The Pledge of Allegiance was led by Chairman Garland. ROLL CALL: Present: Ms. Falco Mr. Nagy Ch. Garland Ms. Lanning Mr. Dalessandro Mr. Widup Absent: V.c. Morris Mrs. Carbano Mr. Conover All were excused. Also present: Wayne Eseltine, Building Director/Official APPROVAL OF MINUTES: Regular Meeting held 2/14/06. MOTION: Lanning/Garland I make a motion we approve the minutes of meeting held 2/14/06 as written. A voice vote was taken - passes unanimously. OLD BUSINESS: None NEW BUSINESS: Experior Exam Severino, Thomas/ A/C "B" Contractor Mr. Severino was sworn in by Ch. Garland. MOTION: Garland/Falco I make a motion we approve Mr. Severino to take the test for Class "B" NC. ROLL CALL: Mr. Nagy - yes Ch. Garland - yes Mr. Widup - yes Ms. Lanning - yes Mr. Dalessandro - yes Ms. Falco - yes Motion carried 6 - O. Gruber, Brett T.lAluminum Construction Mr. Gruber was sworn in by Ch. Garland. MOTION: Falco/Widup I make a motion we approve Mr. Gruber to take the test for Aluminum Construction. ROLL CALL: Mr. Widup - yes Mr. Dalessandro - yes Ms. Falco - yes Mr. Nagy - yes Ch. Garland - yes Ms. Lanning - yes Motion carried 6 - O. Villamizar, Yesith E.lDrywall Villamizar, Yesith E.lLtd. Painting Mr. Villamizar and his translator (name not given) were sworn in by Ch. Garland. Ch. Garland noted that there was not enough experience showing in both the drywall and limited painting trades. MOTION: Garland/Falco I make a motion that Mr. Villamizar come back before the Board in April showing the required two years experience in both drywall and limited painting. ROLL CALL: Mr. Dalessandro - yes Ms. Falco - yes Mr. Nagy - yes Ch. Garland - yes Ms. Lanning - yes Mr. Widup - yes Motion carried 6 - O. VIOLATION HEARINGS: Raymond S. Hurley, Hurley Builders & Developers, Inc. 210 Main Street - 26-172(5), Diversion of Funds 26-172(10), Abandonment of a Construction Project Mr. Raymond Hurley and Mr. Bruce Hurley were sworn in by Ch. Garland. Before the violation hearing was discussed, Ch. Garland began the discussion for the request of a re-hearing on the five (5) violations brought before the Board at their February 14,2006 Meeting. It was noted that at the March Meeting Raymond and Bruce Hurley were not in attendance. When asked why, Bruce Hurley said that because of a massive fraud committed against their company and because of all of the hearings and law suites resulting from the fraud committed against them and unfortunately the wrong date was written on the calendar for the February meeting. He said they called Wayne Eseltine and asked what could be done to remedy it and he suggested that a re-hearing be requested. Mr. Hurely said they had information that needed to be heard by the Board. Because there was a new violation hearing on the agenda, re: Hurley Builders, Mr. Dalessandro suggested the hearing be heard before a decision is made concerning the re- hearings being requested. Raymond S. Hurley, Hurley Builders & Developers, Inc.l210 Main Street Bruce Hurely said the contract signed on this job was not a valid contract. The account the money was deposited into was not a valid Hurley Builders account. He said that none of the cases heard last month were actual Hurley Contracts. MOTION: Lanning/Delassandro I make a motion that this complaint be dismissed. ROLL CALL: Ms. Falco - yes Mr. Nagy - yes Ch. Garland - yes Mr. Widup - yes Ms. Lanning - yes Mr. Dalessandro - yes Motion carried 6 - O. MOTION: Garland/Falco I make a motion that we allow Hurley Builders to come back in April to counter the fine that was put against them and bring