AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, SCHEDULING AN
ELECTION TO SUBMIT A REFERENDUM ISSUE TO THE ELECTORATE IN
ORDER TO Al\fEND ARTICLE IV OF THE CITY CHARTER TO LIMIT THE
ABILITY OF CITY TO UTILIZE EMINENT DOMAIN FOR ECONOMIC
DEVELOPMENT PROJECTS; PROVIDING FOR THE MANNER IN WHICH SUCH
ELECTION SHALL BE CONDUCTED; ESTABLISHING THE FORM OF THE
BALLOT FOR SUCH ELECTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 166.031 of Florida Statutes provides that the governing body of a
municipality may submit to the electors of that municipality a proposed amendment to all or part
of its charter; and
WHEREAS, recent legal decisions uph91ding the use of eminent domain to acquire
property on behalf of private parties for'purposes of economic development have concerned the
citizens of Sebastian; and
WHEREAS, the City Council desires to submit an amendment to the City Charter on
this issue for ratification by the eleetors of the City of Sebastian, Indian River County, Florida.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
Section 1. That upon passage of the Referendum submitted hereunder, existing
Section 1.02 (11) of the City Charter of the City of Sebastian, Florida, shall be amended to add a
paragraph as follows:

The city shall not use the power of eminent domain for a project having the purpose
of transferring rights in the properties acquired to a private party in pursuit of
economic development.
Section 2. An election is hereby called and scheduled to be held on March 14,2006,
to determine whether the revisions to the City Charter of the City of Sebastian, Florida shall be
approved by a majority of the votes cast in such election by the qualified electors residing in the
City of Sebastian.
Section 3. The places of voting in such election shall be the usual places of voting in
the City of Sebastian, Florida, in the regular election as determined under the applicable
provisions of Florida law. All duly qualified electors residing within the City of Sebastian shall
be entitled to participate and vote in such election.
Section 4. The purpose of this election shall be to present a referendum issue to the
electors of the City of Sebastian of whether or not to adopt revisions to the City Charter. The
ballot question shall be substantially in the following form:

WHEREAS, pursuant to Section 4.05 of the City Charter, the Mayor issued a
Proclamation on December 14, 2005, calling for a general election in the City of Sebastian to
be held on March 14, 2006; and
WHEREAS, the City Council, pursuant to Section 4.07 of the City Charter, adopted
Resolution No. R-05-45 on December 14, 2005, specifying Precincts 103, 104, 105,106, 107,
109, 201, 203, and 204 as the official polling places for the City of Sebastian for the general
election, and naming the offices to be filled; and
WHEREAS, the City Council adopted Ordinance No. 0-05-19 on October 26, 2006,
which placed a referendum question on the ballot as follows: The city shall not use the power
of eminent domain for a project having the purpose of transferring rights in the properties
acquired to a private party in pursuit of economic development; and
WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.021 of the
Florida Statutes, published notice of the general election on December 23, 2005, and January
6, 2006 in the Vero Beach Press Journal, a newspaper of general circulation; and pursuant to
100.342 of the Florida Statutes, published notice of the referendum on February 10 and 24,
2006; and posted the Election Proclamation and notice of the general election on the official
announcement board located at City Hall; and
WHEREAS, at the close of qualifying on January 27, 2006, four candidates had
qualified for the two, two-year seats; and
WHEREAS, the City Canvassing Board, comprised of the City Clerk, City Attorney and
City Manager have canvassed the election results in accordance with the City Charter.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:
SECTION 1. DECLARATION. The City Council of the City of Sebastian, Indian River
County, Florida, hereby accepts the returns provided by the City Canvassing Board for the
general election, held on March 14,2006, in Precincts 103,104,105,106,107,109,201,203,
and 204, as attached hereto as Exhibit "A".
SECTION 2. RECORDING. The City Clerk is hereby directed to enter the results of
the Council election in the official minutes of the City Council meeting during which this
Resolution is adopted and to forward the Charter Amendment to the Department of State and
provide for its inclusion in the City Charter.
SECTION 3. CONFLICT. All resolutions or parts of resolutions in conflict herewith are
hereby repealed.
SECTION 4. EFFECTIVE DATE. This resolution shall take effect immediately upon its
passage.

The City Clerk swore in newly elected officials Sal Neglia and AI Paternoster and
each took their place at the dais.
Mr. Paternoster presented a photo to Mayor McCollum.
2. Election of Mavor
Mayor McCollum called for nominations for Mayor.
Mr. Neglia nominated Mayor McCollum.
Mr. Paternoster nominated Mayor McCollum.
Mayor McCollum was re-elected.
3. Election of Vice Mavor
Mayor McCollum called for nominations for Vice Mayor.
Mayor McColllum nominated Vice Mayor Burkeen, and being no other
nominations, Vice Mayor Burkeen was re-elected.

