1. Mayor Burkeen called the Special Meeting to order at 7:00 p.m.

4. NEW BUSINESS
A. Proposed Airport Business Plan
The City Manager explained the purpose of the draft plan Phase I, introduced Dr. David
Byers, AICP, CM, Quadrex Associates, Inc, a subcontractor for the LPA Group, who
prepared the plan for the City, and requested feedback from Council and the public to
finalize Phase I, and then begin Phase II which will be the appraisals and values which
will help to establish rents and fees. He said if everything goes well he may be able to
bring back a finalized plan in approximately 35-45 days.
Dr. Byers summarized highlights of the "Guiding Documents for the City of Sebastian
Municipal Airport" which he referred to as Phase I of the Airport Business Plan and
which he described as a combination of other existing documents and regulations, which
were consolidated into a cohesive document.

The four major sections of Phase I that he summarized were:

o Development Guidelines
o Rules and Regulations
o Minimum Standards

Following Dr. Byers' presentation, he responded to questions and input from City Council.
Mr. Neglia made inquiries and suggestions on the following sections:
Rules and Regulations
· 1.6 Fines and Penalties - set out a clearer description of the City's role in the fining
process (no objection)
. 1.6 (c) - Fines and Penalties - change 12 months to six months (Council did not
concur)
· 2.7 (a) Vehicles - include requirement for drivers license. Dr. Byers said this should
be in the Minimum Standards section
. 3.1.a.v. - Preservation of Property - add "or surrounding property" to which Dr. Byers
advised we can only regulate on airport property and the City Manager said it would be
hard to enforce if the concern was someone buzzing a house, however we could look
into enforcement when those types of violations take place on a continuous basis. Dr.
Byers said it would be tough to enforce alleged flight violations. Discussion followed
on calls received by citizens alleging low flying planes and Dr. Byers said these calls
can be reported to FAA, however, the airport is the City's jurisdiction but the air is not
within the City's authority. The City Attorney added that beyond take off and landing
patterns this is not within the City's authority. In response to Mr. Paternoster, the City
Manager said there has been some success by handling these complaints through the
Airport Director.
· 4.12 - Fueling and Defueling -asked if there will be precautionary measures such as
automatic shut off or signs letting people know how to shut off the fuel tanks and the
City Manager said there would be pre-safety precautions and contact information.
· 4.12 (I) Fueling and Defueling - daily check - asked if the checks will be made every
day, and the City Manager responded that City personnel would check its own and
each lessee would responsible for their own
· 9.5 Waivers for Non-Compliant Aircraft - asked why we should allow non-compliant
aircraft and Dr. Byers said the term compliant relates to dimensions, wing span, length
and weight of the aircraft and anything that does not fit the criteria set out it is non-
compliant and needs permission to land. He then asked how we would know if
someone is under the influence and Dr. Byers responded if someone observes and
reports it this may be the only way.

Mayor Burkeen called recess from 8:25 p.m. to 8:32 p.m. All members present at roll call
were present when the meeting reconvened.
In response to Mayor Burkeen, the City Manager said there was no conflict with the Land
Development Code and rather it is a blend of existing regulations. Mayor Burkeen noted that
this is a complex document for non-aviation people and that there is not much here for non-
aviation activities. He said he wanted to be a good neighbor to Roseland.
Ms. Coy made inquiries and suggestions on the following sections:
General Provisions
. 2.1 Definitions - move glossary to a separate section for better understanding
Development Guidelines
. BAs. Lighting - suggested add "environmentally friendly" to lighting
. Site Plan approval - suggested that final site plan be approved by Council, however
the City Manager stated that Council will have first review of the plan when it is asked
to approve the lease. Discussion followed about the possibility of changes after
conceptual plan approval.
. Ms. Coy then suggested that flight schools be taken out of the plan because they don't
mix with skydiving. Flight schools appear in Minimum Standards -Section 8 and as
"aeronautical schools" in the Development Guidelines Appendix C, which is merely a
reference to existing language from Section 54-2-5.7 of the Land Development Code.
Dr. Byers said the City might run afoul of FAA and Ms. Coy cited reasons could be the
existence of the jump school and because of insufficient security at the airport. The
City Attorney said the skydive operation could be the strong argument and the City
Manager said Flight Safety currently does touch and goes and the City has no
authority to regulate them. The City Clerk noted for the record that the LDC currently
allows flight schools as a permitted use. Dr. Byers then stated that FAA's
determination on this could be that it discriminates.
The rest of Council said they would like to see a determination from FAA on the possible
deletion of flight schools.
Mr. Paternoster made inquiries and suggestions on the following sections:
Rules and Regulations
. 1.6 Fines and Penalties - asked for a better explanation of how and by whom the City
would be fined if someone for instance spilled paint and Dr. Byers said EPA and
further said if the City could find someone to blame the fine could be imposed on the
offender. The City Manager said we could revoke leases and go through litigation as
we are now. The City Attorney said we have been subject to these rules for many
years, and if it is the lessee's fault the City is responsible for fines but if it is not a lease
the City would be responsible for clean up and there are grants available.

