The Pledge of Allegiance was said. ROLL CALL: Present: Mrs. Carbano Ch. Garland Mr. Mitchell V.c. Morris Ms. Falco Absent: Mrs. Lanning Mr.Wolf Mr. Gilligan All are excused. APPROVAL OF MINUTES: Regular Meetings held 3/08/05 and 04/12/05. MOTION: Morris/Carbano I make a motion that we approve the minutes on/08/05 and 4112/05. ROLL CALL: Mrs. Carbano - yes V.C. Morris - yes Mr. Mitchell- yes Ms. Falco - yes Ch. Garland - yes MOTION carried 5 - O. OLD BUSINESS: None NEW BUSINESS: Experior Exam Ch. Garland swore everyone in at the same time. Hood IV, Clarence/General Contractor MOTION: Carbano/Falco I make a motion that Mr. Clarence Hood be allowed to take the test for General Contractor. . t~) c "'~ ....-.'O.."....c,'"" ROLL CALL: Mrs. Carbano - yes Mr. Mitchell- yes Ch. Gamble Jr., Robert/General Contractor The Board had a problem that the letter verifying the supervisory experience did not show the license number of the person verifying the information and that it did not specify what exactly was being supervised by Mr. Gamble. MOTION: Morris/Mitchell I make a motion that the Board on a limited basis approve Mr. Gamble to take the exam subj ect to the minimum of a quorum review by the Board of a new letter from the Fritsche & Pavia Construction showing an explanation of the supervisory experience, more specifically whether it was field in the categories (inaudible) also that the State Certification # be on the letter and a copy of the license from the State of Ohio (inaudible) be attached to it. ROLL CALL: Ms. Falco - yes Ch. Garland - yes V.C. Morris - yes Mr. Mitchell - yes Mrs. Carbano - yes Motion carried 5 - O. Board Member Kari Lanning came in late for the meeting. King, RicklElectrical Contractor It was noted that Mr. King was applying to take the Business & Law test, that the Master Electrical test had already been taken. MOTION: Carbano/Morris I make a motion that we allow Rick King to take the Business & Law portion of the test. ROLL CALL: Ms. Falco - yes Mrs. Lanning - yes V.C. Morris - yes Motion carried 6 - O. Dahlberg, Daniel/Electrical Contractor Mr. Mitchell - yes Mrs. Carbano - yes Ch. Garland - yes Mr. Dahlberg said that he was moving back to Florida within a year since this is where most his family is. It was also noted that at one time he was state registered as an electrical contractor and that he held a City of Sebastian competency card. MOTION: Morris/Garland I make a motion that we approve Daniel Dahlberg to take the Electrical Contractor Exam. ROLL CALL: Mrs. Carbano - yes Ch. Garland - yes Mr. Mitchell - yes Motion carried 6 - O. V.C. Morris - yes Mrs. Lanning - yes Ms. Falco - yes Feliciano, Raymond/Aluminum Construction Mr. Feliciano told the Board that for the last 2 years he has been doing re-screening and that he held a County Occupational License. When asked, the Board Secretary said that a sub-contractors license was not required to do re-screening as long as nothing structural was being done. MOTION: Carbano/Falco I make a motion that we let Raymond Feliciano take the test for Aluminum Construction Specialty Contractor contingent on seeing a copy of his Indian River County license that he has held for two years for re-screening. ROLL CALL: Mrs. Carbano - yes Mrs. Launing - yes V.C. Morris - no Motion carried 4 - 2. Mr. Mitchell - yes Ms. Falco - yes Ch. Garland - no Wallace, Eric/Drywall V.C. Morris asked what the status of the citation was issued on 5/11/05 for acting as a contractor without a license. Mr. Wallace explained that he had an advertisement and he was warned not to advertise as a contractor and he removed it that day. He explained that he was issued a warning not a citation with a fine involved. The Board Secretary said that Dawn Bradford from the County had called and said that a citation has been issued. Nothing was said about a "warning". Mr. Wallace said he had it in his truck and would be glad to go get it. There was no response. MOTION: Morris/Lanning I make a motion that Mr. Wallace not be approved to take the Drywall Exam. ROLL CALL: V.C. Morris - yes Ch. Garland - yes Mr. Mitchell- yes Mrs. Lanning - yes Mrs. Carbano - yes Ms. Falco - yes Motion carried 6 - O. V.C. Morris noted that the first thing that was noted in his packet was that he had been issued a citation acting as a contractor. Also, he felt the experience documentation was not enough, that he needed to redo his package to bring back before the Board. Cohen, Jeremiah/Ltd. Insulation It was noted that Mr. Cohen is licensed in Brevard County, but due to his working with contractors who build in Sebastian, he needed to take a test in order to be licensed here. Chairman Garland noted that there was no letter explaining the felony that Mr. Cohen had been charged with. He said that it had slipped his mind and apologized to the Board. He explained that he had been charged years ago and they had been taken care of. He said that 5 years ago he