Chairman Dodd called the meeting to order at 2:00 p.m. with a pledge to the flag. 2. ROLL CALL: Present: Chairman Charles Ed Dodd Carl Anderson Ronald Van Buskirk Howard Brauer Barbara Beck Clarence Barton Steven Lincoln Also Present: Code Enforcement Officers Absent: Excused: David Johns City Attorney Secretary Antoine Van Meir Warren Lindquist Rich Stringer Shirley Lynch 3. The minutes to the May 17, 2006 Code Enforcement Board meeting were approved as written on a motion by Howard Brauer, second by Ed Dodd- voice vote: Ayes 7- Nays 0 4. Additions & Deletions- Item D #2006-13978 and Item F- #2006-14387 are in compliance and have been removed from the agenda, Item E- #2006-14386 is postponed to the July meeting 5. NOTICED HEARINGS: A. VIOLATION HEARING- CASE #2006-1932 D-Carr Investments, Inc (Taco Bell, Pizza Hut, KFC)- 1809 US 1 . SECTION 39-27 CODE OF ORDINANCE CITY OF SEBASTIAN- Permit Requirements- (a) No alarm user shall operate, or cause to be operated, an alarm system at its alarm site without a valid alarm permit issued by the alarm administrator Respondent agent, Becky Medley was sworn in and gave testimony. She stated that D-Carr Investments, Inc did not respond to any of the fine due letters because they thought they were for the previously paid fine. The breakdown of the fine was discussed. MOTION made by Ed Dodd reference Case #2006-1932- finding the respondents in violation of Section 39-27 operating an alarm system without a permit, giving the responded three days from the date of notification to properly permit the alarm system, and pay the false alarm and administration fee fine of $62.00, failure to permit the alarm system within the Code Enforcement Meeting June 21, 2006 Page 2 00 three days will incur a $500.00 additional fine for operating a non-permitted alarm, seconded by Ronald VanBuskirk. VIOLATION HEARING- CASE #2006-SHELL Shell Station- 617 US Highway One . SECTION 39-27 CODE OF ORDINANCE CITY OF SEBASTIAN- Permit Requirements- (a) No alarm user shall operate, or cause to be operated, an alarm system at its alarm site without a valid alarm permit issued by the alarm administrator Respondent Bernabe Serrano, manager, was sworn in and explained the problem- He stated the company he works for took over the management of the Shell Station in February of 2006, they didn't realize they had to renew the alarm permit. They received the second alarm renewal notification letter from the city in February. Mr. Serrano was told by Officer VanMeir to come in to register the alarm. Officer VanMeir gave the information on false alarms received and the fines. A discussion followed on the operation of an alarm without registration. MOTION made by Ronald VanBuskirk reference Case #2006-SHELL to find the respondent in violation of Section 39-27, fining them $27.00 with two days after notification to register the permit or be fined $250 per day until respondent comes into compliance, second by Howard Brauer ROLL CALL VOTE: Chairman Charles Ed Dodd Carl Anderson Ron Van Buskirk Howard Brauer Barbara Beck Clarence Barton Steven Lincoln Motion carried 7-0 YES YES YES YES YES YES YES c. VIOLATION HEARING- CASE #2006-2076 Jackie Williams- 341 Englar Drive . SECTION 39-27 CODE OF ORDINANCE CITY OF SEBASTIAN- Permit Requirements- (a) No alarm user shall operate, or cause to be operated, an alarm system at its alarm site without a valid alarm permit issued by the alarm administrator The respondent or their agent was not in attendance. Officer VanMeir was sworn in and presented the city's case referencing the notices mailed to the respondent. After a discussion on the different ways to enforce the code and the $500 fine in the Ordinance, MOTION made by Ed Dodd referencing case #2006-2076 finding the respondent in violation of Section 39-27 of the City Code of Ordinance, giving the respondent five days from day of notification to permit the alarm system or notify the City that the alarm is not in operation, if they permit the alarm they Code Enforcement Meeting June 21, 2006 Page 3 of3 must pay a fine of $22.00, failure to permit will incur a $100 per day accrued daily until they come into compliance, seconded by Ronald VanBuskirk ROLL CALL VOTE: Chairman Charles Ed Dodd Carl Anderson Ron Van Buskirk Howard Brauer Barbara Beck Clarence Barton Steven Lincoln YES YES YES YES YES 'r'ES YES Motion carried 7-0 A discussion followed on notification for renewals of registered alarm permits- City Attorney told the Board that it is written in the Ordinance that the city will attempt to notify the applicants to renew but it is the responsibility of the alarm owner to remember to renew the alarm permit. 7. CHAIRMAN'S MATTERS- None 8. MEMBER'S MAITERS- Ron VanBuskirk asked if the past false alarms for Shell Station are a dead issue- City Attorney stated it probably was because we don't have the name of the individual owner. He suggested getting a copy of the occupational license so we know who we must notified Carl Anderson asked to be excused from attending the July and August meetings. 9. CODE OFFICER MATTERS: Officer VanMeir stated he did not have a the status report on Case 2006713A- Walter Worthington, 1671 US Highway One- signs He will present a report at the July meeting. Chairman Dodd asked for a status of the 2 cases on Sandy Pines, Ltd! John Sneed, 101 Flint St- Officer VanMeir stated he will ask Officer Iachini to report on these cases at the July meeting 10. ATTORNEY MATTERS: Mr. Stringer joked and discussed a program he saw on A&E regarding a serial killer being a code enforcement officer. II. PUBLIC INPUT: NONE There being no further business to come before the Board, Chairman Dodd adjourned the meeting at 1450 hrs Approved at the f~ /g 2a?6" Code Enforcement Board meeting.
