MEETING WAS CALLED TO ORDER BY CHAIRMAN ROBERT FITZMAURICE AT 2:10 P.M.
PRESENT: CHAIRMAN ROBERT FITZMAURICE, VICE CHAIRMAN EARL WITHERBY, EUGENE POPOW,
GEORGE McCLEARY, MARTIN LEWIS, GEORGE LA PORTE, BOARD ATTORNEY GREGORY GORE.
IN DISCUSSING THE MINUTES OF THE SPEC~ALMEETING OF AUGUST 18, MR. WITHERBY
QUESTIONED THE STATEMENT REGARDING THE CASE OF A VIOLATOR WHO IS JUST RENTING
PROPERTY - THAT NO LIEN COULD BE PLACED AGAINST THAT PROPERTY, BUT COULD BE
AGAINST OTHER"PROPERTY HE OWNS. MR. WITHERBY DISAGREED WITH THIS BECAUSE AS
A RENTER THE PERSON WHO OWNS THAT PROPERTY IS ~TILL RESPONSIBLE IF A LAW HAS
BEEN VIOLATED. MR. POPOW THOUGHT THAT DURING THE DISCUSSION IT NAD BEEN DECIDED
THAT JUST THE RENTER WOULD BE BROUGHT IN, THAT WE CAN'T RECORD A LIEN BECAUSE
THE LANDLORD NAS NEVER HAD A NOTICE, NOR AN OPPORTUNITY TO CORRECT. ATTORNEY
GORE AGREED THAT THE STATEMENT IN THE MINUTES SHOULD BE AMENDED. HE NAD IN-
TENDED TO DISCUSS THIS WITH ATTORNEY KILBRIDE BUT NAD NOT HAD THE OPPORTUNITY.
HE ADDED THAT HE DOES INTEND TO DISCUSS THIS WHOLE QUESTION WITH HIM REGARDING
THE PLACING OF A LIEN AGAINST A LANDLORD AND THE PROCEDURE TO BE USED TO NOTIFY
AN ABSENTEE LANDLORD.
MOTION BY MR. LEWIS, SECONDED BY MR. McCLEARY, THAT THE MINUTES OF THE SPECIAL
MEETING OF AUGUST 18 BE APPROVED WITH THE STIPULATION THAT BOARD ATTORNEY GORE
WILL CHECK WITH CITY ATTORNEY KILBRIDE REGARDING THE LAST PARAGRAPH ON PAGE 1.
CARRIED.
THERE BEING NO FURTHER BUSINESS BEFORE THE BOARD, MOTION WAS MADE BY MR. LEWIS,
SECONDED BY MR. POPOW, TO ADJOURN AT 2:20 P.M.
