2. Requested Action: Variance requested from Section 54-2-5.11.(f).(3) to allow
structures to be 30 feet in height, whereas the code would limit the structures to 25 feet in
height.

a. Narrative of proposed action: KB Home is requesting a variance to allow the
construction of several of their models that will exceed the 25-foot height
limitation in Sebastian River Landing Phase Two. The height limitation is
established by the RS-10 zoning districts to the east and south of this property.

8. Staff Comments:
In May of 2003, Forte Macauley Development Inc. annexed the property now known as
Sebastian River Landing (Phase One) into the city limits of Sebastian. The zoning for
that property was established as PUD-R (Planned Unit Development -Residential). Per
the Sebastian Land Development Code, the maximum height in a PUD-R shall not
exceed the maximum height established for the adjacent residential district. Because the
PUD did not abut a residential district (it was separated from the RS-10 zoning district by
an area of conservation), the maximum height in Sebastian River Landing was
established at 35 feet.
Subsequently, in January of 2004, the same developer annexed another property now
known as Sebastian River Landing Phase Two into the city limits of Sebastian. The
zoning for that property was also established as PUD-R. However, SRL Phase Two abuts
the RS-10 zoning district immediately to the east, and was therefore limited to a building
height of 25 feet. This was discussed with the developer at length during the preliminary
plat phase of the review process, and a memo dated August 24, 2004 by Tracy Hass,
Director of Growth Management, was placed in the City file.
Later, the Spencer property to the south was annexed into the City and given the RS-10
zoning classification (25 foot height limitation).
The request for a variance is to allow KB Home, who presently owns all of Sebastian
River Landing Phase Two, to construct homes that exceed 25 feet in height. Further data
submitted by KB Home since the initial application indicates the height of their tallest
model to be 28 feet 8 inches. Per code, only the minimum variance necessary may be
granted. Therefore, the request is for a maximum height limitation of 28 feet 8 inches.
Staff has concerns about the issuance of this variance. The PUD-R District provisions
"establish a voluntary management framework for negotiating innovative development
concepts which protect nature features and provide abundant amenities designed to
benefit the City as well as the specific development. All planned unit developments shall

be designed and administered consistent with the criteria and administrative procedures
in Article XX, Planned Unit Development, and shall comply with all provisions of the
Land Development Code." As such, the original owner made the choice to request a
PUD-R zoning to allow the negotiation of various issues such as lot size, width, depth
and setbacks. However, the height is determined by the adjacent residential district to
provide a similarity between a traditional zoning district and the more innovative PUD-R
zoning district. Sebastian has three traditional single-family zoning districts described as
follows:
RS-10 minimum lot size 9,500 SF height limitation of 25 feet
RS-20 minimum lot size 20,000 SF height limitation of 35 feet
RE-40 minimum lot size 40,000 SF height limitation of 35 feet
As noted above, zoning districts with larger lot sizes are allowed additional height. The
lot sizes in Sebastian River Landing Phase Two range from an average of 6,600 SF on the
interior lots to 9,000 SF on the perimeter lots, which is still smaller than the RS-10
zoning district lots.
The height limitation was thoroughly discussed with the original owners and the
justification was noted in our records. Change of ownership should not require the need
to grant variances.
BOARD CRITERIA FOR DETERMINING VARIANCES (Section 54-1-2.5):
In order to authorize any variance from the terms of the land development regulations, the
Board of Adjustment must find the following:
a. Existence of special conditions or circumstances.
b. Conditions not created by applicant.
c. Special privileges not conferred.
d. Hardship conditions exist.
e. Only the minimum variance granted.
f. Not injurious to public welfare or intent of ordinance.
g. Conditions and safeguards may be imposed.
h. Time limit may be imposed.
i. No use variance permitted in specified instances.

Please reference Section 54-1-2.5 of the Land Development Code for further explanation and
clarification of the conditions as set forth above.
Staff Recommendation:
Staff recommends denial of this request. The applicant has many existing models that meet the
code limitation and should consider redesigning those models that do not meet code.
Commission Action:
Hold quasi judicial hearing to consider the variance request.

into KB HOME Treasure Coast LLC, which is a limited liability company formed in the State of
Delaware, and which is sometimes hereinafter referred to as the "surviving company". The laws of the
jurisdiction of the limited liability company of the disappearing company permit the merger of a
business limited liability company of said jurisdiction with and into a business limited liability
company of another jurisdiction.
2r The separate existence of the disappearing company shall cease upon the effective date of the
merger in accordance with the provisions of the laws of the jurisdiction of the limited liability
company of said limited liability company.
3. The surviving company shall continue its existence under its present name pursuant to the
provisions of the Limited Liability Company Act of fine State of Delaware.
4. The Certificate of Formation of the surviving company upon the effective date of the merger in
the State of Delaware shall be the Certificate of Formation of said surviving company and shall
continue in full farce and effect until amended and changed in the manner prescribed by the
provisions of the Limited Liability Company Act of the State of Delaware.
5. The limited liability company agreement of the surviving company upon the effective date of
the merger in the State of Delaware shall be the limited liability company agreement of said surviving
company and shaIl continue in full force and effect until changed, altered or amended as therein
provided and in the manner prescribed by the provisions of the Limited Liability Company Act of the
State of Delaware.
b. The Member and officers in office of the surviving company upon the effective date of the
merger in the State of Delaware shall continue to be the Member and the officers of the surviving
company, all of wham shall hold their Membership and offices until the election, choice, and
qualification of their respective successors or until their tenure is otherwise terminated in accordance
with the limited liability company agreement of the sucrviving company.
7. Any membership interests of the disappearing company shall, upon the effective date of the
merger, be cancelled without consideration. The membership interests of the surviving company shall
not be converted or exchanged in any manner or any consideration be paid therefor,
8. Upon the effective date of the merger, the surviving company shall acr~uire all ~sa~ and
liabilities of the disappearing company, including real property previously held in the Warne of the
disappearing company, by operation of law, and shall assume any and all rights and obligations of the
disappearing company in connection therewith.

