SEBASTIAN CONSTRUCTION BOAftB W": v REGULAR MEETING MAY 9. 2006 -7:00 P.M. Meeting was called to order at 7:00 P.M. by Chairman Garland. The Pledge of Allegiance was led by Chairman Garland. ROLL CALL: Present: Ch. Garland V.C. Morris Mrs. Carbano Mr. Conover Ms. Lanning Mr. Widup Ms. Dalessandro Ms. Falco Absent: Mr. Nagy - excused Also Present: Wayne Eseltine, Building Director/Official Rich Stringer, City Attorney APPROVAL OF MINUTES: Regular Meeting held 3/14/06; 4/11/06. MOTION: Morris/Garland I make a motion we approve the minutes of meeting held 3/14/06 as written. A voice vote was taken - passes unanimously. MOTION: Carbano/Lanning I make a motion we approve the minutes of meeting held 4/11/06 as written. A voice vote was taken - passes unanimously. OLD BUSINESS: None NEW BUSINESS: Thomson * Prometric Exam: (Replaces Experior) Shimmin, Marcus/Aluminum Construction Mr. Shimmin was sworn in by Ch. Garland. MOTION: Lanning/Garland I make a motion we approve Mr. Shimmin to take the Aluminum Construction Exam. ROLL CALL: Mrs. Carbano - yes Mr. Conover - yes Ms. Lanning - yes Mr. Widup - yes Mr. Dalessandro - yes Ch. Garland - yes V.C. Morris - yes Motion carried 7 - O. Tucker, Shawn E./ Aluminum Construction Mr. Tucker was sworn in by Ch. Garland. Mr. Tucker told the Board that he worked as a sub-contractor for Mr. Higdon, John Scott Higdon, Inc.. Mrs. Carbano noted that the verification showed him as an employee. Again, Mr. Tucker said he worked as a sub-contractor not as an employee and that he had his own W/C Exemption. V.C. Morris said that he was admitting that he was working as an unlicensed sub-contractor. MOTION: Garland/Morris I make a motion the Mr. Tucker re-do his package to show proper procedure for applying and come back at a later date. Sullivan Jr., Michael/Concrete Mr. Sullivan was sworn in by Ch. Garland. MOTION: Carbano/Garland I make a motion we approve Mr. Michael Sullivan Jr. to take the test for concrete. ROLL CALL: Ms. Lanning - yes Mr. Widup - no Mr. Dalessandro - yes Ch. Garland - yes Motion carried 5 - 2. Hudmon, Kevin C./lrrigation Mr. Hudmon was sworn in by Ch. Garland. MOTION: Morris/Garland V.C. Morris - no Mrs. Carbano - yes Mr. Conover - yes I make a motion that Kevin Hudmon take the exam for Irrigation Specialty Contractor. Painting Mrs. Carbano - yes Mr. Conover - yes Ms. Lanning - yes Mr. Villamizar was sworn in by Ch. Garland. (A translator was with Mr. Villamizar) MOTION: Dalessandro/Carbano I make a motion that we allow Mr. Villamizar to take the Limited Painting test. ROLL CALL: Mr. Dalessandro - yes Ch. Surface Coating (stucco) Mr. Wilson was sworn in by Ch. Garland. MOTION: Morris/Garland I make a motion we approve Mr. Wilson to take the Stucco Exam. ROLL CALL: Ch. Garland - yes V.C. Goodridge, Derek/Tile & Marble Mr. Goodridge was not present at the meeting: The Board took a 5 minute recess at 7:30 P.M. Meeting reopened at 7:37 P.M. VIOLATION HEARINGS: Stephen Lundy, Lundy's Low Cost Screen Rooms 927 Canal Circle - 26-172( 1), Willful and Deliberate Disregard of the Applicable Building Codes of the City. Mr. Lundy was sworn in by Ch. Garland. Mr. Lundy told the Board that at the time the work was done he did not think he needed a permit. No inspections have been done since the permit was applied for 5/8/06. V.c. Morris asked the Board Secretary if Mr. Lundy had ever been before the Board before. She said 3 other hearings had been brought before the Board. They were found guilty and fined. The Board Secretary also noted that the company information in the computer and the information on the "proposal" were different. Different company names as well as different business locations, but they were both under the same license number. He said he would come into the Building Department to rectify the problem. Mrs. Minker, homeowner, was sworn in by Ch. Garland. She told the Board she did not trust Mr. Lundy and did not want him on her property. All she wanted was her money refunded. MOTION: Lanning/Morris I make a motion we assign the maximum fine of $500.00 for the willful and deliberate disregard ofthe applicable building codes of the city and suspend your license for one year and any of the building permits you have pulled that you are not licensed for, if you rectify the licensing problem within 5 working days, you will be able to complete those permits. ROLL CALL: V.C. Morris - yes Mrs. Carbano - yes Mr. Conover - yes Ms. Lanning - yes Mr. Dalessandro - yes Ch. Garland - yes V.C. Morris - no Motion carried 6 - 1. James Richter, Classic Aluminum Fabrication, Inc. 1477 Bevan Dr. - 26-172(1), Willful and deliberate disregard ofthe applicable building Codes of the City. J ames Richter and Ed Piper were sworn in by Ch. Garland. It was noted that James Richter was the license holder and Ed Piper was a business partner. V.C. Morris asked ifMr. Richter's license was up to date. The Board Secretary said it was currently on hold because the insurance was not up to date. Mrs. Sharlene Frame was present at the meeting. Ch. Garland swore her in. Mr. Eseltine, when asked, said there was no permit for this job. MOTION: Garland/Conover I make a motion that we fine Classic Aluminum Fabrication $500.00 for 26-172(1), willful and deliberate disregard of the applicable building codes of the city. ROLL CALL: Mrs. Carbano - yes Mr. Conover - yes Ms. Lanning - yes Mr. Widup - yes Mr. Dalessandro - yes Ch. Garland - yes V.C. Morris - no Motion carried 6 - 1. 