ROLL CALL: Present: Chairman Ronald Van Buskirk Mr. Kenneth Cosco Mr. Leon Griffin Mr. Carl Anderson Ms. Eva Schofield Mr. Charles Ed Dodd Mr. Hank Buchanan Mr. Howard Brauer Absent: Mr, Fred Clement Excused: City Attorney Rich Stringer Also Present: Code Enforcement Officers: Antoine Van Meir Warren Lindquist Code Enforcement Board Secretary Shirley Lynch 4. APPROVAL OF MINUTES: Regular Meeting 12/15/04 The minutes were approved as written by a voice vote 6-0 5. Additions & Deletions- CEO Antoine VanMeir was sworn in by the Chairman Item B on agenda is in compliance, Item C on agenda is in compliance- both are deleted from the agenda. There are no additions 6. NOTICED HEARINGS: A. REQUEST FOR FALSE ALARM APPEAL- CASE #2005-1205/668 EDWARD O'CONNELL- 53 BLUE ISLAND STREET · SECTION 39-39 CODE OF ORDINANCES An alarm user may appeal the determination of a false alarm Mr. & Mrs. O'Connell were sworn in by Chairman VanBuskirk Mrs. O'Connell Code Enforcement Meeting February 16, 2005 PAGE 2 OF 4 explained that there was a false alarm on the morning of January 8, 2005. When she contacted the alarm company, they told her she was using an incorrect password. She said this is the password they told her to use when she spoke to them in August of 2004. The alarm company came to replace the contacts on the patio doors and windows and checked the battery- the only thing they could tell her is that the system is old and that is why the alarm sounded. A question on how many false alarms they have. This would be the second false alarm. The last alarm was waived by the code board in August 2004. There is no fine involved. Code Officer VanMeir stated the citation notes an unknown pass code- regardless of what was repaired on the system- the police department sent two people out to investigate the alarm, as well as the administrative portion that must be done by code enforcement office, which is time consuming. This was user error not mechanical. After a discussion, a MOTION was made by Ken Cosco, reference CASE g2005-1205/668, to dismiss this case, second by Howard Brauer. VIOLATION HEARING- CASE #2004-32816- Repeat Offender MR. & MRS. ANTONIO C. DE PAIVA- 1597 RIDGELY LANE SECTION 66-3.(11) CODE OF ORDINANCES · SECTION 66-.(1)(5X6) CODE OF ORDINANCES It shall constitute a violation of this ordinance to allow: 66-3 .(12) inoperative, junk, or abandoned vehicles and vessels on the exterior portions of residential property. Officer VanMeir went to Mr. DePaiva's home on the date it was due for compliance as set by the Code Enforcement Board, to check the inoperable vehicle stored on the side of the house. At that time he was not in compliance. Mr. DePaiva asked Officer Lindquist for a few more days to come into compliance. Officer VanMeir went to Mr. DePaiva's house on February 2, 2005, at that time the vehicle was removed. It is in compliance at this time, there is no open violation. According to Officer VanMeir's interpretation of the Ordinance, Mr. DePaiva would have had to be called back for a special meeting because he was non-compliant at the date specified by the Board. He stated Mr. DePaiva could have been in compliance before he inspected the home on Code Enforcement Meeting Februa~ 16, 2005 PAGE 3 OF 4 February 2ha. He recommends that this case be found in compliance with no violations at this address at this time. After a discussion MOTION made by Chairman VanBuskirk, reference Case #2004-32816- finding Mr. Antonio DePaiva in compliance at this time, marked that he is a repeat offender of Ordinance 66-3, seconded by Ken Cosco ROLL CALL VOTE: Chairman Van Buskirk Yes Ken Cosco Yes Leon Griffin Yes Eva Schofield Yes Carl Anderson Yes Ed Dodd Yes Motion carried 6-0 7. CHAIRMAN'S MATTERS- Chairman VanBuskirk stated that the Board will have their election for a new chairman and vice chairman. He read the City's Code on the election, the officers, and those allowed to vote. He will not run for Chairman again. Ken Cosco stated that this is his last meeting, not because he wants it this way. He explained the City code states that a member can only serve two full terms. Carl Anderson nominated Ed Dodd as Chairman, seconded by Ken Cosco- There were no other nominations ROLL CALL VOTE: Motion carried 8-0 Chairman Van Buskirk Yes Ken Cosco Yes Leon Griffin Yes Eva Schofield Yes Carl Anderson Yes Ed Dodd Yes Hank Buchanan Yes Howard Brauer Yes Ed Dodd nominated Eva Schofield as Vice Chairman, seconded by Carl Anderson- There were no other nominations ROLL CALL VOTE: Motion carried 8-0 Chairman Van Buskirk Yes Ken Cosco Yes Leon Griffin Yes Eva Schofield Yes Carl Anderson Yes Ed Dodd Yes Hank Buchanan Yes Howard Brauer Yes Code Enforcement Meeting February 16, 2005 Page 4 of 4 Ed Dodd commented that the board should evaluate whether the codes were violated or not. He stated more things should come before the board to see if they can help with the enforcement. There are a lot of issues in the City that he feels the board could deal with and put pressure on people to respond to the code enforcement officers if so needed. Changes in the codes were discussed. Eva Schofield discussed the trailer trucks parking in Winn Dixie over the weekend as well as people selling cars on their property. Hank Buchanan asked about the status on the board's decision on Florida Power Sports. 7. MEMBER'S MATTERS: Ken Cosco stated he enjoyed working on the board and will miss it. He was given his nameplate. Eva Schofield discussed undeveloped land and the overgrowth. She was informed that there is no ordinance and that the council is not really interested in changing that at this time. Wendy's was discussed as well as the office building near it.