9. In the event that the merger herein provided for shall have beers fully authorized in
accordance with the provisions of the laws of the jurisdiction of ttte limited liability company of the
disappearing company and in accordance with the provisions of the statutes of the State of Florida, the
disappearing company and the surviving company hereby agree that they will cause to be executed
and filed and/or recorded any document or documents prescribed by the laws of the State of Florida
and of the State of Delaware, and that they will cause to be performed all necessary acts therein and
elsewhere to effectuate the merger.
10. The Member and the proper officers of the disappearing company and the Member and
officers of the surviving company, respectively, are hereby authorized, empowered and directed to do
any and all acts and things, and to make, execute, deliver, file, and/or record any and all instruments,
papers and documents which shall be or became necessary, proper or convenient to carry out or put
into effect any of the provisions of this Agreement of Merger or of the Merger herein provided far.
11. Notwithstanding the full authorization of the merger herein provided for, the merger may be
abandoned at any time prior to its effective date in the event t the Member of Evans Group, LLC
and the Member of KB HOME Treasure Coast LLC deem it avisabie and appropriate to do so.

Sebastian River landing Phase II
The project will incorporate elements from the downtown redevelopment area to
convey the established design image of the City. The entry into the community
will be via a bridge crossing a tributary of the Sebastian River with native tropical
hammock. The bridge will be the focal point which separates phase one from
phase two of the development. We will incorporate downtown elements into the
bridge such as grand columns, native landscaping, and inviting brick pavers,
which will capture the attention of those driving into the community. The homes
will emulate the downtown vision with metal roofing and stucco siding with colors
such as the yellow as shown in the below image. The goal is to create a sense
of community identity with the use of similar design attributes from the downtown
area (see below picture).

Pride in Sebastian Community Beatification Award Winner
The City of Sebastian has been actively involved in restoring the community
image through the creation of a downtown redevelopment area. The selected
architectural elements were derived from the City's pride in its fishing village
history. Fishing, of the subsistence and recreational varieties, had flourished in
the area since the time of the Ais Indians. It didn't take long for the fishing
business to expand, and Sebastian had begun to emerge as a small fishing
village by the end of the century. One of the original commercial fishing families,
Archie Smith and Bascomb Judah still operate from their original fish house
located on Indian River Drive. The driving force behind the success of Sebastian
as a fisherman's haven is the Sebastian River and the Sebastian Inlet (see below
picture).

$1.1 million land purchase helps Indian River Lagoon
Land preservation should prevent more water runoff

INDIAN RIVER COUNTY -The Marine Resources Council of East Florida has just won a major victory in the name of
conservation.
Last Thursday, the nonprofit, Palm Bay-based environmental organization closed on the $1.1 million purchase of eight acres
of land next to Sebastian Creek, which connects to the South Prong of the St. Sebastian River. This parcel of undeveloped
land is southeast of County Roads 512 and 510 and south of the future Sebastian River Landing neighborhood.
The publicly-owned eight acres will be conserved and improved, with native plants and trees replacing evasive ones, to help
protect these waterways and the Indian River Lagoon from pollution, Jim Egan, the council's executive director, said Tuesday.
"We're looking to preserve as much of the land by the river and creek as possible," Egan said.
The council now is working on acquiring 62 adjacent acres of undeveloped land for conservation. Several future Sebastian
subdivisions of single-family homes border the land the council intends to preserve.
Egan said the $1.1 million came from the Florida Communities Trust, a state land acquisition agency that helps to preserve
green space. The seller was Wayne Lawrence, whose former home at the site could be converted into an environmental
educational facility, with a proposed canoe and kayak launch nearby.
"This purchase wouldn't have been possible without his interest in seeing a piece of old Florida get preserved, rather than
turning into a housing development," Egan said.
Conserving the land instead of developing it means the waterways won't be inundated with more storm-water pollution from
streets, driveways and roofs, he said.
And Egan cited another reason to conserve the land: local scientist Grant Gilmore has identified eight species of fish that live
in the narrow, upper parts of the St. Sebastian River but nowhere else in the world. These include the opossum pipefish,
which look like seahorses, Egan said.
Sebastian Mayor Nate McCollum was pleased to hear about the Marine Resources Council's accomplishment.
"I think their goal to make that environment safe is a great relief to those of us in Sebastian, because we have always been
concerned about growth along the St. Sebastian River," he said. "We've always been concerned about development, and not
only what would go there but the runoff from buildings. I think this (land purchase) is just very good news for the entire North
County area."
Marine Resources Council members hope to know in the next two months whether the Florida Communities Trust will provide
about $2.2 million, or the appraised value for a second eight-acre parcel south of the land they just bought. The second eight-
acre parcel is owned by Sam B. Nevel Inc., of Miami, which might donate an adjacent eight acres, Egan said, meaning the
company could end up turning 16 acres over to the council.
"The $2.2 million is already lined up, but (the purchase) is not a done deal," Egan said.
He said council members are working with state officials on the legal wording of a proposed purchase

Finally, the council plans to apply for a grant from the trust in the spring to buy 46 adjacent acres later this year. Council
members might find out by next fall whether they would receive the grant, and they then would get an appraisal of the land,
which is owned by a local family, Egan said.
The council hopes its recent and proposed conservation land purchases connect with other public conservation lands,
including the huge St. Sebastian River Preserve State Park northwest of C.R. 512 and 510.
