratt in violation of section 54-4-18.7, site plan violation, giving him 30 days from 10/15/04 to come into compliance with a $250 per day fine thereafter. Code Enforcement Meeting November 17, 2004 Page 2 of 3 Mr. Pratt stated he has been trying to organize getting a crane and trailer on site at the same time to move the boat- He said that he knows he is in violation but he hopes that he will be able to move the boat this Saturday, 11/20/04. He is asking for a two-week extension from the Board. He also stated that he looked at what he can and can't do on the property a long time ago and it said he could place a boat on the property. He asked if the law was changed. Officer VanMeir reminded the Board that Mr. Pratt is in violation of the site plan After further discussion, a MOTION was made by Ed Dodd, seconded by Chairman VanBuskirk, extending the time limit for Mr. Pratt to move the boat to December 6, 2004 (12/06/04). If the boat is not moved by that time the $250.00 per day fine will be retroactive to the original date. HUBERT BROWN- 109 FLINT STREET · SECTION 18-32(a) CODE OF ORDINANCES · SECTION 66-.(IX5}(6) CODE OF ORDINANCES Chairman VanBuskirk swore in Code Enforcement Officer Antoine VanMeir who testified that the owner of the property leased the unit to those how are harboring dangerous reptiles. He reported that the certified letter mailed to the owners informing them of today's meeting was returned from the post office as unclaimed. He stated he was denied access to the home on this date and in order for the City to confirm that the reptiles were still in the residence he would have to obtain an inspection warrant by the court. He feels doubtful he will be granted this warrant. After a question by a board member, Officer Van Meir stated that the owners of the residence don't feel that the renters are doing anything illegal and will not cooperate with the City officials. He also stated that the City's Police Department can go to their door with the decision of the board, or he can post the property with the decision and certify the posting, also it can be posted in the newspaper for 4 consecutive weeks after which, if the property is not in compliance, the City can lien the property and put the burden on the property owners. He stated he is still working on this case with Animal Control. After further discussion, MOTION made by Ken Cosco, seconded by Chairman VanBuskirk, give the homeowners 10 days from hand delivered notification to come into compliance with the City of Sebastian's Code of Ordinances. If they are not in compliance by that date, a $250.00 per day fine will be imposed until they are in compliance. CHAIRMAN'S MATTERS- Chairman Van Buskirk explained that the Code Enforcement Board will be presenting their annual report to the City Council at their December 8th meeting. A discussion followed on some changes to ordinances that will be presented to the Council as well. Discussed were maintaining vacant land and hiring a new code officer. The City Attorney's attendance at the meetings was discussed. It was the consensus of the Board that he must attend the meetings or provide a written report on each case. 8. MEMBER'S MATTERS: Eve Schofield asked if anything could be done about loudness of generators. 9. CODE ENFORCEMENT OFFICER'S MATTERS: Carl Anderson stated he had a ride- along with Officer VanMeir yesterday. He commented that he was impressed and it was a very enlightening day He encouraged other board members to do the same. 10. CITY ATTORNEY'S MATTERS: City attorney was not in attendance 11, PUBLIC INPUT: Secretary Lynch mentioned to the Board that there were conflicting sections to the Alarm Systems Ordinance. This discrepancy will be mailed to the Board for their review. She asked that this problem be presented to the City Council for change or clarification.
