HomeMy WebLinkAboutO-85-18 .. e e e I ~1 ; ORDINANCE NO. tJ- e 5-/8 AN ORJlINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING THE STANDARD OPER ATING PROCEDURES OF THE CITY AS FOLLOWS: BY AMENDING PARAGRAPH (C) OF St:CTION 7.03 AND THEREBY DELETING THE REFERENCE TO COMPENSATORY TIME OFF; BY AMENDING PARAGRAPH (G) OF SECTION 7.03 RELATING TO COMPENSATORY TIME OFF; BY AMENDING PARAGRAPH (E) OF SECTION 8.02 AND THEREBY INCREASING PAY FOR HOURS WORKED ON A HOLIDAY BY REGULAR EMPLOYEES; BY AMENDING PARA- GRAPHS (A) AND (C) OF SECTION 11.05 REGARDING MILITARY LEAVE AS REQUIRED BY SECTION 115.05, FLORIDA STATUTES, ENACTE'D BY THE FLORIDA LEGISLATURE ON JULY 1,1985; PROVIDING AN EFFECTIVE DATE. BE' IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: SECTION I That Paragraph (B) of Section 7.03, of the City of Sebastian Standard Operating Procedures, now reading as follows: "B. All authorized and approved work performed in excess of forty (40) hours in anyone week shall be considered as overtime and shall be paid at the overt.ime rate of one and one-half times the employee's straight time rate of payor by compensatory time off, at the discret.ion of the Department Head." IS HEREBY AMENDED TO READ AS' FOLLOWS: "B. SECTION II That Paragraph (G) of Section 7 .03 of the City of Sebastian Standard Operat.ing Procedures, now reading as follows: "G, Compensa tory time off wi 11 be ass .igned by the Department Head if the work schedule permits such t.ime off, by selecting the time off from a list of at least three (3) time periods to be submitted to the Department Head by the employee within not more than seven days from the t.ime worked on wh.ich the compensatory time is based. When such a list is presented, the Department Head shall attempt to accomodate the employee's preferences for the compensatory time off, condit.ions permitting. The selected or ass .igned compensa tory time off must be taken wi thin thirty days from the da te it is earned, or be forfei ted . I f no compensa tory time off .is assigned (no list) or selected by the Department Head from a timely list, then the employee shall be paid a t the overt.ime ra te of pay. No employee will be required to take annual leave or be placed in leave without pay status during the basic workweek in order to deprive him or her of compensabl e overt.ime." IS HEREBY AMENDED TO READ AS FOLLOWS: "G. No employee w.i1l be required to take annual leave or be placed in leave without pay status during the basic workweek in order to deprive him or her of compensable overtime." SECTION 111 That Paragraph (E) of Section 8,02 of the City of Sebast.ian Standard Operating Procedures, now reading as follows: tiE. Regular full-time employees assigned and scheduled to work on a holiday, and who in fact do work on the holiday shall receive their holiday pay plus pay and one-half pay for the hours actually worked. Regular part- time employees assigned and scheduled to work on a hol.iday and who in fact do work on the holiday shall receive time plus time for the hours actually worked." SECTION IV That Paragraph (A) of Section 11.05 of the City of Sebastian Standard Operating Procedures, now reading as follows: "A. Regular employees (full-time or part-t.ime) who are commissioned reserve officers or reserve enlisted persunnel in the United States Military or Naval service or members of the Florida State National Guard shall be entitled to leaves of absence for their respective duties without loss of pay for such time as they shall be ordered to military service or field training in an active duty or active duty for training status for a period not to exceed seventeen consecutive calendar days in anyone calendar year." IS HEREBY AMENDED TO READ AS FOLLOWS: "A. All employees who are commissioned reserve officers or reserve enlisted personnel in the United States Reserve Forces of the National Guard shall be entitled to leaves of absence for their respective duties without loss of pay, vacation leave, efficiency rating or time, for such time as they shall be ordered to military service or training in an active or inactive duty for training status for a period not to exceed seventeen (17) working days in anyone annual period." SECTION V That the first sentence of Paragraph (C) of Section 11.05 of the City of Sebast.ian Standard Operating Procedures, now reading as follows: "C. Regular employees (full-time or part-time) who are members of the Armed Forces Reserve or Florida National Guard shall be excused from work"with- out pay to attend inactive duty training drills as required." IS HEREBY AMENDED TO READ AS FOLLOWS: "C. All employees who are members of the United States Reserve Forces or the National Guard shall be excused from work without pay to attend active or inactive duty or training shall be excused from work without pay in excess of seventeen (17) working days in any annual period, without loss of time or efficiency rating."
