Meeting was called to order by V.C. Morris at 7:00 P.M.
Pledge of Allegiance was led by V.C. Morris.

APPROVAL OF MINUTES: Regular meeting held 5/8/07.
MOTION: Bulla/Widup
I make a motion we approve the minutes of the meeting held 5/8/907 as written.
A voice vote was taken -passed unanimously.
OLD BUSINESS: None
NEW BUSINESS: Thomson * Prometric Exam
Morrison, James/Plumbing Contractor
Mr. Morrison was sworn in by V.C. Morris.

I make a motion we approve Mr. Morrison to take the Plumbing Contractor exam.

VIOLATION HEARINGS:
Mr. Eseltine and Mr. Stringer were sworn in by V.C. Morris.
Gregory and Cindy Perugini were not present at the meeting.
Paperwork from the Peruginis was given to the Board prior to the start of the meeting.
Rich Stringer suggested that the Board address the violations of Hawaiian Pools and the
paperwork from the Peruginis be given to the homeowners to review.
There was no representative from Hawaiian Pools present at the meeting.

The homeowner was not present at the meeting.

Mr. Johnston, homeowner was present at the meeting and was sworn in by V.C. Morris.
Monies were paid and the pool construction was started in September, 2006. With the
pool partially done, Mr. Johnston said he received a call from Matt Kerr, (partner) saying
they were going out of business but he could recommend other people to finish the pool
but that he (Johnston) would have to pay them again. Mr. Denton made no attempt to
contact them or to help. He said he felt as though Mr. Denton had "abandoned" them.
He also noted that the fence that was to be constructed was never done and the money for
the fence was not returned.
MOTION: Bulla/Carbano
I make a motion we fine Daniel Denton, $500.00 for violation of 26-172(5), diversion of
funds, $500.00 for violation of 26-172(10), abandonment of a construction project and
revoke his license for a period of 1 year.

MOTION: Widup/Canning
I make a motion that on the addresses 421 Columbus Street, 255 Englar Dr. and 1563
Clearbrook Street, on the issues of 26-172(5), diversion of funds and 26-172(10),
abandonment of a construction project that we fine Daniel Denton $500.00 for each
offense for each of the 3 addresses which would be accumulative of $3,000.00 fine and
that his license be suspended indefinitely until he comes before this Board.
V.C. Morris asked the City Attorney if this would supercede the previous suspension of
the indefinite suspended license? Mr. Stringer said he would have to come in and address
that since you found it in a separate case, he would have to address them both at the same
time.

Gregory Perugini/Perugini Construction

Diane Ronan, homeowner, was present and was sworn in by V.C. Morris.
Ms. Ronan told the Board they paid the contractor according to the draw schedule in their
contract and then found out that they were not paying the sub-contractors for the work
that was covered by the draws, so there were liens applied against their property.
V.C. Morris asked if she had any idea about how much they had paid him and about how
much there is in outstanding liens that are different between what they paid and where
they are? Ms. Ronan said that most of the liens have been satisfied. Some were paid by
them and some by us. She said that they had taken over the permit and doing it
themselves.
V.C. Morris asked when the contractor stopped working on the house. Ms. Ronan said
the last time they had ordered work done was February of this year.
V.C. Morris asked Mr. Eseltine if there are any ongoing permits at the present time. Mr.
Eseltine said there were.
Mr. Widup felt that Greg Perugini also be brought back before the Board and charged
with "abandonment of a construction project".
Several sub-contractors were sworn in and talked about some of the liens they had filed
due to non-payment of their bills.
The Board asked to hear the case at 1355 Damask Lane before any motions were made.

Kristin Moak, homeowner, was present and was sworn in by V.C. Morris.
Mrs. Moak summarized what they had been going through with Perugini Construction.
She said that in April, the Sheriff came to their house to serve them with a subpoena for
them being sued because a sub wasn't getting paid.
After talking to Cindy Perugini, she signed a notice to Moak's bank to say they had
control of their own funds.
Tina Corone of Vero Beach asked to speak to the Board and was sworn in by V.C.
Morris. She had a similar account of what transpired with Perugini while their house was
being built. She said that in July she had an administrative complaint against Perugini
Construction going before the Indian River Construction Board of Adjustment and
Appeals.
MOTION: Widup/Morris
In the case of 614 Helicon Terrace, Code of Ordinances 26-172(5), diversion of funds to
fine Mr. Perugini $500.00 and the Building Official to prepare documentation
abandonment of construction project for the September meeting, his license indefinitely
suspended for pulling future permits and his ability to call for inspections suspended until
he comes before the Board.
In the case of 1355 Damask Lane, Code of Ordinances 26-172(5), diversion of funds to
fine Mr. Perugini $500.00, and following several amendments being made, to suspend all
permits existing and future for this individual and his license be indefinitely suspended -
total suspension.