Development Guidelines
. B.4.h. Building Appearance - wanted assurance that muted earth tones means what it
says and that trim colors cannot be mixed
. B.4.i.4. Windows - recommended that windows be impact resistant, however the City
Manager stated the windows had to meet code, but later said the City Attorney said we
could require impact proof windows. Based on high cost it was the consensus of
Council to require it on the runway side of the buildings.
. B.4.s. Lighting - add "or nearby residents" to the end of the last sentence.
. Remove reference to "sliding" doors here and anywhere else it occurs.
Mayor Burkeen called for public input at this time.
Donna Wilt, 687 Brushfoot Drive, Collier Club, Sebastian, who said she was a local pilot and
flight instructor at Florida Tech, offered the following recommendations:
Rules and Regulations
. 2.7 - Vehicles - cited the problem with vehicles in the area of t-hangars and
suggested that the t-hangar area be exempted from this paragraph and add the
sentence "Automobiles in that area cannot leave the t-hangar area".
. Flight Schools - stated it is very important to have flight schools and that TSA requires
extensive security information and the plan could just say "Flight schools shall be
compliant with FAA and TSA regulations regarding flight schools".
Minimum Standards
. 7.2.d. SASO - Aircraft Rental- Airport Equipment - delete it or replace it with "The
equipment should be consistent with the type of operation that they are handling".
. 8.2.d. SASO - Flight Training - Airport Equipment - same recommendation - The City
Manager said the instrument approach is in the works.
7.2.f. SASO - Aircraft Rental - Personnel and Training - recommended alternate
wording "The operator shall have in its employ on duty during defined operating hours
trained personnel in such numbers as are required to meet the minimum standards
therein. The operator shall also provide an employee in the office to supervise the
operations on the leased premises. This employee must be able to address the
service and product needs of aircraft owners and pilots. Such person must be
authorized to represent and act for and on behalf of the operator during all business
hours. All personnel are required to hold appropriate FAA certificates (inaudible) as
applicable."
. 8.2. SASO - Flight Training - said flight training and skydiving can co-exist and
suggested adding requirement that they work together to educate for safety and asked
that the type of aircraft used for training not be overregulated, for example Velocity
may want to train only on Velocity aircraft.
. 16 Flying Clubs - suggested deleting paragraphs c-g and said if they have maybe
more than 4 or 5 aircraft they should meet flight training regulations.
General Provisions
. Flight Schools - should be Part 61 rather than Part 91 CFRs and include the
appropriate title that goes with it.

