MEETING WAS CALLED TO ORDER BY CHAIRMAN ROBERT FITZMAURICE AT

LA PORTE, MARTIN LEWIS, GEORGE McCLEARy, EUGENE POPOW~ GREGORY GORE, BOARD
ATTORNEY.
MOTION BY MR. McCLEARy~ SECONDED BY MR. LEWIS, TO APPROVE THE MINUTES OF THE
MEETING OF MAY 12, 1982.
VIOLATION HEARING:
CASE NO. 82~3 - JOHN SNIPES, LOTS I AND 2, BLOCK 3~ W, AL MARTIN SUBDIVISION -
VIOLATION OF CITY OF SEBASTIAN CODE OF ORDINANCES, CHAPTER 12, ARTICLE I,
SECTION 12-1, LITTERING - ARTHUR MAYER, THE BUILDING OFFICIAL, WAS SWORN IN
BY ATTORNEY GORE AND PRESENTED THE FOLLOWING FACTS: COMPLAINTS WERE RECEIVED
THAT DEBRIS AND RUBBISH WAS BEING DUMPED JUST EAST OF MARTIN LANE ON THE RIVER
SIDE (WHICH PROPERTY.rS OWNED BY F~. SNIPES); ALSO ROOFING MATERIAL, PLYWOOD,
OLD LAWN MOWERS~ BRUSH, ETC. ABOUT A MONTE AGO MR. MAYER OVERHEARD MAYOR FLOOD
INSTRUCTING A POLICE OFFICER TO REQUEST MR. SNIPES TO REMOVE THE DEBRIS AND
CLEAR UP THE PROPERTY. SINCE NOTHING WAS DONE, MR. SNIPES WAS SENT A LETTER
DATED MAY 28. MR. MAYER REPORTED THAT AS OF THIS DATE EVERYTHING HAS BEEN
CLEARED UP, BUT I~R. SNIPES WAS PRESENT AND WISHED TO MAKE A STATEMENT.
MR. SNIPES WAS SWORN IN BY ATTORNEY GORE AND MADE THE FOLLOWING STATEMENT:
FIRST OF ALL HE APOLOGIZED TO THE BOARD AND TO THE CITY FOR ANY INFRACTION OF
THE LAW ~rHICH MAY HAVE BEEN COMMITTED, SINCE ACQUIRING THE PROPERTY ABOUT A
YEAR AGO HE HAS BEEN IN THE PROCESS OF SHAPING IT UP AND GOT PERMISSION FROM
CITY HALL TO PILE UP THE TRASH AND THEN BURN IT, AND WOULD HAVE DONE SO WITH
THIS LATEST ACCUMULATION HAD IT NOT BEEN FOR THE RAIN~ MR. SNIPES IS OF THE
OPINION THAT HE IS BEING HAPJ{ASSED BY THE CITY AND BY HIS NEIGHBOR. ALSO, HE
MAINTAINED THAT HE HAD NEVER BEEN INFORMED BY ANYONE IN THE CITY THAT HE WAS
IN VIOLATION.
MOTION BY MR. LEWIS, SECONDED BY MR. POPOW, THAT CASE NO, 82~3 IN THE MATTER OF
JOHN SNIPES, CHARGED WITH VIOLATION OF SEBASTIAN CODE OF ORDINANCES, CHAPTER 12~
ARTICLE It SECTION 12-1, LITTERING, BE DISMISSED~ CARRIED.
