HomeMy WebLinkAbout03101982MINUTES OF MEETING OF CODE ENFORCEMENT BOARD - MARCH 10, 1982 MEETING WAS CALLED TO ORDER BY CHAIRMAN ROBERT FITZMAURICE AT 2:15 P.M. PRESENT: ROBERT FITZMAURICE, CHAIRMAN, EARL WITHERBY, VICE CHAIRMAN, GEORGE LA PORTE, MARTIN LEWIS, GEORGE McCLEARY, EUGENE POPOW, ARTHUR MAYER, BUILDING OFFICIAL. MOTION BY MR. POPOW, SECONDED BY MR. McCLEARY, TO APPROVE THE MINUTES OF THE MEETING OF FEBRUARY 26, 1982. CARRIED. ME. McCLEARY ASKED IF THE WHOLE BOARD WOULD HAVE TO APPEAR IN COURT IF A CASE WENT THAT FAR. SINCE ME. RENE VAN DE VOORDE WAS PRESENT HE WAS ASKED FOR HIS OPINION. HE ADVISED THAT THERE WASA POSSIBILITY THAT EACH MEMBER COULD BE SUBPOENAED, BUT MORE THAN LIKELY IT WOULD JUST BE THE CHAIRMAN. MR. FITZMAURICE STATED THAT THE CITY COUNCIL IS TAKING UNDER ADVISEMENT THE HIRING OF A BOARD ATTORNEY AND ADDED THAT IT WAS HIS UNDERSTANDING THAT MR. RENE VAN DE VOORDE HAD INDICATED HIS WILLINGNESS TO ACT AS TEMPORARY BOARD ATTORNEY UNTIL SUCH TIME ASAN ADVERTISEMENT CAN BE PLACED FOR A PERMANENT ATTORNEY AND HIS APPOINTMENT BY THE CITY COUNCIL. MOTION BY MR. WITHERBY, SECONDED BY MR. McCLEARY, TO RECOMMEND TO THE CITY COUNCIL THAT RENE VAN DE VOORDE BE APPOINTED TEMPORARY BOARD ATTORNEY PENDING ADVERTISING FOR AND HIRING OF A PERMANENT ATTORNEY. CARRIED. ARTHUR MAYER STATED THAT HE HAD TWO CASES HE WOULD LIKE TO DISCUSS. AFTER PRE- SENTING ONE CASE, IT WAS THE CONSENSUS OF THE BOARD THAT HEARING THIS OR THE OTHER CASE MIGHT BE PREJUDICIAL, AND THEY SHOULD WAIT UNTIL FORMAL PRESENTATION. THERE FOLLOWED A DISCUSSION ON THE PROCEDURE TO BE FOLLOWED AND A SPECIAL MEETING WAS SUGGESTED. IT WAS DECIDED THAT TO BEGIN WITH ONLY TWO CASES SHOULD BE HEARD. MOTION BY MR. WITHERBY, SECONDED BY MR. LEWIS, TO MEET ON MARCH 31 AT 2:00 P.M. WITH MR. VAN DE VOORDE TO PUT OUR PLANS TOGETHER AND SEE HOW WE ARE TO APPROACH THIS, IF HE IS APPROVED BY THE CITY COUNCIL. CARRIED. MRS. VERONICA AUTRY ON BEHALF OF GENERAL DEVELOPMENT CORPORATION COMMENDED THE CITY OF SEBASTIAN FOR ESTABLISHING THE CODE ENFORCEMENT BOARD, AND EXPRESSED THE HOPE THAT AT SOME FUTURE DATE IT BE RECOMMENDED TO THE CITY COUNCIL THAT ORDINANCES BE UPGRADED TO THE POINT THAT THEY EITHER MEET OR EXCEED GENERAL DEVELOPMENT'S DEED RESTRICTIONS, THEREBY ENFORCING THE SAME TYPE OF THING THAT WAS ANTICIPATED WHEN DEED RESTRICTIONS WERE FILED. MRS. AUTRY ADDED'THAT GENERAL DEVELOPMENT WOULD BE GLAD TO ASSIST THE CODE ENFORCEMENT BOARD IN ANY WAY THEY CAN. MR. FITZMAURICE AGREED TO CONTACT THE PRESS JOURNAL AND THE SEBASTIAN SUN REGARD- ING PRINTING OF ARTICLES EXPLAINING THE FUNCTION OF THE CODE ENFORCEMENT BOARD. THE NEXT REGULAR MEETING WAS SCHEDULED FOR APRIL 14, 1982, AT 2:00 P.M. MOTION BY MR. McCLEARY, SECONDED BY MR. LEWIS, TO ADJOURN AT 3:05 P.M.
