The Pledge of Allegiance was said. ROLL CALL: PRESENT: Mr. Faille Mr. Allocco Mr. Simmons (a) Mr. Paul Chmn. Smith Mr. Keough Mr. Oakes (a) Mr.Celli EXCUSED: Mr. Mahoney Mr. Hughes, School Board Representative ALSO PRESENT: Jan King, Growth Management Manager Rich Stringer, City Attorney Linda Lohsl, Administrative Secretary ANNOUNCEMENTS: Chmn. Smith said Mr. Mahoney is excused. APPROVAL OF MINUTES: MOTION by Paul/Keough to approve the minutes of May 5, 2005. A voice vote was taken and motion passed unanimously. NEW BUSINESS: QUASI-JUDICIAL PUBLIC HEARING - Conditional Use RS-10 Zoning District - Model Home Permit -1473 Barber Street - CEMCO Chmn. Smith opened the hearing. The applicant was not in attendance. Ms. King gave the staff review. The application is for a new model home permit. The contractor was asked to include a handicap parking space on the property, which could be accommodated in the driveway but he would not be required to stripe the driveway. Staff recommends approval. Mr. Allocco commented he lives next door to the site and has no problems with this application. MOTION by Paul/Oakes to approve the conditional use permit for the model home on 1473 Barber Street by CEMCO. Smith Mr. Allocco Mr. Faille yes yes yes yes Mr. Paul Mr. Oakes Mr.Celli yes yes yes The vote was 7-0. Motion carried unanimously. Chmn. Smith noted that Item B Accessory Structure Review (397 S. Wimbrow Drive) has been withdrawn. QUASI-JUDICIAL PUBLIC HEARING - WAIVER OF SECTION 54-4- 21.A.8(d)(1) RIVERFRONT OVERLAY DISTRICT - FACADE SIGN TO EXCEED ALLOWABLE SIZE - THOMAS SIGN & AWNING CO. FOR ADVANCED AUTO PARTS - 949 U.S. HIGHWAY #1 Chmn. Smith opened the hearing and swore in the applicant, staff and all who wished to speak. Mr. Gregory Davis with Thomas Sign & Awning Co. presented the application. Also present was Stephano DeLuca, 611 Edwin Street, Hollywood, FL, of Advanced Auto Parts. Mr. Davis said he has been working diligently with Ms. King to bring this project into compliance in accordance with the recommendations from this commission. He is asking to be allowed additional square footage on the side. They chose to reduce the square footage of the sign on the front elevation by as much as 50 square feet in the hopes of being allowed a sign of similar size on the side elevation. This would result in both signs being equal in proportion, color and square footage. Currently there is one sign on the site at the front elevation. Mr. DeLuca added that Advanced Auto Parts would like to have the additional sign on the side. He said because the building is on a corner, it would be more architecturally pleasing to have two signs of equal size rather than one large sign. Ms. King reviewed what had taken place when this applicant was before the commission in March of this year. She added that the applicant has diligently followed through with staff's requests to remove the red background. There are still a few outstanding issues like the red trim on the building and certain site features such as the light poles, which were painted red. The effect they are hoping to get is to have both signs visible from the intersection. Staff feels this is a good plan. The commissioners had questions about the process used to remove the red panels and Mr. Davis answered all their questions. The following people spoke: Damien Gilliams, property owner in Sebastian, commented on selling a precedent. Mr. Paul asked if this were approved would the commission be selling a precedent. Mr. Stringer responded if the front were reduced to have two matching sides and staff had no problem with the application, it could be done; but it could not be done by adding to the side if the front is at the maximum coverage. Mr. Allocco asked if the waiver ran with the building or the occupant. Mr. Stringer said it runs with the structure and if someone were to come along and change the name they would have to change the structure by starting over with a new application. Mr. Faille asked the difference between a waiver and a variance. Mr. Stringer explained if it is something that is a special requirement of the overlay district, we don't allow them to go through the normal variance. For overlay 2 PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF JUNE 16, 2005 requirements an applicant can only go to the Planning Commission for a waiver. A typical variance of anything that is throughout a district or citywide, you go to the Board of Adjustment, which is now the city council. MOTION by Oakes/Allocco to approve the waiver request for Advanced Auto Parts at 949 U.S. 1 with conditions (noted in the staff report). CHAIRMAN MATTERS NONE MEMBER MATTERS Mr. Keough expressed displeasure that the proposed restaurant at The Villages Shopping Plaza was unable to get approval for a change to the code for alcohol consumption within limits of a church or school. Mr. Allocco asked if it was true that on commercial building permits, the Building Department must check with the Growth Management Department for approvals and compliance and Ms. King said that was the procedure now. She added that they now have a computerized tracking system wherein zoning can sign off on applications. DIRECTOR MATTERS Ms. King gave an update from Code Enforcement stating that they have compliance from all but seven model homes with regard to handicap signage. He has advised the contractors where they can purchase a sign. ATTORNEY MATTERS Mr. Stringer reported on the meetings with Code Enforcement regarding Hurricane Harbor. He informed the commission that we are the only ones in the county that has not "blessed" the new impact fees by the county. We had questions and met with the county. One thing they have to put into place is to address affordability of housing. By this we mean the people who had purchased lots in the hope of coming here at a later time to build their home. There was discussion on the process of calculating the fees and the amount that would be charged. Mr. Paul asked about the "Welcome to Sebastian" sign that had been located on 66th Avenue, where it turns into Schumann. He said it is no longer there. Ms. King said she would contact Jerry Converse to look into what happened to the sign. Mr. Gilliams commented on the impact fees. Chmn. Smith adjourned the meeting at 7:47 p.m. (6/30/05 SBL) 3
