Smith Mr. Oakes (a) Mr. Keough Mr. Paul EXCUSED: Mr. Simmons (a) ALSO PRESENT: Bill Hughes, School Board Representative Tracy Hass, Director, Growth Management Department Jan King, Manager, Growth Management Department Susan Lorusso, Secretary Richard Stringer, City Attorney ANNOUNCEMENTS: Mr. Simmons is excused. Chmn Smith congratulated Tracy Hass on obtaining his AICP and he is now a certified planner. He also congratulated Mr. Hughes on his appointment as Chairman of the Indian River County School Board. The December 16, 2004 Planning and Zoning Commission meeting is canceled. APPROVAL OF MINUTES: 9/16/04 MOTION by Faille/Seeley "1 make a motion we approve the minutes of 9/16/04." A voice vote was taken. Motion carried. OLD BUSINESS: NONE NEW BUSINESS: A. Accessory Structure Review - Section 54-2-7.5- 1329 Surfside Terrace - 29' X 34' Detached Garage - J. DeCaria Jack from Advanced Custom Carpentry presented the application. The garage is to be used for custom and antique cars. Ms. King said staff recommends approval and PLANNING AND ZONING COMMISSION MINUTES OF SPECIAL MEETING OF DECEMBER 9, 2004 requested the commission to include a condition for the required amount of shrubbery to be planted and a revised survey to be submitted showing the 28 shrubs. ON MOTION by AIIocco, and SECOND by Oakes, Planning and Zoning Commission approved the accessory structure at 1329 Sur[side Terrace, 29' X 34' detached garage with the additional shrubbery noted in the staff report to be included. Quasi-Judicial Public Hearing - Conditional Use Permits - Model Home Renewals: 1 ) Ameron Homes - 1450 & 1474 Barber Street Ms. King reported that there have been no complaints or violations at these locations and staff recommends approval. There was discussion regarding marking of handicap spaces and Ms. King informed the commission that Code Enforcement is working with the model home contractors to secure the handicap parking. ON MOTION by Keough, SECOND by Paul, The Planning and Zoning Commission approved the one-year renewal of conditional use permits for a model home for Ameron Homes at 1450 and 1474 Barber Street. ROLL CALL: Mr. Keough yes Mr. Mahoney yes Chmn Smith yes Mr. Faille yes Mr. Seeley yes Mr. Paul yes Mr. AIIocco yes The vote was 7-0. Motion passed. 2) North South Builders, Inc. - 909 Landsdowne Drive Ms. King said there have been no complaints or violations at this location and Code Enforcement is working with the applicant on handicap parking signage. Staff recommends approval. Motion passed. 2 PLANNING AND ZONING COMMISSION MINUTES OF SPECIAL MEETING OF DECEMBER 9, 2004 Public Hearing - Recommendation to City Council - Preliminary Plat - Sebastian Preserve Subdivision - 160 Acres East of Collier Creek Estates - RS-10 Zone Chmn Smith opened the public hearing at 7:21 p.m. Mr. Timothy Jelus, P.E., Lincoln Land Development LLC presented the application. The project consists of 162 acres in the RS-10 Zone for 126 single-family homes. This will be a deed-restricted development with curb and gutter design and on site storm water retention. Prior to any development permits will be obtained from state and federal agencies, including St. John's Water Management, U.S. Army Corps of Engineers, Indian River County Utilities, DEP, and Fish, Game and Wildlife. The applicant is aware that the tree, which held the eagle's nest, had been destroyed during the hurricanes but the eagle has been spotted in the area. Mr. AIIocco and Mr. Seeley had strong reservations regarding the increase in traffic on Fleming Street. Mr. Hass and Mr. Stringer answered questions regarding traffic from this site stating that Fleming Road is designated as a collector road and on the MPO list for widening in the next 20 years. Mr. Hughes was concerned about the ability for school buses to turn around. The following people spoke: Alma Miller, 699 So. Easy Street, concerned about increase in traffic on Fleming Street. Terese Harber, 949 Potomak, very concerned about the eagle finding an alternate nesting site. Al Manzi, 742 Holden Avenue, complimented the applicant as this proposal was a vast improvement over the previously submitted proposal but had concerns about traffic. Barbara Relva, 197 Englar Drive, expressed concerns regarding the scrub jays. Susan Bowser, 715 So. Easy Street, would like to see the traffic pattern planned better. Peter Walls, 702 So. Easy Street, also had traffic concerns. Chmn Smith closed the hearing at 8:45 p.m. ON MOTION by Oakes, SECOND by Keough, the Planning and Zoning Commission recommends to the City Council approval of the preliminary plat for Sebastian Preserve Subdivision as presented. ROLL CALL: Mr. AIIocco no Chmn Smith yes Mr. Keough yes Mr. Mahoney yes Mr. Seeley no Mr. Paul yes Mr. Faille yes The vote was 5-2. Motion passed. CHAIRMAN MATTERS: Chmn Smith said he presented a report to City Council updating them on the Planning and Zoning Commission. He asked Mr. Hass about the fence portion of the parapet wall on the Blockbuster building as it blew down during the storms. Mr. Hass said he will notify the building department. PLANNING AND ZONING COMMISSION MINUTES OF SPECIAL MEETING OF DECEMBER 9, 2004 MEMBER MATTERS: Mr. Mahoney complimented the city on the new facility and prestigious meeting room. Mr. Keough asked what was being built next to the Gator Lumber site and Mr. Hass said it is a contractor trade facility. Mr. Seeley asked what was BEING BUILT ON Indian River Drive next to the yacht club and Mr. Hass said a single-family home. DIRECTOR MATTERS: Mr. Hass wished the commission a happy holiday and expressed his appreciation to his staff and the commission for all the support and assistance he receives from them. He advised the commission that the comprehensive plan update will be coming before them very soon and once he meets with Iler Planning Group workshops will be scheduled. ATTORNEY MATTERS: Mr. Stringer reviewed the upcoming annexations that have been in the application process and will be going before city council in January. He advised the commission that he is working on a CR512 Triangle Overlay District but the state Department of Community Affairs only allow for two comprehensive plan submissions a year. He also informed the commission of the resignation of Mr. Heptinstall from City Council. Chmn Smith adjourned the meeting at 9:20 p.m. (12/10/04 SBL ) 4