Dr. Martha McAdams, Sebastian Charter Junior High School, proposed a partnership with the
City for a location on the airport property for the school.
Scott Baker, Velocity Aircraft, a SMA lessee, said he was upset with this plan from a business
point of view and requested an opportunity to submit a list of objections before any decision is
made by City Council. He said it was overly bureaucratic and overkill and that in his opinion,
there is no demonstrated need for this plan in Sebastian, because it oversteps the Council
and City's authorities that fall under FAA authority. He said in a non-towered airport there
should be no requirement for radios.
Council advised Mr. Baker to submit his list to the City Manager who would provide the list to
City Council.
The City Manager said Jeff Manning, who had been filling in for the former Airport Director,
was leaving the City's employ as of Friday, and that the City was fast tracking the position and
would probably fill it by September.
Ms. Coy noted that Velocity Aircraft would probably be grandfathered relative to some of these
regulations.
Holly Dill, Roseland, neighbor abutting the industrial district, questioned how the recent
Philipson lease property was developed as mini-storage when the AI regulations do not
allow it. She was correct~d that the subject property was actually zoned IN and not AI.
She made the following suggestions to the plan:
Development Guidelines:
Appendix B Development Guidelines and Standards for Airport Leaseholds:
. B.1. Intent - state that the more stringent regulation applies rather than the LDC
taking precedence if there is a conflict in language.
. B.2.c. Purpose - add "and to make the uses compatible with surrounding parks
and residential areas".
. B.3.Compatible land use - second paragraph - add a reference to health,
welfare and quality of life
. B.12 Vehicle parking - consider including pervious surface for parking areas
. B.13.a. Signage - concern for the number of signs which will be allowed for each
business
. Expressed appreciation for Ms. Coy's request for "environmentally friendly"
lighting and suggested adding solar powered lighting and time limitations for
lighting
. B.13. f. - Signage Exempt signs - suggested setting a limit for temporary signs
. B.15.4. Landscaping requirements - asked what "to create an immediate design
impact" meant and about the prohibition of plants that attract birds and wildlife
suggesting that these plants be allowed in the industrial district only. She further
suggested it state deer and hogs rather than birds and wildlife.

The City Attorney and Dr. Byers explained that under FAA guidelines certain plants that attract
wildlife and birds are prohibited from airport properties. Ms. Dill said then landscaping should
be prohibited because it will provide habitat.
Ms. Dill asked if there had been discussions with Indian River County on traffic impacts on
Roseland Road and said this plan should be sent to the City Environmental Committee for
those matters under their jurisdiction.
She said she was impressed with Mayor Burkeen's desire to protect Roseland and said she
thought there was to be an added layer of rules for this area to make it more stringent such as
exist in the riverfront overlay district.
Bob Ingram, local pilot, said there are many inconsistencies in this plan such as the prohibition
of retention ponds which actually exist along the 0-8 runway, said the City should have spoken
to pilots for input on the plan, said the City shows a lack of respect for people at the airport
such as Mr. Van Antwerp, stated that the City supplying cheaper fuel will increase growth, that
once the City took grant funding it put FAA in charge and is overstepping its boundaries, and
said he did not think the City could prohibit ultralights. He asked how the City could build the
Administration building to one standard and then place a modular unit in the middle of the
runways.
Mr. Ingram was asked to provide his list to the City Manager.
The City Attorney explained that this plan is a business guideline with regulations that were
previously adopted during master planning at which time there was citizen input.
Frank DeJoia, 11625 Roseland Road, Roseland, said he concurred with Ms. Dill's input and
said the sensitivity of this area adjacent to the river and the buffer preserve should be noted in
the plan. He requested that the IN buffer be 100% opaque.
Ms. Coy asked that the consultant be directed to address issues presented at this meeting
and bring them back again including spelling out what FAA won't allow or will allow and set up
a time frame to address the issues and until such time keep the status quo until they can be
resolved.
Mr. Paternoster agreed with Ms. Coy's statement and in addition asked that the consultant
add something to show our concern for the Roseland area.
Mr. Neglia agreed, noting this plan is not complete and noted the City Manager will provide
Council with a list of public concerns.
Mayor Burkeen said Council will work diligently to make everyone happy but the City will
develop the airport area. He said all concerns will be considered, and that he would like to
make the buffer opaque and regulate the quality of business that goes in there.

The City Manager said he would get with Dr. Byers and get something back to Council in two
to four weeks.
Mayor Burkeen said he did not want to drag this out, and invited anyone listening to provide
input to the City Manager and he will provide it to Council.
Dr. Byers requested since he did not perceive any deal killers in these amendments that
Council authorize him to proceed with Phase II and there was no objection from Council.
Ms. Coy announced early voting for the next two weeks Monday through Saturday from 8 am
to 4 pm.
Mr. Paternoster announced his public forum on Tuesday from 5:30 p.m. to 7 pm in Council
Chambers.
4. Being no further business, Mayor Burkeen adjourned the Special Meeting at 10:10 p.m.
