RESOLUTION NO. R-07-08 " 1 ' ~ ~ of

A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA,
RECOGNIZING HISTORIC DEDICATION OF RIGHT-OF-
WAY FOR TRUMAN STREET; PROVIDING FOR CONFLICT;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Truman Street has existed in its current location as a paved roadway
for decades; and
WHEREAS, record title for some portions of the land area containing Truman
Street lie with private landowners and appear on the Property Appraiser records as the
property of these individuals for tax purposes; and
WHEREAS, under Florida law road rights-of--way may be dedicated verbally or
by action, and historically many roadways in Florida were built without written
documentation of the right-of--way dedication; and
WHEREAS, Dr. Pamela Adan as the landowner of 1437 US Highway 1 desires
that public ownership of the right-of--way for the adjacent portion of Truman Street be
recognized as a matter of public record;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
Section 1. DEDICATION RECOGNIZED. The City hereby recognizes
that the land described in the attached Schedule "A" has been dedicated to public use, as
acknowledged by the property owner of record, as aright-of--way for Truman Street, and
the City acknowledges ownership of said parcel.
Section 2. CONFLICT. All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
Section 3. EFFECTIVE DATE. This resolution shall become effective
upon adoption.
The foregoing resolution was moved for adoption by Councilmember
