Other Officials Present:

Other Elections staff were also present.
The meeting was called to order at 8:00 a.m. and Supervisor of Elections staff provided seven
provisional ballots for Sebastian. They also provided a copy of the Ballot Balance Sheet dated 3/15/06
(see attached), a Report on Conduct of Election Questionnaire to fill out a for the State Division of
Elections (see copy of completed form attached), and Provisional Ballots - Guidelines for Counting/Not
Counting Ballots (see attached).
On motion by Mr. Stringer, and second by Mr. Minner, the March 14,2006, Canvassing Board Minutes
were approved on a voice vote of 3-0.
The Canvassing Board reviewed the seven provisional ballots and accepted six and rejected one due
to the fact that the voter was from precinct 101 which is not a City precinct,
Following canvass of provisional ballots, the boards moved to the counting room for the final count of
election results including provisional ballots. Final results were counted, printed and signed off by the
Canvassing Board.
Two members of the Canvassing Board returned to the counting room to begin the certification process
for the official results and once the ballot box was sealed the third member (Stringer) returned and all
three certified two original Certificate of Canvassing Board Official Returns (see attached).
The Supervisor of Elections provided the Canvassing Board with copies of the final results by precinct.
At 8:45 a.m. the Sebastian Canvassing Board meeting adjourned.

Other Elections staff and representatives of Sequoia were also present.
The meeting was called to order at 2:00 p.m. and the Indian River County Supervisor of Elections
reviewed the schedule, explained absentee ballot opening procedures and ballot duplications if
necessary. She announced that there had been 83 absentee ballot requests and 43 absentee ballots
returned for Sebastian and none were questionable.
On motion by Mr. Stringer, and second by Ms. Maio the February 22, 2006 Canvassing Board Minutes
were approved on a voice vote of 3-0.
Absentee ballots were opened and processed but not counted at this time.
The Canvassing Board meeting recessed at 2:40 p.m., members returned at 5:30 p.m. for dinner, and
then reconvened the Canvassing Board meeting at 6:15 p.m.
Following canvass of remaining absentee ballots, the boards moved to the counting room for the
Election Day Public Tests of the equipment, which were successful. (see all signed tests attached)
At 8:30 p.m. the City Canvassing Board was called to the conference room for an issue with
precinct 106, whereby poll workers had counted 296 signatures and 298 votes. The Supervisor
of Elections and Attorney Brian Connelly counted the votes and found the vote to be 298, and the
Sebastian Canvassing Board assisted them and SOE staff in counting the signatures of voters
twice and found the number of signatures of voters to be 297, which left a discrepancy of one
vote with no signature.
At 8:45 p.m. the Sebastian Canvassing Board was notified that there were seven provisional ballots
for Sebastian.
Public tests of the machines were once again conducted and successful (see all signed tests and
certification)

It was noted that canvassing of official results would take place on Monday, March 22, 2006 at 8:00
a.m. due to the provisional ballot law.
An unofficial voting certificate was completed (see attached) and being no further business, the Board
adjourned at 9:20 p.m.

The undersigned members of the City of Sebastian Canvassing Board do hereby
certify that on March 14, 2006 at L, :yO p.m., the automatic tabulation equipment to
be used in counting the election systems ballots was tested to ascertain that the
equipment will correctly count the votes cast for all offices and all measures on the
ballot. The test was conducted by processing a pre-audited group of ballots so marked
as to record a predetermined number of valid votes for each candidate.
We further certify that after the test was completed, the testing materials
and programs were sealed in a transfer case with Seal # DOotof.o q(p

