Smith extended good luck to Mr. Seeley and Mr. Paul on their campaign for a position on City Council. Mr. Keough and Mr. Oakes are excused and Mr. Simmons will be voting. Mr. Hughes is also excused. APPROVAL OF MINUTES: 2/03/05 Mr. Paul questioned the motion for the sign ordinance for garage sale signs stating that he thought they had included in the motion removal of taking the signs down each evening of the sale and allowing them to stay up during the duration of the sale. Mr. Stringer said it was discussed but not made a specific part of the motion. If they want to recommend that change, they can reconsider the motion by adding it to the agenda. MOTION by Paul/Seeley to reconsider. A voice vote was taken. Motion carried unanimously. Chmn. Smith asked for a motion to approve the minutes of February 3'~. MOTION by Simmons/Paul to approve. A voice vote was taken. Motion carried unanimously. PLANNING AND ZONING COMMISSION MINUTES OF SPECIAL MEETING OF FEBRUARY 17, 2005 OLD BUSINESS: PUBLIC HEARING - RECOMMENDATION TO CITY COUNCIL - PROPOSED ORDINANCE TO AMEND SECTION 54-4-21 OF THE LAND DEVELOPMENT CODE - CREATE A ZONING OVERLAY FOR THE SEBASTIAN BOULEVARD TRIANGLE DESCRIBING BOUNDARIES, DEFINITIONS AND REGULATIONS Chmn..Smith opened the public hearing at 7:05 P.M. Mr. Stringer asked if the commissioners had any changes to the list of uses discussed at the last meeting and adde. d that the Community Redevelopment Advisory Committee reviewed the suggested uses. The one comment they had was on the industrial zone. Originally the CRAC was going to strike out the whole category but the electronics, research and development and similar uses had some appeal to them. The remainder is to extend the design criteria from the CR-512 Overlay to the whole triangle. The other comment CRAC had was to add the language of all uses permitted within the RM-8 zone to the Industrial zone. There were no comments from the public. Chron. Smith closed the hearing at 7:15 p.m. Mr. Simmons asked if the light manufacturing was going to be removed entirely and Chron. Smith said they would keep only the part that read, "electronics, research and development, and similar uses up to 5,000 sq. ft." MOTION by Smith/Seeley to recommend city council approve the proposed ordinance to amend Section 54-4-21 of the Land Development Code to create a zoning overlay for thb Sebastian Boulevard Triangle describing boundaries, definitions and regulations as presented with the inclusion of the following: 1. All uses permitted in the RM-8 Zoning District to be added to Industrial Zone permitted uses. 2. Industrial Zone Conditional Uses to include electronics, research and development, and similar uses up to 5,000 Sq. Ft., and eliminating all other wording under "Light manufacturing". NEW BUSINESS: PUBLIC HEARING - RECOMMENDATION TO CITY COUNCIL PRELIMINARY PLAT - KOZLOWSKI SUBDIVISION - GLADIOLA AVENUE AND LACONIA STREET - RS-10 ZONING - 18 ACRES - 34 LOTS AT A DENISTY OF 1.85 UNITER PER ACRE Chmn. Smith opened the hearing at 7:16 p.m. Mr. Joseph Schulke, Schulke, Bittle & S!oddard, Vero Beach, Florida presented the application representing Mr. Wayne Kozlowski. All the lots meet the minimum lot size for the RS-10 Zoning district. The parcel:identified as Tract A will be used for storm water retention and Mr. Kozlowski is in negotiations to sell this tract to the City of Sebastian. On another part of the site a storm PLANNING AND ZONING COMMISSION MINUTES OF SPECIAL MEETING OF FEBRUARY 17, 2005 water tract is proposed and the applicant will be excavating a lake. They are also proposing a buffer between the wetlands and lake area. The entrance is at the .nodheast corner coming off Laconia Street. To the south between lots four and five there is a 20 Ft. wide emergency access. A small recreation tract is proposed next to the cul de sac and residents of the subdivision would be able to use that to access the river. A tree survey was submitted and there are some scattered trees in the wetland area but it is primarily an unmaintained citrus grove. They will be dedicating forty additional feet for a right-of-way along Laconia Street to widen the existing right-of-way from 40 Ft. to 80 Ft. For safety purposes, they will also widen the road and repave it to brihg it to a full 24 Ft. in width along Laconia. The site will have county water and sewer. Mr. Hass added that the storm water utility engineering division of the city is in the process of obtaining some appraisals on that property and will be moving forward with negotiations and ultimately purchase of that tract of land to support our storm water improvement project. The following people spoke: Wa~'ren Fuller, 1672 Sunport Road, Sebastian, had concerns about the wildlife in the area and water runoff and flooding. He showed photos of his home, which was . constructed in 2004, and the amount of water from the recent hurricanes. John Krajewski, 1699 Whitmore Street, Sebastian, was impressed with the proposal and said it would be an asset to the neighborhood. Many of the commissioners complimented this application. CHAIRMAN MATTERS: NONE yes Mr. Mahoney yes yes Mr. Faille yes yes Mr. Paul yes yes MEMBER MATTERS: Mr. Mahoney asked about the location of Advance Auto Parts mentioned in a public notice and inquired about another public notice regarding the vacating of public rights-of- way at Madison and Jackson. Mr. Hass said no formal notice has been received. Mr. Faille expressed concern about fencing rules and asked if rules and restrictions regarding fences could be put into the Land Development Code. Mr. Stringer said it · would have to be brought to city council. He advised Mr. Faille that as an individual he PLANNING AND ZONING COMMISSION MINUTES OF SPECIAL MEETING OF FEBRUARY 17, 2005 could talk to the city council but if he were designated by Planning and Zoning to be a representative, then he would have to speak to council within the confines of the Sunshine Law. Mr. Paul brought up the issue to reconsider the motion on the garage sale signs. MOTION by Paul/Smith "1 make a motion that on the sign ordinance that we had passed that everything remains the same with the exception of changing the need of taking the signs down every night that the sign is able to stay up from the start of the sale, whether it be Friday night through Sunday night, and then be brought down or if it is only a one-day sale then brought down appropriately." A voice vote was taken. Motion passed unanimously. Mr. AIIocco asked if the white fence along CR-512 at Sebastian River Landing was part of their approval. Mr. Hass said there was nothing specified at the approval but the fence does meet all regulations. Mr. Seeley asked that the commissioners make their comments known to city council about the treatment of staff at the last council meeting. Mr. Smith agreed with Mr. Seeley's sentiments. DIRECTOR MATTERS: Mr..Hass thanked Mr. Seeley and informed him that he had received apologies from each of the council members. ATTORNEY MATTERS: · Mr, Stringer explained the relocation procedures for gopher tortoise. Chmn Smith adjourned the meeting at 8:40 p.m. (2122/05 SBL) 4
