between
INDIAN RIVER COUNTY, FLORIDA
and
CITY OF SEBASTIAN, FLORIDA
This Interlocal Agreement, entered into this __ day , 1999, by
and between INDIAN RIVER COUNTY, FLORIDA, a political subdivision of the state
of Florida, hereinafter referred to as COUNTY, and the CITY OF SEBASTIAN,
FLORIDA, a municipal corporation of the State of Florida, hereinafter referred to as
CITY, for the purpose of cost sharing in the paving of Vocelle Avenue, provides:
WITNESSETH:
WHEREAS, tl~e COUNTY and CITY agree that the COUNTY was issued a
permit to install underground utilities in the CITY Right of Way for Phase 2B Water
Main Expansion; and
WI-[EREAS, the COUNTY accepts responsibility to restore the right-of-way in
accordance with the conditions of the permit; and
WHEREAS, the CITY and COUNTY would benefit to cost share the paving
restoration of Vocelle Ave; and
WHEREAS, an undertaking of this nature is in keeping with the "Florida
Interlocal Cooperation Act of 1969" as set forth in Florida Statutes Chapter 163;
NOW, THEREFORE, in consideration of the mutual terms, conditions, promises,
covenants and premises hereinafter set forth and pursuant to the statutory authority
contained in F. S. Chapter 163, the COUNTY and CITY agree as follows:
1. The COUNTY agrees to pay to the CITY 60% of the resurfacing costs of Vocelle
Avenue estimated at $9,000.
2. Within forty five (45) days of invoice by CITY, the COUNTY agrees to reimburse
the CITY 60% of the contractor's bid price for resurfacing said street.
IN WITNESS WHEREOF, the parties hereto have caused this interlocal agreement to be
executed by their duly authorized officials on the day and year first written above.
