Meeting was called to order at 7:00 P.M. by Ch. Garland

NEW BUSINESS: Thomson*Prometric Exams (formally Experior)
The Board Secretary told the Board that Jackie Flanagan was being removed from the
agenda since he is getting his Electrical Contractor license issued through a letter of
reciprocity, which is handled in-house. Also being removed from the agenda is Derek
Goodridge. He called and said he was still in Georgia and asked to be put on the May
agenda. She also asked for a motion to be made to put Yesith Villamizar, Limited
Painting be added to the agenda. (see attached memo)

I make a motion that we add Yesith Villamizzar to the agenda.
A voice vote was taken - passes unanimously.
Ch. Garland swore in all applicants present.

Adding Yesith Villamizar to the agenda.
Mr. Villamizar appeared before the Board at the March meeting. He was denied pending more
proof of experience for Ltd. Painting.
While I was on vacation/sick leave, we did receive additional paper work. The gal that was
trying to help me while] was out was not aware of this and did not put his name of the agenda.
At this time I am requesting a motion be made to put Mr. Villamizar's name on the agenda.

Rich Stringer, City Attorney spoke to the Board. He said that a Consent Order had been
done and that he was asking it be accepted instead of having a hearing. He went over the
order with the Board. (copy of order attached)

CONSENT ORDER
THIS CAUSE being before the Construction Board of the City of Sebastian for public hearing,
on April ] 1, 2006, and the Board being presented with this Consent Order, it makes the following
FINDiNGS OF FACT
]) That the Respondent, a licensed landclearing contractor operating within the jurisdiction of the
City, was hired by a licensed demolition contractor to perform demolition work for which
Respondent was not licensed.
2) That, without admitting guilt, Respondent does not contest these charges.
WHEREFORE, based upon the foregoing Findings, it is hereby ORDERED.
That Respondent Mike's Landclearing & Excavating, Inc. is adjudged to have committed a
violation of Section 26- 172 of the City Code, and shall be fined in the amount of $250 dollars. (/--)\

I make a motion the in regards to 26-171 ( a), unlicensed contractor that we accept the
Consent Order showing a fine of $250.00, which must be paid within 15 days. If not paid
Mr. Pelletier license shall be suspended unless and until payment is received.
Additionally, Mr. Pelletier will be on probation for 1 year commencing April 11, 2006.

Ch. Garland swore in Raymond Hurley and Bruce Hurley.
All of the homeowners involved in the re-hearings were sworn in by Ch. Garland.

Mr. Nicolini, owner, noted that there had been no communication with Mr. Hurley. Mr.
Nicolini told the Board that he had given a deposit of $1 ,900.00.

Mrs. Milewski, owner, told the Board they had paid $16,200.00 and had not heard from
Mr. Hurley.
749 Wentworth St. - 26-172(5), Diversion of Funds

Mr. Sutter, owner, gave a deposit of$3,983.00 and had not heard from Mr. Hurley since
the March meeting.

Susan Lorusso, owner, gave a deposit of $2,500.00 to Coastal Cages who was suppose to
give it to Hurley Builders. She had screen enclosure put up by another contractor from
Vero.
Ch. Garland asked the Board Secretary what the fines were from last meeting. She said
each violation hearing was fined $1,000.00, with a grand total of$5,000.00.
805 Holden Ct. - 26-172(5), Diversion of funds
26-172(10), Abandonment of a Construction Project
Carl Michaud, owner, said a deposit of $2,000.00 was paid with an additional $8,000.00
when the material was dropped. Most of the work was completed but no inspections
were done. Unfortunately, it was not built according to the specifications. He asked to
speak to their superintendent, but never spoke to anyone after the request was made.
Bruce Hurley said that everyone at the meeting was part of a fraud as well as fraud
against themselves. He said that they thought Hurley Builders were the ones getting paid
but in fact they were not. Bruce Hurley said that they did not have a contract with
anyone in Sebastian.

that were imposed.

this by a case-by-case basis or uphold the previous decision made by the Board.

Attorney Stringer asked to go back to the Pelletier case. He said the Board has the right
to put him on probation but it has to be for a set time, up to 3 years.

probation be a period of 1 year.

BUILDING OFFICIAL MATTERS:
The Building Official asked the Board to please come in to pick up their packets in a
timely fashion. Also, it was noted that all the members know the meeting is always the
second Tuesday of the month and that phone calls should not have to be made as a
reminder of the meetings and that the packets are ready to for pickup. Packets should
also be reviewed before coming to the meeting. He said the packets would be ready for
pickup the Friday before the meeting.
