CODE ENFORCEMENT BOARD
MINUTES OF REGULAR MEETING
March 15, 2006
1. Chairman Dodd called the meeting to order at 2:00 p.m. with a pledge to the flag. He
introduced and welcomed Clarence Barton as tbe new alternate member to the Code
Enforcement Board

3. The minutes to the February 15, 2006 Code Enforcement Board meeting were approved
as written on a motion by Howard Brauer, second by Ron VanBuskirk- voice vote: Ayes

4. Additions & Deletions- Item A- 101 Indian Avenue will be removed from the agenda,
Item C- 602 Concha Drive will be added

The maintaining, using, placing, depositing, leaving or permitting to be or remain on any public or private property of
any of the following items, conditions, or actioos is hereby declared to be and constitute a nuisance; provided, however,
this enumeration shall not be deemed or coostrued to be conclusive, limiting or restrictive

(1) Accumulations of trasb, litter, debris, garbage, bottles, paper, cans, rags, dead or decayed fisb,

Chairman Dodd swore in Code Enforcement Officer, Richard Iachini, who stated his
credentials and the city's case- The owner spoke with Officer Iachini several months ago
and said everything would be taken care of. It has not been. Debris around back must be
cleared out, shingles are allowed to remain if covered and stacked neatly. He asked the
board to give the respondent 5 more days to come into compliance or be fined $250 per
day for every day not in compliance. The vehicle on the property is not in question at the
present time. The accumulation of trash & debris are the issues for the Board to address
today.
Mr. Reed was sworn in by Chairman Dodd. Mr. Reed stated he would comply with the
ordinance and remove the trash & debris removal today. Upon questioning, Mr. Reed
stated he would be done removing the trash and debris by Friday, March 17, 2006. He is
trying to get a loan to have someone help him finish the roof.
MOTION made by Ed Dodd ref case #2005-33778, finding the respondent in violation
of the SECTION 66~3 ofthe Code of Ordinances of the City of Sebastian, giving him
until March 22, 2006 to come into compliance with the code. If not complied by that
date, the respondent win receive a $100 per day fine until complied, second by Howard
Brauer

Officer Iachini presented the City's case. All attempts to contact the violator met with
negative results. He showed pictures taken on 3/13/06 of the vehicles. He asked that the
board allow three additional days for the respondent to come into compliance or receive a
$250 per day fine for every day the violation exists. He explained what needs to be done
with the vehicles.
Debra Goodin addressed the board- She explained that she has been staying with her
mother for a while. Ms. Goodin stated she would get rid of the vehicles.
After a discussion MOTION made by Howard Brauer reference case #2006-1570,
finding the respondent in violation of SECTION 66-3(12) giving her until April 19, 2006
to come into compliance or receive a $250.00 per day fine until the property comes into
compliance, second by Carl Anderson.

7. CHAIRMAN'S MATTERS- Chairman Dodd stated that Eva Schofield's term is up in
April and she has indicated that she does not wish to remain on the board. He told the
alternates to contact the City Clerk and tell her if they were interested in a regular
membership on the board.
8. MEMBER'S MATIERS: Roo VanBuskirk brought up the case where a "Support Our Troops"
sign put in someone's yard was cballenged by her homeowners associations with removal or
receive a $100 per day fine because the sign is a violation of association rules.
9. CODE OFFICER MATTERS: Officer Van Meir reported on:
a. Case #2005-22839, 1301 US Highway One, is now a vacant building- Attorney
Stringer stated when they stopped using the property they came into compliance
b. Case 2005-2692- Florida Power Sports- 1301 US Highway One: The are no longer
in business in the city- and vacated prior to the date a fine would have incurred.
c. Case #2005-36126- Patrick White- 562 Drawdy Street- has complied prior to date
the fine would have incurred, photographs of property shown
d. Case #2005-32525- Steven Krasco, 592 Orange Avenue- has complied prior to date
the fine would have incurred, photographs shown
e. Case #2~713A- Bamma Subs, 1671 US Highway One- is not in compliance and
fines of $100 per day are accruing since March 14th

f. Case#2006-2344- Zhen Guo, 101 Empire Terrace, has paid the administration costs
prior to the date the fine would have incurred
g. Case 2005-35822, Michael Linscott, 573 Michael Street, is not in compliance and the
fine is accruing.
10. ATTORNEY MATTERS: NONE
11. PUBLIC INPUT: Baxter Caustin, 660 Balboa Street, asked about a fence going
beyond the front line of the house. He was told that a fence could go past tbe front line of
the building and to the property line. After further discussion by Mr. Caustin, Mr.
Stringer informed him that the board does not do enforcement, they judge cases and can
not hear any information on perceived problems or else they will not be able to hear the
case if it comes before them.
There being no further business to come before the Board, Chairman Dodd adjourned the
meeting at 3:45 pm
