Other Officials Present: Indian River County: Supervisor of Elections, Kay Clem; SOE Attorney, Brian Connelly; Chief Deputy Supervisor of Elections, Cathy Hart; Absentee Ballot Coordinator, Marge Diehl, IT Manager, Chris Wilson. City of Vero Beach Canvassing Board Members City of Fellsmere Canvassing Board Town of Orchid Canvassing Board Other Elections staff and representatives of Sequoia were also present. The meeting was called to order at 12:10 p.m. and the Indian River County Supervisor of Elections reviewed the schedule, explained absentee ballot opening procedures and ballot duplications if necessary. There were 63 absentee ballots for Sebastian and none were found to be questionable by SOE staff. On motion by Attorney Stringer and second by Mr. Minner, the March 20, 2006 and February 21, 2007 Canvassing Board Minutes were approved on a voice vote of 3 -0. Absentee ballots were opened and processed by SOE staff but not counted at this time. The Canvassing Board meeting recessed at 12:40 p.m. and members reconvened at 6:15 p.m. in the counting room. At 7 pm when the polls closed, the early voting results were released to the Canvassing Board and began to run on government access channels. Canvassing Board members Maio and Stringer moved to another office with Kay Clem to speak to pollworkers from precincts 204 and 106 relative to vote discrepancies. In precinct 104, pollworkers Barbara Youmans and Doris Ackerly said there were two more signatures than votes and their explanation was that they believed that two individuals who came in and signed and were there to assist two other voters (one elderly citizen and one mentally challenged citizen) who were with them, never voted themselves. The Canvassing Board accepted the explanation. In precinct 106, pollworkers Barbara Trout and Liz Landino said there were 297 signatures which was two more than the number of votes, which included one provisional vote which was voted because the individual did not have a picture ID. They said they recounted several times and came up with the same information did not have any specific explanation for it. The Canvassing Board accepted the explanation. The Canvassing Board was notified by Kay Clem that there were seven provisional ballots for Sebastian. The SOE staff verified voter registration for six of the seven, and the Canvassing Board approved those six provisionals because the signature on each of the provisionals matched the voter registration signature for each of the provisional voters. The seventh provisional was not accepted because the individual does not show up as a registered Florida voter, and Kay Clem explained that under Florida law, the individual has until Friday to produce proof that he is indeed registered. If the individual is able to produce the proof, the ballot will be counted, if not it will not be counted in the official results. Mayor Burkeen, incumbent seeking re- election, contacted Canvassing Board member Minner, and asked about the procedure for contesting the election results. The full Canvassing Board and Supervisor of Elections Attorney Brian Connelly moved to another office and called Mr. Burkeen and explained the process as set out in FS 102.168. It was explained to him that the FS provision regarding recount took effect if the vote was less than one half of one percent and the difference in his vote to the next highest vote was .71 therefore was not subject to automatic recount. It was further noted that the number of vote discrepancies (four) and outstanding provisionals (1) would not affect the election numbers or outcome. Public logic and accuracy tests of the machines were once again conducted and certified (see all signed tests and certifications attached). The unofficial results are also attached to these minutes. It was noted that canvassing of official results would take place on Friday, March 16, 2007 at 5 pm due to the one provisional ballot.