6. CLOSING REMARKS BY COUNCIL MEMBERS/STAFF
Mr. Paternoster and Mr. Neglia thanked God, their families and all their constituents for
their assistance with election to office. Mr. Paternoster introduced friends and his
former police captain who are visiting, and each vowed to live up to their campaign
promises to work to represent the people of Sebastian and move the City forward.
Irene Thompson was recognized for her contributions to their campaigns.
Mayor McCollum thanked everyone who participated in the election process and those
people who want to serve their communities.
Vice Mayor Burkeen said City residents are the benefactors of this election and the
Council will serve them very well.
Ms. Coy thanked the citizens of Sebastian, said she was proud of Sebastian and that
Council will do the right thing.
Mr. Paternoster recognized Richard Strange who helped him and Mr. Neglia campaign
every day.
Mayor McCollum handed out his recommended liaison appointment list for the March
22,2006 Regular Meeting.
The City Attorney recognized the City Clerk's handling of the election process.
7. Being no further business, Mayor adjourned the Special Meeting at 7:23 p.m.

Dear Mrs. Clem:
On behalf of the City of Sebastian, I want to express my gratitude for your administration of the
March 14, 2006 City of Sebastian General Election. I'm not sure what the municipalities would
do without your expertise and professionalism. Please convey my thanks to your staff and
Attorney Brian Connelly as well. You all make it look so easy. Knowing that the election laws I
am required to understand are a drop in the bucket compared to what you need to know, easy is
not a word to describe what you do.
For your information, City Council elected Nathan McCollum as Mayor and Brian Burkeen
as Vice-Mayor for one-year terms to March 2007.

2. OFFICERS/METHOD OF SELECTION; Section 106.144 (1) (b): The current officers of the
PBA and method of selection are as follows:

B. METHOD OF SELECTION: Nomination and selection of officers is governed by
Article IV of the PBA By-Laws. Candidates must be members of the PBA Board of Directors, in good
standing, who have filed a written form, thirty (30) days prior to the election date, signed by ten (10)
members in good standing. Fifteen (15) days prior to the election date, ballots are mailed to each PBA
member in good standing containing the names of all properly nominated candidates. Ballots are returned
by mail to the election trustees to who count all timely filed ballots and announce the results of the election.
3. SELECTION OF CANDIDATES TO ENDORSE/OPPOSE; Section 106.144 (1) (c): Article
VIII of the PBA By-Laws authorizes the screening and endorsement of political candidates. As an election
nears, a political screening committee is formed comprised of PBA members in good standing. Dates are
selected for interviews of each candidate for each office relevant to the association. Letters are mailed
inviting each candidate to be interviewed by the PBA Political Screening Committee. Any candidate
interested in participating in the screening process calls the PBA administrative assistant and confirms a
date and time for their interview. Each candidate is asked to respond to the same set of questions tailored
to the particular political seat. After interviews, the political screening committee meets, deliberates, and
chooses a candidate to endorse or concludes that no candidate should be endorsed.
4. SOURCE OF FUNDS FOR ADVERTISEMENTS/ENDORSEMENTS; Section 106.144 (1)
(d): The majority of the association's funds are generated from membership dues and a small proportion
comes from solicitation of donations by outside independent solicitors.
5. PAYMENT TO ORGANIZATION BY CANDIDATES; Section 106.144 (1) (e): None.
MUNICIPAL ELECTION 2006

The City of Sebastian General Election will take place on Tuesday, March
14, 2006 for two two-year City Council seats.
Sebastian Council consists of five members. Elections are conducted
annually for two seats in even-numbered years and for three seats in odd-
numbered years. Municipal elections are at-large and non-partisan.
Candidates who qualified for City Council seats are: Lisanne Monier,
Sal Neglia, Al Paternoster and Eugene Wolff.
In addition to the two Council seats, City Council has placed a referendum on the ballot by adoption of
Ordinance No. 0-05-19. The ballot question is:

Amending Section 1.02(11) concerning eminent domain power.
Shall the City of Sebastian amend the City Charter to add the following provision?
"The city shall not use the power of eminent domain for a project having the purpose of transferring rights in
the properties acquired to a private party in pursuit of economic development."