had a drug related charge and about 15 years ago he had a burglary charge. He said they had not been expunged. Mrs. Carbano noted that on the verification sheet from Gale Insulation that if was not dated and that there was no contractor number. MOTION: Lanning/Carbano I make a motion that we deny Mr. Cohen's application for testing. ROLL CALL: Mrs. Carbano - yes Mrs. Lanning - yes Mr. Mitchell- yes Motion carried 4 - 2. Ch. Garland - yes Ms. Falco - no V.C. Morris - no Mrs. Lanning said she had issues that he was not forthcoming with the felony information and specifically with the burglary and the fact that he has not made an effort to have that record expunged which in this state can be done after 10 years. V.C. Morris said it bothered him that he had a document that did not show a state certification number nor was it dated. He suggested that the application be resubmitted. Mr. Mitchell said he felt the same way, that he did not have a problem with the past. Mohler, Jeffrey/Masonry MOTION: Morris/Garland I make a motion that we approve Jeffrey Mohler to take the exam for Masonry Specialty Contractor with a corrected letter on the notary signature and date and that the license number be shown. ROLL CALL: Ms. Falco - yes Ch. Garland - yes V.C. Morris - yes Motion carried 6 - O. Jackson, Richard/Ltd. Painting MOTION: Morris/Garland Mr. Mitchell - yes Mrs. Carbano - yes Mrs. Lanning - yes I make a motion that we approve Richard Jackson to take the Limited Painting Exam. ROLL CALL: Ms. Falco - yes Mrs. Lanning - yes V.C. Morris - yes Motion carried 6 - O. Mr. Mitchell - yes Mrs. Carbano - yes Ch. Garland - yes Burress, Michael/Roofing Mrs. Carbano noted that there was no license number of Mr. Martell's letter. MOTION: Morris/Mitchell I make a motion that we approve Mr. Burress to take the exam with an amended letter from Martell Construction that has their license number properly affixed on the letter. Mrs. Lanning amended the motion asking that the letter be dated. ROLL CALL: Mrs. Carbano - yes Ch. Garland - yes Mr. Mitchell - yes Mrs. Lanning - yes V.C. Morris - yes Ms. Falco - yes Motion carried 6 - O. . Holycross, Travis/Tile MOTION: MitchelllFalco I make a motion that Travis Holycross be approved to take the Tile test. ROLL CALL: Mrs. Carbano - yes Mrs. Lanning - yes V.c. Morris - abstained Ms. Falco - yes Mr. Mitchell - yes Ch. Garland - yes Motion carried 5 - O. Inman, DavidITile MOTION: Morris/Carbano I make a motion we approve David Inman to take the Experior Exam for Tile. ROLL CALL: V.C. Morris - yes Ch. Garland - yes Mr. Mitchell - yes Mrs. Lanning - yes Mrs. Carbano - yes Ms. Falco - yes Motion carried 6 - O. Wayne Eseltine, Building Official arrived at the meeting. Emmons, Dallas/Underground Construction MOTION: Morris/Garland I make a motion that we approve Dallas Emmons to take the Underground Construction Specialty Contractor test. ROLL CALL: Mrs. Carbano - yes Mrs. Lanning - yes Mr. Mitchell- yes Ch. Garland - yes Ms. Falco - yes V.C. Morris - yes Motion carried 6 - O. VIOLATION HEARINGS: None BUILDING OFFICIAL MATTERS: LR.C. Ord., Sec. 103.08 Mr. Eseltine provided paperwork from Indian River County showing that they adopted the State Statutory requirements and the provision found in F.S. 489.127. He said that he would like us to be consistent with the County in regards to penalties and the right to come before the Board. MOTION: Morris/Frank I make a motion that accept Wayne's documentation with regard to the County Ordinance that we present this to the City Council of Sebastian at the next convenient City Council meeting for adaptation to our Codes. ROLL CALL: Ms. Falco - yes Ch. Garland - yes V.C. Morris - yes Mr. Mitchell - yes Mrs. Carbano - yes Mrs. Lanning - yes Motion carried 6 - O. V.c. Morris asked Wayne his opinion regarding people coming from out of the area to Sebastian to be sponsored for a test. Although Wayne did not give an answer to this question, he did say that the plans were to try to get rid of the ones that the State licenses and only keep the specialty licenses. In regards to the adoption of the County Ordinance being to our Codes, a memo will be given to Attorney Rich Stringer and then the Board will be notified as to when it will be going before City Council. BOARD MATTERS: Ch. Garland felt the Board needs to involve the advice from the City Attorney concerning people coming before the Board with a felony, as to whether or not we can legally challenge this person, or because it is past history, can we even touch it. V.C. Morris suggested that the Attorney be asked to attend a meeting to go over page 3, the affidavit, and give the Board some clarification in this matter. The Board Secretary said she would see ifhe could attend the June meeting. ATTORNEY MATTERS: None. RECORD SCORES IN SCOREBOOK: Scores were recorded by Mrs. Lanning and Mr. Mitchell. There being no further business, meeting adjourned at 9:15 P.M.
