Home My WebLink AboutCHAPTER #169 Y:-- r "'lr;o- e ----^~ e ORDINANCE NO. \lo~ AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, PROVIDING FOR REGULA:I'ION OF HOUSE TR.AlLER, OR ANY TRAILER EQUIPPED OR OCCUPIED FOR SLEEPING, HOUSEKEEPING OR LIVING QUARTERS WITHIN THE CITY OF SEBASTIAN AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF: AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE PEOPLE OF THE CITY OF SEBASTIAN, FLORID Section 1. PARKING, ETC., OF TRAILERS SUBJl]tCT TO ARTICLE. No owner of property within the corporate limits of the city shall permit the parking, maintaining o-r keeping :wilpon his property and no person shall park, maintain or keep any houAe~trai1ers, which house-trailer shall be occupied or used for sleeping, housekeeping or living cparters except as provided by this article. Section 2. ARTICLE NOT TO APPLY TO TRAILER. PARKS. (1) The provisions of this article shall not apply to house -trailers kept and maintained in trailer parks which are duly licensed by the City, such license being in full force and effect. (2.) The provisions of this article shall not apply to trailers of any makes or types which were not designed primarily to act as portable living quarters Section 3. SLEEPING, ETC., IN HOUSE-TRAILERS PARKED IN PUBLIC PLACES PROHIBITED. No House ..trailer parked upon any public street, park or other public pr:IDpI!:1:'tyLwithin the corporate limits of the City shall be used for sleeping, housekeeping or living quarters while so parked. Section 4. REQUIRED APPLICA'II ON: PERMIT The owner of the property upon which a house -trailer is to be parked shall apply to the City Clerk for a permit to do so. Such parking shall be per- mitted only on and after the approval of such permit. The application shall be in such form as shall be re~red by the City Clerk and shall specifically designate, by legal description, the property upon which such house-trailer is to be parked. . Section 5. POWER OF CITY CLERK TO GRANT OR DENY PERMIT The City Clerk shall have the sole power to grant or deny applications for a permit subject to review by the City Council, wl)o will eithe r affirm or reverse the City Clerk's action by a majority vote of those members of the City Council present at the meeting when an appeal is taken. Notice of appeal shall be made one week prior to a meeting of he city council to review the City Clerk's action. The Clerk shall be governed in his discretio by the applicable provisions of this ordinance and also by the intent of this ordinance, which is to protect the health and sanitation of the inhabitants of d the City of Sebastian. The City Council shall have the power, from time to time to direct the City Clerk concerning the Clerk's discretionary powers.. Section 6. PERMIT- ISSUANCE: DURATION: RENEWAL: DISPLAY DESCRIPTION: LOGATION. If the application specified in the preceding sections may be granted under the provisions of this article and of all other applicable ordinances of the City, it shall be granted and issued by the City Clerk. The permit can be renewed only once for a ninety day period. An addi.tional ninety day period for such renewal need not be continuous to the original ninety day period but such renewal must take place' within three years from date of original permit and only one renewal within any three year period. The original permit, if and when isaued, must be kept promi- nently displayed within the trailer, for which such permit is issued and shall contain a description of such house-trailer and the location of the property upon which the same is permitted to be parked. Section 7. SAME- FEE A charge of two dollars ($2..00) shall be made for the issuance of each permi Such amount shall be deposited with the application for such permit and shall be returned to the applicant in the event such permit shall not be granted. Section 8. SAME--ADJACEN:T, ETl;., PROPERTY OWNER'S CONSENT REQUIRED. No permit shall be issued for the parking of any ho-use-trailer at any location w ithin the City unless the applicant for auch permit shall file with such application, consent, in writing, to the granting of such permit, signed by the owners of all residences situated upon the property immediately adjacent to the location described in such application, or if no residence buildings are situated upon the immediately adjacent property, then the consent in writing, of the owner of the residence nearest the location described in such application. Section 9. SAME-- NOT TO BE ISSUED IF NUISANCE, :FlRE HAZARD ETC., WOULD RESULT. J No permit shall be isaued or per permitted to remain in effect when such action would result in the maintenance of a nUisance or of a fire hazard or of a sanitary hazard or of a condition endangering life or property. Sectinn 10. SAME --NOT TO BE ISSUED UNTIL SEWER, ETC., FACILITIES ARE PROVIDED. .. , No permit for the parking of any house-trailer shall be isaued :under the provisions of this article unless a connection with a sanitary sewer or approved septic tank shall be available, authorized and fully connected with the approval of the City Building Official and City Health Officer within twenty-four hours from the date of such permit or unless the applicant for the permit ahall attach to his application the written authorization of the owner of nearby toilet and sanitary facilities authorizing the use of such facilities by the occupants of suchlfLouile-trailerduring the life of such permit. Section 11. SAME--PERMITTED CONDITIONS TO (COMPLY WITH EXISTING LAWS. No permit shall be issued hereunder, or if issued, permitted to remain:in effect, unless the parking, locating and using of such house;trailer shall C be in full complance with all existing ordinances of the City, the statutes of the State and 1the regulatio:p.s of the Florida State Board of Health applicable the reto. Section 12.. SAME--NOT TO BE ISSUED UNTIL ELECTRICAL FACILITIES ARE PR.OVIDED No perm t for the parking of any h.miBe....trailer shall be issued under the provisions of this article unless a connection with an electric line shall be available, authorized and fully connected with the approval of the City Building Official within twenty-four hours from the date of such permit or unless the applicant for the permit sbdl attach to his application the written authorization of the owner of nearby electrical facilities authorizing the use of a separate electrical hook-up by the occupants of such house -trailer durin the life of such permit. SAME--REVOCATION The City is authorized to revoke any permit issued in the event that any provisions of this article or any other existing ordinances of the City shall be viIllated in the parking, using and occupying of such house-trailer. Section 14. SAME--REMOVAL OF TRAILER ON EXPIRATION OR REVOCATION. Immediately upon the expiration of any permit isaued, or immediately upon the revocation of such permit by the City, the property owner upon which such parking has been permitted under such permit and the owner of such house-trailer shall move the house-trailer from such location. Section l5. PARKING REGULATIONS Any house -trailer parked under the provisions of this article shall be parked on the rear one half of the lot described in the location, shall not be parked within twenty feet of the nearest right of way line of any public street and shall not be parked within thirty feeLof any building. Section 16. NUISANCES PROHIBITED: MAINTENANCE OF LOTS. No nuisance shall be permitted in the use and occupancy of any house-trailer. The lots upon which the same are parked must be kept in a clean and sanitar condition at all time s. Section 17. MORE THAN ONE TRAILER ON CONTIGUOUS PROPERT OF OWNER PROHIBITED. Not more than one house-trailer shall be permitted to be parked at anyone time upon the contiguous property of anyone property owner. Section 18. USE OF TRAILER RESTRICTED, TO FOUR PERSONS Not more than bur persons shall be permitted to make use at the same time of any houBe-trailer, permitted to be parked by this article, for sleeping, housekeeping and living quarters. Section 19. Any person v:f.elating any of the provisions of this Ordinance, upon conviction thereof shall be punished by a fine not exceeding Five Hundred Dollars ($500.00) or by imprisonment for a te.rm not exceeding sixty(60) days, or by both such fine and imprisonment within the discretion of the Municipal Judge. Each day upon which violationshall occur or continue shall constitute a separate offense. Section 2.0. This Ordinance shall become effective immediately upon final passage by the City Council of the City of Sebastian, Florida. ".c..I~. S. E..
