HomeMy WebLinkAbout05121982MINUTES OF MEETING OF CODE ENFORCEMENT BOARD - MAY 12, 1982 MEETING WAS CALLED TO ORDER BY CHAIRMAN ROBERT FITZMAURICE AT 2:00 P.M. PRESENT: ROBERT FITZMAURICE, CHAIRMAN, EARLY WITHERBY, VICE CHAIRMAN, GEORGE LA PORTE, MARTIN LEWIS, GEORGE McCLEARY, EUGENE POPOW, GREGORY GORE, BOARD ATTORNEY. MOTION BY MR. LA PORTE, SECONDED BYMR. WITHERBY, TO APPROVE THE MINUTES OF THE MEETING OF APRIL 21, 1982. CHAIRMAN FITZMAURICE INTRODUCED ~4R. GORE TO THE MEMBERS OF THE CODE ENFORCEMENT BOARD AND REMARKED THAT HE HAS BEEN THROUGH THE PROCEDURE OF HAVING BEEN INTER- VIEWED BY THE CITY COUNCIL. CHAIRMAN FITZMAURICE ADDED THAT ALTHOUGH IT IS THE PREROGATIVE OF THE BOARD TO RECOMMEND TO THE CITY COUNCIL THEIR RECOMMENDATION FOR AN ATTORNEY, IT HAS WORKED OUT THIS WAY FOR THE TIME BEING. EACH MEMBER WAS GIVEN A COPY OF A LETTER FROM MAYOR FLOOD TO THE BOARD ADVISING THAT MR. GORE HAS BEEN APPOINTED AND IF WE WISH TO RECONSIDER OR HAVE THE COUNCIL RECON- SIDER THIS APPOINTMENT HE WOULD LIKE TO BE NOTIFIED BY MAY 19. COPIES OF THE RESUMES SUBMITTED BY FIVE ATTORNEYS WERE ALSO GIVEN TO THE BOARD. CHAIRMAN FITZMAURICE ASKED FO~:COMMENTS FROM THE BOARD IN ORDER TO KNOW HOW TO PROCEED WITH THE APPOINTMENT. MAYOR FLOOD JOINED THE MEETING AND APOLOGIZED FOR HIMSELF AND THE COUNCIL AND MAYBE THE CITY ATTORNEY. APPOINTMENTS FOR INTERVIEWS WERE SET UP IN THE SAME WAY AS OTHER APPOINTMENTS HAVE BEEN MADE, AND IT TOTALLY SLIPPED EVERYBODY'S MIND THAT THE ORDINANCE CREATING THE CODE ENFORCEMENT BOARD PROVIDES THAT THE BOARD CAN RECOMMEND THEIR APPOINTMENT TO THE COUNCIL. THE COUNCIL WAS NOT TRY- ING TO GO OVER ANYBODY'S HEAD. ME. WITHERBY REMARKED THaT IT IS OBVIOUS THAT THINGS DIDN~TGO~UITE LIK~ THE~ SHOULD HAVE BUT WE HAVE A GOOD THING GOING HIfREAND IT IS SOMETHING THAT THE CITY OF SEBASTIAN NEEDS~ B~ESUGGESTED THAT RATHER THAN GET STARTED WITH SOME KIND OF BAD PUBLICITY, SINCE THE APPOINTMENT HAS ALREADY B~EN MADE~ IT SHOULD .BE GONE ALONG WITH, WE ALWAYS HAVE THE RIGHT TO MAKEA CHANGE IF IT DOESN'T WORK OUT TO OUR MUTUAL SATISFACTION, MOTION BY MR, WITHERBY~ SECONDED BY ME, LEWIS~ TO ACCEPT TM3& CITY COUNCIL~'S APPOINTMENT OF MR, GREGORY GORE AS THE BOARD ATTORNEYFOR T~UE. CODE ENFORCEMENT BOARD, CAP~RIED~ R~. FITZMAURICE BROUGHT TO THE ATTENTION OF THE BOARD T~iESTIPULATION IN THE ORDINANCE REGARDING FAILURE OF MEMBERS TO ATTEND MEETINGS AND REQUESTED THAT THE MEMBERS NOTIFY EITHER HIM OR THE CITY CLERK I~ THEY EXPECT TO BE ABSENT SO IT CAN BE AN EXCUSED ABSENCE, AT THE SUGGESTION OF MR, McCLEARY~ CHAIRMAN FITZMAURICE AGREED TO WRITE A LETTER OF THANKS FOR MR, RENE gAN DE VOORDE FOR HiS ASSISTANCE IN HELPING TO SET UP THE BOARD.