The undersigned members of the City of Sebastian Canvassing Board do hereby

Representatives of Sequoia were also present.
The Chairperson called the Sebastian Canvassing Board meeting to order at 2:30 p.m.
The March 8, 2005 Canvassing Board minutes were approved on motion by Ms. Maio, and
second by Mr. Stringer with a voice vote of 3-0.
Canvassing board members and Supervisor of Elections staff met in the Supervisor's
conference room for a power point presentation (see printout attached) regarding canvassing
laws.
At this time, the Sebastian Canvassing Board accepted "Criteria to be Used in Reviewing
Absentee Results" (see executed copy attached). An outline for the Pre-Election Public Test
and copy of the legal ad for canvassing board meetings were handed out (see attached).
Canvassing Boards were advised that results could not be finally certified until after 5 pm on
March 17th due to new law related to provisional ballots. The Sebastian Canvassing Board
agreed to meet on Monday, March 20, 2006 in the Supervisor of Elections Office for final
certification.
The group then moved to the voting equipment room to view the public test of the voting
equipment and when that was completed to the tabulating room for certification of test results.
The Sebastian Canvassing Board had to leave at 4:45 p.m. prior to the completion of tabulation
to attend a Special City Council meeting, therefore, they designated Kay Clem, Supervisor of
Elections, in accordance with Florida Law, to act on their behalf to certify the pre-election test,
which is sent to the State of Florida.

all of the voting system input, output,

How do we test?
. We randomly select touchscreen machines to test and
Optical scan paper(absentee) ballots are also tested
. Paper ballots are premarked to get a predetermined
total. The candidate In first position gets one, second
position - two votes, etc. One ballot is Overvoted to
make sure the tabulating system is rejecting the vote
. One paper ballot Is Undervoted and one Is overvoted to
test the tabulating equipment Is sorting It out for the
Canvassing Board to look at It to make voter Intent
decisions.
Testing, cont.
· The machine tests itself through a process
called a "Vote Simulation". A cartridge is
programmed (a "vote sim" script) to vote
each race just as in the procedure we
described for the paper absentee ballot.
· Each touchscreen machine is also manually
voted for the first selection of each race.
The manual vote goes to the candidate in
the last position.
Undervotes/Overvotes
· You cannot overvote on a touchscreen
· You can undervote - that is the voter's
choice
· If you undervote on a touchscreen
there is no question what your "intent"
was - the vote is clearly indicated
unlike a paper ballot

Provisional Ballot Testing
. Provisional Ballots are cast on the touchscreen
(new)
. When they are cast they are held in the machines
without being counted until we manually tell the
tabulation system to count the ballot (identifed by a
number) or to reject the ballot
. We manually enter a provisional ballot during
testing to make sure the tabulating equipment holds
the ballot and then lets us enter tne command to
reject or accept the ballot.
. The provisional vote is given to the first position
candidate.
Testing the tabulation
. After running the vote sim script and
manually voting the touchscreens we close
the polls on the machines and run the totals
on them. We receive a paper print-out of
the totals.
. We also make a copy of the cartridge (audit
trail cartridge). We will keep the copy to use
for our public test of the equipment
immediately prior to starting to count ballots
on election night. The original cartridge will
go out in the machine to the polling place
(or early voting site).
Tallying the vote
. Since we know how we voted all the ballots we know what the
results will be when we tabulate the vote
. We open the tabulation system and run a zero proof report to
show the system Is set to zero. Canvassing Board members
Initial this report.
. We tally all the votes from the touch screen cartridges
. We tally all the votes from the paper ballots (absentee) using a
400-C machine In the tabulation room. And add them to the
touch screen machine votes.
. A report Is printed and all Canvassing Board members verify
the predetermined results.

Reporting
. We send a copy of all the programming and election
parameters on the tabulation system to the Department of
State after we test the equipment.
. They hold a copy to make sure nothing has been tampered
with should there be a question about the election.

. Canvassing Board reviews the number of absentee ballot
requests and compares to the number of ballots we have to
make sure we don't have more than were requested
. Absentee Ballot Envelopes which have been separated out as
having no "problems' are opened by staff using a machine In
front of the Canvassing Board
. Envelopes are separated from the ballot which Is enclosed in a
"Secrecy Envelope."
. Ballots are then separated from the "Secrec:tj Envelope" by
another team of election help so that the ba lot Is not
associated with the voter's name on the outside of the ballot.