with them all the necessary paper work as to who is up to date with their job, who got their money back, who got an screen enclosure, etc. ROLL CALL: Ms. Falco - yes Mr. Nagy - yes Ch. Garland - yes Mr. Widup - no Ms. Lanning - no Mr. Dalessandro - yes Motion carried 4 - 2. Raymond Tummolo, Tummolo Aluminum, Inc. 637 Cavern Ter. - 26-172(5), Diversion of Funds 26-172(10), Abandonment of a Construction Project Mr. Tummolo was sworn by Ch. Garland. Mr. Tummolo told the Board that the money was refunded and that he had a release from the homeowner in hand. MOTION: Lanning/Falco I make a motion that we dismiss both diversion of funds and abandonment based on the fact that the money was refunded. ROLL CALL: Mr. Nagy - yes Ch. Garland - no Mr. Widup - no Ms. Lanning - yes Mr. Dalessandro - no Ms. Falco - no Motion fails 4 - 2. MOTION: Garland/Widup I make a motion that in regards to 26-172(10), Abandonment of a Construction Project that we fine Mr. Tummolo $100.00. ROLL CALL: Ms. Falco - no Mr. Nagy - yes Ch. Garland - yes Mr. Widup - yes Ms. Lanning - no Mr. Dalessandro - yes Motion carried 4 - 2. Raymond Tummolo, Tummolo Aluminum, Inc. 948 Canal Circle - 26-172(5), Diversion of Funds 26-172(10), Abandonment of a Construction Project Mr. & Mrs. Winkel, owners of the property were sworn in by Ch. Garland. MOTION: Lanning/Widup I make a motion that we levy a fine of$250.00 on each account for the diversion of funds and for the abandonment of a construction project for a total the total fine to be $500.00. ROLL CALL: Ms. Falco - no Mr. Nagy - no Ch. Garland - yes Mr. Widup - yes Ms. Lanning - yes Mr. Dalessandro - yes Motion carried 4 - 2. Raymond Tummolo, Tummolo Aluminum, Inc. 412 Bywood Ave. - 26-172(5), Diversion of Funds 26-172(10), Abandonment of a Construction Project It was noted that no permit had been pulled for this job. Mrs. Driben, owner of the property was sworn in by Ch. Garland. Mrs. Driben said that she still wanted Mr. Tummolo to do the job and did not ask for a refund. MOTION: GarlandlNagy I make a motion that at 412 Bywood Ave. that 26-172(5), Diversion of Funds and 26- 172( 1 0), Abandonment of a Construction Project be dropped with no fines. ROLL CALL: Mr. Nagy - yes Ch. Garland - yes Mr. Widup - yes Ms. Lanning - yes Mr. Dalesssandro - yes Ms. Falco - yes Motion carried 6 - O. Douglas Michels, Michels Screening, Inc. 517 Drawdy Way - 26-172(5), Diversion of Funds 26-172( 1 0), Abandonment of a Construction Project Mrs. Conners, owner of the property was sworn in by Ch. Garland. Mrs. Connors said she did not want them to do the work. After visiting the office, she felt threatened and did not want them on her property. She did want a refund, which Mr. Michels refused to do. MOTION: Garland/Widup I make a motion that on 26-172(5), Diversion of funds, that no fine be set forth due to the monies spent on the job and on 26-172(10), Abandonment of a construction project, that due the fact that permit process was stopped, no fine be levied. ROLL CALL: Mr. Widup - no Ms. Lanning - yes Mr. Dalessandro - yes Ms. Falco - yes Mr. Nagy - yes Ch. Garland - yes Motion carried 5 - 1. BUILDING OFFICIAL MATTERS: Mr. Eseltine spoke briefly regarding complaints coming before the Board were people not being able to get their deposits back which holds them hostage because they can't do anything if their deposits are not returned. BOARD MATTERS: Ch. Garland noted that the Board Secretary requested that all applications be reviewed prior to the meeting so that the meeting is not held up while applications are being reviewed.
