Chairman Dodd called the meeting to order at 2:00 p.m. with a pledge to the flag. 2. ROLL CALL: Present: Absent: Chairman Charles Ed Dodd Eva Schofield Ronald Van Buskirk Fred Clement Hank Buchanan Howard Brauer David Johns (alt) Alternate member Raymond Tetro has resigned his seat Excused: Carl Anderson Also Present: Code Enforcement Officers City Attorney Interim Secretary Warren Lindquist Antoine Van Meir Richard Iachini Rich Stringer Barbara Quinn Chairman Dodd explained that David Johns would be voting in the place of the excused member 3. The minutes to the July 20, 2005 Code Enforcement Board meeting were approved as written by a voice vote 7-0 4. Additions & Deletions- Officer VanMeir asked to delete agenda items B, Case #2005- 16431- Anthony & Carol Ann Scaramuzzi, Jr- 374 Midvale Terrace. He confirmed that the Scaramuzzi's have complied with the ordinance by obtaining an occupational license. 5. NOTICED HEARINGS: A. VIOLATION HEARING- CASE #2005-16583 DELMONT W. OQUlST-1413 N. CENTRAL AVENUE SECTION 54-3-16.8(A)(I) CITY OF SEBASTIAN LAND DEVELOPMENT CODE- (a)(l) Any non;,onforming sign which is destroyed or damaged, to the extent of 50% or more, or is altered or replaced, shall not be altered, replaced ore reinstalled unless and until it sball have been made to conform to tbe provisions of tbis article. Code Enforcement Meeting August 17,2005 Page 2 00 Chairman Dodd swore in Officer Antoine VanMeir who presented his credentials and the City's case. He stated he investigated this case on June 23, 2005 and found that the sign was replaced without a permit from the City. He reported that he allowed the owner time to come into compliance, he did not. Officer VanMeir showed the Board members pictures of the sign in question. He then asked the Board to allow the respondent a reasonable amount oftime to come into compliance, ifhe does not comply, he suggests issuing a $250 per day fine until he brings the property into compliance with the City of Sebastian ordinances. Chairman Dodd swore in Mark Oquist, who is representing his father, Delmont Oquist. Mr. Oquist stated, after reviewing the letter from the City, he has been in contact with the sign company and that he and his father want to make sure everything is done to code He received a letter from the sign company that the new sign should be up in six weeks from September 19, 2005 and in compliance with the City Code of Ordinance. Mr. Oquist is not sure if the drawings have been submitted to the City yet. He commented that the sign will be approximately 10 feet from top to ground with approved skirting around the pole. He stated the original sign was blown down during the hurricane last year- Answering a question, Mr. Oquist said the new sign that was erected was made to the same specifications as the old sign with only faces and design work being altered. Officer VanMeir read the ordinance that stated any non-conforming sign which is damaged to the extent of 50% or more or is altered or replaced, shall not be replaced or reinstalled until it has been made to conform to the provisions of the City's ordinance. Mr. Oquist stated he has the drawings that show he and his father have made the sign company put skirting on to meet the requirements of the code. Officer VanMeir stated the Planning & Zoning and Building departments will not approve the sign until it meets the current criteria- once the permit is issued, construction can begin. MOTION on case 2005-16583 made by Ed Dodd, that Delmonte Oquist is in violation of the code and has until October 17, 2005 to come into compliance, if not in compliance by that time, a $250 per day fine could incur City Attorney Stringer suggested that the time period be until October 20, the day after the scheduled Code Enforcement Board meeting. He stated that the Growth Management Department has not seen the drawings yet. IfMr. Oquist and City staff come before the Board at that meeting and both concur that they are close but are still working on it, the Code Board could extend that time period before the fines begin to accrue. Chairman Dodd amended his motion to October 20, 2005 for a compliance date. CHAIRMANS MATTERS- There were none 8. MEMBERS MATTERS: Fred Clement apologized for not being in attendance ofa few of the past meetings. He stated he had health issues but is now quite fit and able to attend. 9. CODE OFFICER MATTERS: Officer Richard Iachini stated that Case #2005-13486, Sandy Pines, Ltd, 1163 Schumann Drive came into compliance within the required timeframe imposed by the Code Board- the case is cleared and a notice of compliance was issued to the owners. Ronald VanBuskirk asked about the lien at 165 Caprona Street. Mr. Stringer replied that he was going to address this item under his matters. 10. ATTORNEY MATTERS: Mr. Stringer stated that the council would not reduce the amount of the lien against 165 Caprona Street. He stated that the $17,000 was placed in escrow at the time of closing and the City has since received this money. He advised the board that the matter is completed. There being no further business to come before the Board, Chairman Dodd adjourned the meeting.