3602 W. Derry Dr. - 26-172(1), Willful and deliberate disregard of the applicable building codes of the city. Mr. Eseltine said there was a permit for vinyl siding, but at the request of the owner, he did an inspection and found that a Florida Room was being done under the vinyl siding permit. The work was very sub-standard and a lot of property damage was done by the contractor. All the work was poorly done. MOTION: Morris/Carbano I make a motion based on the matter of James Richter, 3602 W. Derry Dr., Sec. 26- 172(1), willful and deliberate disregard of the applicable building codes of the city that there be a maximum fine of $500.00 and be on a 6 month probation period and the Board to consider that if the individual comes before the Board again that his license be immediately suspended. ROLL CALL: Mr. Conover - yes Ms. Lanning - yes Mr. Widup - yes Mr. Dalessandro - yes Ch. Garland - yes V.C. Morris yes Mrs. Carbano - yes Motion carried 7 - O. Raymond S. Hurley, Hurley Builders & Developers, Inc. 626 Layport Dr. - 26-172(5), Diversion of Funds 26-172( 1 0), Abandonment of a Construction Project Raymond Hurley and Bruce Hurley were sworn in by Ch. Garland. William and Mary Jane Ingui, homeowners, were sworn in by Ch. Garland. Mr. Ingui gave a rundown of the events that transpired with Hurley Builders. He told the Board that he did send a registered letter requesting a refund. There was no response. It was noted that there was no permit pulled. Mr. Ingui said that a deposit of $4,297.66 was given to the builder. Ch. Garland asked Detective Steve Marcinik, Sebastian Police Department, to come to the podium. It was noted that a list of names who made complaints to the P.D. was given to the Board by Det. Marcinik. Ch. Garland asked if all of the names on the list were valid complaints. The answer was yes, but it was noted that a few of the people did have their money refunded. Both Mr. Hurleys were asked to come back up to the podium. Attorney Stringer asked them both questions. MOTION: Morris/Lanning I make a motion we impose the maximum fine of $500.00 on 26-172(5), diversion of funds and $500.00 on 26-172(10), abandonment of a construction project and put their license on probation for 1 year and that until this matter, specifically this case is resolved, that no additional permits be issued. ROLL CALL: Ms. Lanning - yes Mr. Chidup - yes Mr. Dalessandro - yes Ch. Garland - yes V.C. Morris - yes Mrs. Carbano - yes Mr. Conover - yes Motion carried 7 - O. RE-HEARING: Raymond S. Hurley, Hurley Builders & Developers, Inc. 1391 Whitmore Street 113 Joyhaven Dr. 1162 Croquet Lane 805 Holden Court 749 Wentworth Street 1-- All addresses listed are in violation of: 26-172(5), Diversion of Funds 26-172(10), Abandonment of a Construction Project. MOTION: Garland/Morris I make a motion the re-hearing be closed and that the original fines and the privileges to operate in the City of Sebastian be suspended indefinitely with the modification that all outstanding permits be completed and no other permits will be issued under any circumstances until the City has received all of its' fines and all ofthe people signing the complaints have been satisfied. BUILDING OFFICIAL MATTERS: Mr. Eseltine asked that Eunice Daniel of3602 W. Derry Dr. be allowed to speak to the Board. She was one of the violation hearings for Classic Aluminum Fabrication, Inc. At the time of the hearing she was not given a chance to talk as owner of the property. Mrs. Daniel was sworn in by Ch. Garland. Mrs. Daniel said that since the job was started she had the worst mess, that her house was the worst looking house on the street. She brought pictures with her that were put on the overhead screen so that everyone could see them. Mr. Eseltine noted that a lot of property damage was done. BOARD MATTERS: None. ATTORNEY MATTERS: Ch. Garland asked if there was a time limit in paying the fines. Mr. Stringer said no. RECORD SCORES IN SCOREBOOK: Conover/Dalessandro 15 MINUTES TO PUBLIC: Mr. John Simmons spoke to the Board. He was sworn in by Ch. Garland. Mr. Simmons said that he had a contract with Hurley Builders. He said his name was on the list Det. Marcinik had on complaints being filed with the P.D.. He was told to stop by the Building Department to fill out a City complaint form and he would also be given a form for the State. There being no further business, meeting adjourned at 9: 15 P.M. I