Canvassing First Time Voters Absentees
. Certain voters who registered to vote by mall and are first-time

refiect information about voters allowed to vote a provisional
ballot on the touchscreen

The Municipal Canvassing Boards will meet at
2:00 p.m. on March 14, 2006 in the Office of the
Supervisor of Elections. Absentee ballots will be
, opened and processed; however, not tabulated.
The Boards will reconvene at 6:15 p.m. to canvass
the balance of the absentee ballots. A Public Test
will be conducted immediately following the can-
vass of absentee ballots., The Canvassing Boards

February 22, 2006
Preparation
1. Supplies: one Transfer case, one Transfer case seal, two blank CD-Rs, pens, oath forms, Absentee / Provisional Test Deck,
and information packets (including this information sheet).
2. Determine the number of Edge units and Card Activators.
3. Create Results cartridges, Simulation cartridges, and Audit Trail cartridges for election.
4. Get Voter Activation Cards and Seals for Edge units.
5. BootJLogin Tabulation computers. Start tabulation mode in WinEDS.
6. Initialize network printer.
Stage 1: Ave Edge Voting Unit Pre-LAT
1. Verify display of correct date and time on the screen.
2. Calibrate the screen (Calibration Report will print automatically).
3. Insert a results cartridge to load the ballot.
4. Open the polls to Pre-LAT mode (Zero Report will print automatically).
5. Perform the vote simulation script process.
6. Manually vote one ballot by giving a vote to the last candidate(s) in each race (Select 2 or 3 respectively in vote for multiple).
Manually vote one provisional ballot giving the vote to the first position candidate.
7. Close the polls (Vote Totals Report will print automatically).
8. Enter the Pre-LAT diagnostics mode.
9. Perform the Audit Trail transfer process.
10. Remove the printout.
11. Power down the unit.
12. Turn on unit - verify that screen displays "Ready to open official election."
13. Power down the unit.
14. Seal the Polls Open/Close cover.
15. Seal the cartridge door.
16. Record the seal numbers on Record of Edge Serial Numbers / Seal Numbers report.
17. Clean and lower the screen.
Stage 2: Touch Screen Tabulation
1. Print the Zero Summary (3 Column) Report (Canvassing Board to proof and sign).
2. Read the ten (10) Audit Trail cartridges into WinEDS.
3. Check the cartridge processing to ensure results processing.
4. Print the Summary (3 Column) Report (Canvassing Board to proof and sign).
Stage 3: Read Paper Ballots on 400-C
1. Reset all results on both 400-C units.
2. Read test deck for Absentee & save results to disk.
3. Read Absentee ballot results into WinEDS.
Stage 4: Reporting
1. Backup the database and Election files to CD (1 copy to send to the state, 1 copy to retain locally).
2. Place the test ballots, proofmg materials, signed reports, and one backup CD into the transfer case.
3. Canvassing Board then records the seal number and signs the oath form then the transfer case is sealed.
4. Send the other backup CD to the Florida Division of Elections.

Dear Ms. Clark:
This is in response to your request for an advisory opinion regarding the number of canvassing board
members that are required to be present to take various actions under the Florida Election Code. You are
the Supervisor of Elections for Pinellas County and by law a member of your county canvassing board.
Pursuant to section 106.23(2), Florida Statutes, the Division of Elections has authority to issue an opinion
to you.
You have essentially asked how many canvassing board members are required to be present during or are
necessary to take the following official actions of the county canvassing board:
1. Public Testing of Absentee Ballot Tabulation Equipment;
2. Canvassing Absentee Ballots (Opening and Processing);
3. Election Night Tabulation (Ballot Duplication);
4. Canvassing of Provisional Ballots (Accept or Reject); and
5. Certifying Official Election Results?
Section 102.141, Florida Statutes, specifies who shall constitute the members of the county canvassing
board and outlines the duties of the board. While the statute is specific as to the three persons who shall
serve as canvassing board members, i.e., the county supervisor of elections, a county judge and the chair
of the board of county commissioners, it is silent with regard to the actual number of members of the
board that must be present to conduct the official business of the board. However, the Attorney General
has previously opined in AGO 050-248 that a canvassing board may act in an official capacity when a
majority of the members are present. Therefore, unless othelWise specified in statute or rule, the
canvassing board may act when two members of the board are present, thereby constituting a majority,