Enclosed please find the official ballot for the March 14,2006 General Election including four
candidates for two seats and one referendum question.
For your information, I have appointed City Manager, AI Minner as the third canvassing board
member. In accordance with the City Charter, the City Clerk and City Attorney are members as
well. Our City Charter has not changed since last year, but if you need a new copy please let
me know.
John has already called me about bringing machines for early voting on February 24th and
advised me he needs only a phone line with your new system. Please have him contact MIS
staff if he has any questions about our telephone system. I will be here to let the poll workers in
and store the machines at the end of each day during early voting.
The Special City Council meeting for receipt of certificate of canvassing board by resolution,
swearing-in of newly elected officials, and election of Mayor and Vice Mayor will take place on
Monday, March 20, 2006.

Enclosed please find the Proclamation calling the March 14, 2006 General Election, and Resolution
No. R-05-24, stating where the election will be held, naming offices to be filled, questions to be
decided, authorizing advertisement of the general election in accordance with Florida Law,
authorizing the Supervisor of Elections to administer the election, and authorizing payment for costs
incurred.
There have been no changes made to the City's Charter since last submitted to you.
The City Clerk and City Attorney are members of the Canvassing Board by Charter. City Manager,
AI Minner has agreed to be the third canvassing board member.
Our qualifying period is January 13, 2006 through January 27, 2006. I will fax you a list of names
for the ballot on Monday, January 30, 2006.
So far two candidates have pre-qualified, Sal Neglia and Alexander Paternoster.
As always, I look forward to working with you and your staff with early voting beginning February
27,2006 and for the general election on March 14,2006.

A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY,
FLORIDA, DESIGNATING THE OFFICIAL POLLING PLACES, OFFICES TO
BE FILLED AND QUESTIONS TO BE DECIDED DURING, AS WELL AS
AUTHORIZING PUBLICATION OF NOTICE AND DELEGATION OF
ADMINISTRATION FOR, THE GENERAL ELECTION TO BE HELD ON
MARCH 14, 2006; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS
OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Mayor has called, by proclamation, in accordance with Section 4.05 of
the Charter of the City of Sebastian, a General Election to be held within the City of Sebastian,
Indian River County, Florida on Tuesday, March 14, 2006; and
WHEREAS, Section 4.07 of the Charter of the City of Sebastian, Florida, requires the
City Council of the City of Sebastian to adopt a Resolution upon the calling of an election stating
where the election shall take place, naming the offices to be filled and questions to be decided;
and to cause notice of election to be published in accordance with Florida Law; and
WHEREAS, Section 2.03 of the Charter of the City of Sebastian, Florida, calls for the
election of two (2) council members for two year terms on the second Tuesday in March of each
even-numbered year; and
WHEREAS, City Council by adoption of Ordinance No. 0-05-45 on October 25, 2006,
has called for a referendum to be placed on the March 14, 2006 ballot.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA as follows:
Section 1.
POLLING PLACES. The March 14, 2006 City of Sebastian General
Election as set out by the Indian River County Supervisor of Elections shall be held at the

Section 4.
NOTICE.
The City Clerk is hereby directed to cause notice of this
election to be published in accordance with Florida Law.
Section 5.
DELEGATION. City Council hereby requests that the Indian River
County Supervisor of Elections administer said election, and hereby delegates the conduct of
such election to said officer and further authorizes payment to the Supervisor of Elections to
reimburse the costs thereof.
Section 6.
REPEAL. All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed.
Section 7. EFFECTIVE DATE. This Resolution shall take effective immediately
upon its adoption.

SUMMARY STATEMENT
Provisions of the City Charter require specific actions of the Mayor and City Council in regard to the
general election conducted each year in the City of Sebastian.
Charter Section 4.05 requires the Mayor to call the election by proclamation. Charter Section 4.07
requires City Council to adopt a resolution stating where the election will be held, offices to be filled and
questions to be decided. Section 4.07 also provides for the City Council to authorize the City Clerk to
advertise the election in accordance with Florida Law.
Florida Statutes 100.021 requires advertisement twice in the thirty-day period prior to qualifying. By
Charter Section 4.02, the City's qualifying period runs from January 13, 2006 through January 27,2006
(no more than 60 nor less than 45 days prior to the election).
The resolution also contains a provision authorizing the Supervisor of Elections to administer the
election and approves payment for costs incurred.

