(!C~/c;.<:l~ APPROVED DATS oS-- APPROVED SUBJECT TO_ MINUTES OF REGULAR MEETING Chairman Smith called the meeting to order at 7:01 P.M. The Pledge of Allegiance was said. ROLL CALL: Roll call was not done but the recording secretary noted the following: PRESENT: Mr. Faille Mr. Mahoney Mr. Oakes Mr. Mahoney Chmn. Smith EXCUSED: Mr. Allocco Mr. Keough Mr. Celli Mr. Simmons Mr. Hughes, School Board Representative TREE BOARD MEMBERS PRESENT: Lynn Albury, Chairman Neil Lagin Henry Madison Therese Miller ALSO PRESENT: Dorri Bosworth, Zoning Technician AI Minner, City Manager Terry Hill, Public Works Director Wayne Eseltine, Building Department Director Linda Loshl, Recording Secretary ANNOUNCEMENTS: Chmn. Smith announced Mr. Keough, Mr. Celli and Mr. Simmons have excused absences tonight. He welcomed the Tree Advisory Board to the workshop. APPROVAL OF MINUTES: A voice vote was taken and the minutes of July 7, 2005 were approved unanimously. OLD BUSINESS: NONE NEW BUSINESS: WORKSHOP WITH TREE & LANDSCAPE ADVISORY BOARD REGARDING PROPOSED AMENDMENTS TO ARTICLE XIV, LAND DEVELOPMENT CODE, GTREE PROTECTION AND LANDSCAPING REGULATIONS PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF JULY 21, 2005 Chmn. Smith asked staff to make their presentation. Ms. Bosworth gave a history of these regulations. She referred to a letter from Cathy Fulton, who was chairman of the Tree Board in 2003. Ms. Bosworth explained that with the update of the Comprehensive Plan, Land Development Code changes are reviewed at the same time so as to keep the cost of these changes to a minimum. She noted a question for the city attorney to address is how would land clearing permits that are already in the process of approval be affected as the applicant is given the current tree ordinance code when an application is applied for. Specific items Ms. Bosworth presented were trees removed within a setback area to be replaced with specific species and size and they added species to the prohibited list. Mr. Minner read a letter from Councilwornan Andrea Coy regretting she was unable to attend the workshop and professed she was an advocate of the ordinance and would iike to see it expedited. She asked that a paragraph be included in the iand ciearing section allowing clearing only on days and times that city hall is open. Chmn. Smith asked if anyone from the tree board was going to make a presentation. Chmn. Albury said she wasn't aware she had to make a presentation but said the board would like to get the changes expedited quickly. There was discussion amongst the two commissions regarding specimen trees that are removed and size and type of trees to be used for repiacement. There also appeared a possible contradiction between required trees and replacement of trees within a setback area. It was decided that trees within the setback area replaced up to the limits of good forestry practice for the lot size. Mr. Paul inquired why the FP&L restrictive tree list contained more species than our regulation lists. Mr. Madison commented that FP&L are only concerned about what is planted within their easement and does not look at the homesite as a whole. There was extensive discussion regarding enforcement of tree removal and planting. Mr. Eseltine addressed the commission and said tree requirements are a condition to obtain a CIO (certificate of occupancy). He cautioned the board members that however they rewrite the code, it has to be enforceable. He feit some of the sections were vague and needed more explicit wording. Mr. Minner added that the two conflicting sections should to complement each other. Ms. Albury said they agreed to strike the phrase "of good forestry practice" and change it to "according to your lot size". There was extensive discussion regarding the means in which inspectors can verify that the regulation sized tree has been planted, either by 15 gallon container or trunk diameter measurement. The issue of the size of a protected tree for replacement of an existing tree came up and it was determined that it has to be replaced with two, 15 gallon, three inch caliber DBH (diameter at breast height). It was also explained that it was okay to remove protected trees footprint of the house but if they are removed from any of the seback areas, they must be replaced by code in addition to the seven trees required for aC/O. Ms. Bosworth asked for a clarification from the commission if they wanted the section pertaining to trees in the setback area removed from the code or reworked and resubmitted to Planning and Zoning Commission. Chmn. Smith instructed her to meet with Mr. Eseltine and the Tree Board to determine the probiems that are currently 2 PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF JULY 21, 2005 occurring and come to an agreement on the wording for the code then bring that back to the commission. Mr. Mahoney asked if they would be reviewing the section for commercial landscaping and Mr. Madison said they had not reviewed that section yet. Chmn. Smith added that they should resolve the residential section first. MEMBER MATTERS: DIRECTOR MATTERS: NONE NONE CHAIRMAN MATTERS: Ms. Bosworth reported on the sign Mr. Paul inquired about on 66th Street and said it was damaged by the hurricane and on a list to be done. Mr. Mahoney asked about the "No Pets Permitted" signs that were blown down from the hurricanes and have not been replaced. He said people have been bringing pets into the park and he would like to see the signs repiaced. Ms. Bosworth said she would look into the matter. Chmn.
