HomeMy WebLinkAbout12081982MINUTES OF MEETING OF CODE ENFORCEMENT BOARD - DECEMBER 8, 1982 MEETING WAS CALLED TO ORDER BY CHAIRMAN ROBERT FITZMAURICE AT 2:05 P.M. PRESENT: CHAIRMAN ROBERT FITZMAURICE, VICE CHAIRMAN EARL WITHERBY, MARTIN LEWIS, GEORGE McCLEARY, GEORGE LA PORTE, EUGENE POPOW, PETER TARBELL, BOARD ATTORNEY GREGORY GORE. MOTION BY MR. LEWIS, SECONDED BY MR. LA PORTE, TO APPROVE THE MINUTES OF THE MEETING OF NOVEMBER 10. CARRIED. ATTORNEY GORE ADVISED THAT HE AND CHAIRMAN FITZMAURICE TALKED TO CITY ATTORNEY KILBRIDE CONCERNING SEVERAL QUESTIONS BROUGHT UP A~ THE LAST MEETING. ONE WAS WHAT TO DO ABOUT INCORRIGIBLES WHO CONTINUE TO VIOLATE THE CODE OF ORDI- NANCES. FOR INSTANCE, SUGGESTIONS WERE MADE AS TO WHETHER WE COULD RE-IMPOSE FINES, ETC. ATTORNEY KILBRIDE SAID WE WOULD HAVE TO GO THROUGH THE WHOLE PROCEDURE FROM THE BEGINNING ON EACH AND EVERY VIOLATION. SECOND, WE WERE CONCERNED ABOUT WHETHER WE WOULD BE INDEMNIFIED AGAINST OFFICIAL ACTS AND THE ANSWER IS "YES". THIRD, THE NEW MEMBER MUST SERVE FOR A TWO YEAR TERM. THE TERM OF THE ORIGINAL MEMBERS WILL BE UP IN MARCH, SO THEY WILL BE UP FOR RE-APPOINTMENT AND THE NEWER MEMBER WOULD THEN HAVE THE WHOLE TWO YEAR TERM. MR. WITHERBY WONDERED HOW AN INCORRIGIBLE WOULD BE HANDLED. DEPENDING UPON THE VIOLATION, WE COULD HARDLY GIVE LESS TIME TO COMPLY AND THE MAXIMUM FINE IS $250. IT WAS DECIDED THAT WE SHOULD WAIT AND SEE WHAT HAPPENS AND ACT ACCORDINGLY. UNDER GENERAL BOARD DISCUSSION MR. McCLEARY BROUGHT UP THE FACT THAT WE'VE ONLY HAD THINGS BROUGHT UP BY THE BUILDING OFFICIAL. HE THOUGHT THAT THE POLICE DEPARTMENT, CITY ENGINEER, AND ZONING AND PLANNING COMMISSION SHOULD BE MADE AWARE THAT THEY HAVE INPUT INTO THIS BOARD AND SHOULD BRING VIOLA- TIONS TO OUR ATTENTION. IT WAS SUGGESTED THAT THESE PEOPLE BE INVITED TO ATTEND ONE OF OUR MEETINGS. MR. FITZMAURICE WILL TALK TO MAYOR FLOOD ABOUT THIS, k¥D ALSO THAT THE POLICE DEPARTMENT SHOULD MAKE A NOTE OF ANY VIOLATIONS THAT THEY SEE AND REPORT THEM. IT WAS AGREED THAT THE POLICE CHIEF SHOULD BE INVITED TO THE NEXT MEETING. MOTION BY MR. WITHERBY, SECONDED BY MR. McCLEARY, THAT A GENERAL BOARD DIS- CUSSION BE MADE PART OF THE AGENDA EVERY MONTH. CARRIED. CHAIRMAN FITZMAURICE READ THE LETTER OF COMPLIANCE DRAWN UP BY ATTORNEY GORE WHICH WAS SENT TO MR. LIDDY THANKING HIM FOR HIS COOPERATION IN CLEARING UP HIS VIOLATION. THIS WILL BE THE FORM LETTER TO USE WHEN APPLICABLE. CHAIRMAN FITZMAURICE REMARKED THAT HE WROTE A LETTER TO THE EDITOR OF THE PRESS JOURNAL BECAUSE HE GOT A LITTLE UPSET WITH A WOMAN WHO SAID THAT THE BOARD MEETINGS WERE IN DISARRAY AND WERE NOT FOLLOWING PARLIANENTARY PRO- CEDURES, ETC. HE INVITED HER TO LISTEN TO O~R TAPES TO SHOW THAT ANYBODY HERE HAD A RIGHT TO SPEAK AND WAS TREATED POLITELY. CHAIRMAN FITZMAURICE ADDED THAT IF SHE HAD SAID THE GOLF COURSE BOARD (WHICH IS WHAT SHE WAS TALKING ABOUT) OR THE CITY COUNCIL, THAT MIGHT HAVE BEEN DIFFERENT, BUT SHE WAS PA-~NTING EVERYBODY WITH THE SAME BRUSH AND HE DIDN'T APPRECTATE IT.