WHEREAS, Section 4.05 of the Charter of the City of Sebastian,
Indian River County, Florida requires that all elections shall be called by
a proclamation of the Mayor issued not less than thirty (30) days before
such election; and
WHEREAS, Section 2.03(a) of the Charter of the City of Sebastian
states that there shall be held a general election of two (2) council
members on the second Tuesday in March of each even-numbered year
and of three (3) council members in each odd-numbered year.
NOW, THEREFORE, I, Nathan B. McCollum, Mayor of the City

SUMMARY STATEMENT
In planning for the Candidate Handbook for the March 14, 2006 election, the question of early
voting came up. There were some minor changes to early voting laws this year (see 101.657
attached). Many municipalities around the state are choosing not to conduct early voting.
FS 101.657(e) states "municipalities may provide early voting in municipal elections that are not
held in conjunction with county or state elections. If a municipality provides early voting, it may
designate as many sites as necessary and shall conduct its activities in accordance with the
provisions of paragraphs a-c (which are procedural and time requirements) The Supervisor is
not required to conduct early voting if it is provided pursuant to this subsection. "
I had a discussion with Supervisor of Elections, Kay Clem and the City Attorney today relative to
early voting. I asked Kay how she determines our election costs and whether early voting
increases the cost. She informed me that our current rate of $2 per registered voter is based on
overall costs and would not change whether or not we had early voting. She said that actually
absentee voting provision changes had driven up costs rather than early voting.
Kay also told me other counties do not conduct elections like we do, that some City Clerks in
larger counties have to provide for administration for early voting, however in Indian River
County, she administers the elections with the agreement of the municipalities and her
philosophy on early voting is that it provides a benefit to voters and is a good thing.
In reading the new provision relative to municipalities, the City Attorney opined that rather than
opting out of early voting, as some municipalities are doing, municipalities should be opting IN if
they choose to conduct early voting since nothing in the statutes requires cities to have it if their
elections are not in conjunction with county or state elections.
Kay and Rich agreed that if we choose early voting for March it will be included in our resolution
which includes authority for the Supervisor of Elections to administer the election, scheduled to
come before you on December 14th.
The Supervisor of Elections provided early voting at Sebastian City Hall for primary and
presidential elections last year and for municipal elections this year. State statutes provide that
if she is conducting early voting it be conducted in a permanent branch office, or in a city hall or
permanent library facility in the county. She would like to use our facility again for early voting
in 2006. Again, this would be whether or not we choose early voting as long as other
municipalities in Indian River County choose it.
Now that I know our election costs are not affected by whether or not we have early voting, and
since I agree that early voting provides voters a benefit, I suggest we elect to conduct early
voting.
One of the other issues we discussed was the possibility of changing elections to November. I
was thinking that it would be easier for everyone if we had our elections in November. She said
she would agree to us changing our elections (which can be done by ordinance and does not
require a referendum), but her feeling was that since municipal seats and issues would always
appear last on the ballot they would get lost in the large numbers of candidates for other offices
and possible large numbers of initiatives.
The City Attorney and City Manager said they could see it both ways and wondered if perhaps
people who would not typically come out for a City election in March, might vote on City issues if
they were on a November ballot.
Perhaps though it does not require a charter amendment, the Charter Review Advisory Board
can discuss it when they reconvene in April 2006, and give a recommendation to Council.
RECOMMENDATION
Make a decision whether or not to conduct early voting for the March general election. Should
City Council decide to go ahead with early voting, we will include authorization for the
Supervisor of Elections to administer early voting for us in the election resolution.
Approve use of the City Council Conference Room in City Hall for early voting from February 27,
2006 through March 11, 2006. (new legislation changed the ending date to the ~d day prior to
the election, which is Sunday, but according to Kay, we would end on Saturday).

The Roads and N. aintenance Division of the Public Works Department is nearing completion of repairs on Indian Rivet
Drive. The total sCOJ e of work included the removal of debris, filling and stabilizing washed out banks, repairing the sidewalks
and street lighting.

The Indian River Drive shoreline repair has been
done with the cooperation of the Federal Emergency
Managl:lment Agency (FEMA). The City was able to
mitigate and stabilize the banks by using the same
metnod used in the Riverview Park Area. This method
includes mling with soil, covering with a soil stabilization
material and then the placement of various size rocks
on top of the material. This method has been proved
to work against hurricane force winds and seas.

City Council 2005/2006
The March 8, 2005 Municipal Election resulted in a change on the Sebastian City
Council. Incumbent Mayor Nathan McCollum returned to City Council for a second
two-year term. Newcomers Brian Burkeen and Andrea Coy were each elected to
two-year terms. Sal Neglia was elected to the one-year seat that was vacated by
former Council member Mike Hepinstall.

Following the swearing-in ceremony On March 14th, City Council selected Nathan
McCoUum as Mayor and Brian Burkeen as Vice-Mayor for one-year terms to March
2006. The fifth member of Council is Lisanne Monier, who was elected in 2004.
City elections are conducted annually on the second Tuesday in March. Two seats
are filled in even-numbered years and three seats are filled in odd-numbered years.
City Council terms are two years and elections are at-large and non-partisan.
The next City election for three City Council seats will be held on Tuesday, March
1, 2006.
