Chairman Dodd called the meeting to order at 2:00 p.m. with a pledge to the flag. 2. ROLL CALL: Present: Chairman Charles Ed Dodd Ronald Van Buskirk Howard Brauer David Johns Harry Enderlein Barbara Beck Clarence Balton Absent: Carl Anderson Excused: Steven Lincoln AisoPresent: Code Enforcement Officers City Attorney Interim Secretary Richard lachini Antoine Van Meir Warren Lindquist Rich Stringer Barbara Quinn, Records Supervisor 3. The minutes to the March 15, 2006 Code Enforcement Board meeting were approved as written on a motion by Howard Brauer, second by Ron VanBuskirk- voice vote: Ayes 7- Nays 0 4. Additions & Deletions- Item A- #2006-8704 and Item C- #2006-6049 are in compliance and will be removed from the agenda 5. NOTICED HEARINGS: B. VIOLA TION HEARING- CASE #2006-8704 MICHAEL CROWE-116 MILLER DRIVE · SECTION 30-29- CODE OF ORDINANCES OF THE CITY OF SEBASTIAN LICENSES: No person shall engage in any activities for which a license is required by this article · SECTION 54-2-4.5 LAND DEVELOPMENT CODE OF THE CITY OF SEBASTIAN No building or structure shall be erected, rL'Constructed or structurall)! altered, nor shall any building, land or water be used for any purpose other than a use permitted in the district in which such building, land or water is located Code En10rcement Meeting April 19, 2006 Page 2 01'3 Chairman Dodd swore in Code Enforcement Officer, Antoine VanMeir, who stated his credentials and the city's case- The City's suggestion is to find the owner in violation and that any future violation would hold a monetary fine City Attorney Stringer asked the Board members to disregard the petition distributed from the audience stating that this is a judicial hearing and petitions have no place at this meet mg. Michael Crowe was sworn in by Chairman Dodd and stated his case. He said that there was a thirty day extension given to him by Growth Management after the denial and that his permit tor the fence carne in on the last day of that extension. He stated he is in the process of leasing property to store his commercial equipment. He stated he is still using his computer to run his business out of his home and realizes that he needs a home occupational license to do that. David Johns asked the Board to table this issue until after the Planning & Zoning Commission makes their decision on the occupational license. A discussion followed on the time frame for repeat offender fines. Chairman Dodd asked for public comments. Mr. Stringer eXplained to the audience the Code Board will not determine if Mr. Crowe can have an occupational license or not, but only ifMr. Crowe was in violation of the City's ordinance after the March 13th date Three people were sworn in and testimony taken David Johns motioned to find Mr. Crowe in violation with 48 hrs to comply and a $250 per day fine until he comes into compliance. There was no second to this motion. MOTION made by Howard Brauer ref case #2006-8704, finding the respondent in violation of the SECTION 30-29 of the Code of Ordinances of the City ofSehastian, giving him until April 24, 2006 to corne into compliance with the code. CHAIRMAN'S MATTERS- None 8. MEMBER'S MA TIERS- None. 9. CODE OFFICER MATTERS: Oflicer Van Meir reported on the status of the two fines that are accruing: 573 Michael Street- $6000 still not in compliance Barna Subs- $3600 still not in compliance Code Enforcement Meeting April 19, 2006 Page 3 of 3 Otlicer Richard lachini reported on the two cases from last month a. Case #2005-33778, 333 Bayharbor Terrace has been cleaned up and is in compliance b. Case 2005-1570,602 Concha Drive- still has a vehicle in the yard. The owner promised to have it gone by this afternoon- Officer lachini will inspect the property this afternoon. 1 O. ATTORNEY MATTERS: Mr. Stringer stated that the Code Enforcement system that the State has designed has a lot of deficiencies- He explained the four deadlines that need to be missed prior to have fines assessed. He stated that the City is trying to find the best way to use the tools to address code enforcement issues. He commented that the State statutes cannot be modified. A discussion tollowed on what can be done to better define the procedural definitions for the Code Enforcement Officers. 11.