as long as the two members present are in agreement as to the action to be taken. If they are not in
agreement, then a majority of the board has not approved the action.
Let us now take these principles and apply them to the specific canvassing board actions about which
you mqurre.
The public testing of voting equipment is governed by section 101.5612, Florida Statutes. As you note
in your inquiry, section 101.5612(2), Florida Statutes, specifically provides, "For the test, the canvassing
board may desighate one member to represent it." However, that same section also requires that the
canvassing board shall convene and that each member of the canvassing board shall certify to the
accuracy of the test. Therefore, for any public testing conducted pursuant to section 101.5612, Florida
Statutes, including the testing of absentee ballot tabulators, the canvassing board may designate one
member to be present, i.e. represent it, at the actual testing, but all members of the canvassing board
must certify to the accuracy of the test.
The canvassing of absentee ballots, i.e., the opening and processing of absentee ballots, is governed by
sections 101.68, 101.6925 and 102.141(2), Florida Statutes. There being no specific provision contained
therein to the contrary, the board action of approving and ordering the opening and processing of the
absentee ballots requires that a majority of the members of the canvassing board be present. Once
approved and ordered, the clerical work of actually opening the absentee ballots and running them
through the tabulators may be done with at least one member of the canvassing board present at all times
pursuant to section 102.141(7), Florida Statutes.
Election night ballot duplication is governed by sections 101.5614(5) and 101.68, Florida Statutes.
There being no specific provision contained therein to the contrary, this board action requires that a
majority of the members of the canvassing board be present to approve the duplicate ballots. Again, the
clerical activity of creating the duplicate ballot for approval by the canvassing board may be done with
only one member of the canvassing board present pursuant to section 102.141 (7), Florida Statutes.
The canvassing of provisional ballots, i.e., determining whether to accept or reject, is governed by
sections 101.048, 101.049, 101.6925 and 102.141(2), Florida Statutes. There being no specific
provision contained therein to the contrary, this board action requires that a majority of the members of
the canvassing board be present.
The certification of the official election results by the canvassing board is governed by section 102.151,
Florida Statutes. There being no specific provision contained therein to the contrary, this board action
requires only a majority of the members of the canvassing board. Therefore, the certificate can be
signed by just two canvassing board members.
You also ask if the answers to these questions would be the same for a municipal canvassing board if the
municipality has adopted the Florida Election Code and there are no municipal charter provisions or
ordinances that specifically address these municipal canvassing board actions. The answer to this
question is yes.

SUMMARY
A canvassing board may act in an official capacity when a majority of the members are present, unless
otherwise specified in statute or rule. Therefore, generally the canvassing board may act when two
members of the board are present, thereby constituting a majority, as long as the two members present
are in agreement as to the action to be taken. If they are not in agreement, then a majority of the board
has not approved the action. However, for any public testing conducted pursuant to section 101.5612,
Florida Statutes, the canvassing board may designate one member to be present, i.e. represent it, at the
actual testing, but all members of the canvassing board must certify to the accuracy of the test.
Additionally, once a majority of the canvassing board members has approved and ordered the opening
and processing of absentee ballots, the clerical work of actually opening the absentee ballots and running
them through the tabulators may be done with at least one member of the canvassing board present at all
times. Finally, the certification of the official election results by the canvassing board can be signed by
just two members of the canvassing board. These answers would also apply to a municipal canvassing
board if the municipality has adopted the Florida Election Code and there are no municipal charter
provisions or ordinances that specifically address e municipal canvassing board actions.
