R-96-90 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, ELECTING TO USE THE UNIFORM METHOD OF COLLECTING NON-AD VALOREM SPECIAL ASSESSMENTS LEVIED WITHIN THE INCORPORATED AREA OF THE CITY; STATING A NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING OF THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Sebastian, Indian River County, Florida (the "City Council"), is contemplating the implementation of an ordinance providing for stormwater management and road projects and services within the area of the City of Sebastian (the "City); and WHEREAS, the ordinance will require that each property owner shall pay for the provision of stormwater management and road projects and services through a special assessment on such property; and WHEREAS, the City Council intends to use the uniform method for collecting non-ad valorem special assessments levied within the City as authorized by Section 197.3632 3 (a), Florida Statutes, as amended, because this method will allow such special assessments to be collected annually commencing in November, 1997 in the same manner as provided for ad valorem taxes; and WHEREAS, the City Council held a duly advertised public hearing prior to the adoption of this Resolution, proof of publication of such hearing being attached hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows: Section 1. That commencing with the 1997-1998 Fiscal Year and with the tax statement mailed for such Fiscal Year, the City intends to use the uniform method of collecting non-ad valorem assessments authorized in Section 197.3632, Florida Statutes, as amended, for collecting the non-ad valorem assessments, levied throughout the incorporated area of the City for the provision of stormwater management and road projects and services. A legal description of such area subject to the assessments is attached hereto as Exhibit B and incorporated by reference. Section 2. That the City hereby determines that the levy of the assessment is needed to fund the cost of the provision of stormwater management and road projects and services within the City. Section 3. That, upon adoption, the City Manager is hereby directed to send a copy of this Resolution by United states mail to the Florida Department of Revenue, the Indian River County Tax Collector, and the Indian River County Property Appraiser by January 10, 1997. Section 4. EFFECTIVE DATE. This Resolution shall take effect immediately upon its adoption.
