Aluminum License Reinstated. Building Official_, Wayne Eseltine presented a summary
of events on three properties which Steve Lundy, of Lundys' Screen Room appears to
have represented under contract while license was under suspension.

After much discussion, a motion was made to fine Steve Lundy, of Lundy's Screen
Rooms, $500 for violation of 26- 175(e)(f) of which work was completed and permit
never issued at 368 Toledo St.

so that all work may be cleared up after which time he shall then go back before the
board.

NOTICE OF VIOLATION HEARING

The Sebastian Construction board of the City of Sebastian hereby notifies you of
an alleged violation of the Sebastian City Code of Ordinances. The Sebastian
Construction Board contends that the following violations exist:
26- 175(1), Failure in any material respect to comply with the provisions of article
6 of the City Code of Ordinances;
26- 175(e) Holder of certificate of competency was found to have
violated 26 -171 and certificate previously issued was suspended
for period of one year from 5/9/06 then found to have violated
again 10 /10 /06 which extended suspended license until 10/10/07.
26- 175(f) Unlicensed person offering communication that he is a
contractor or qualified to act in business as a contractor.

Accordingly, the Sebastian Construction Board has set this matter for a hearing
on:
Tuesday, the 9th day of September, 2008 at 6:00 P.M.
at 1225 Main Street, City Council Chambers, Sebastian, Florida.
YOU ARE REQUESTED to appear before the Board at that time to answer and
defend the allegations that you have violated the above cited provisions of the
Code of Ordinances of the City of Sebastian.
If you fail to attend, the Board may base its findings and act solely on the
presentation made by the Construction Board.
YOU MAY APPEAR WITH OR WITHOUT AN ATTORNEY. YOU HAVE A RIGHT TO
SUBPOENA WITNESSES AND DOCUMENTS AND CROSS-EXAMINE THE OTHER
PARTY'S WITNESSES. SUBPOENAS ARE AVAILABLE IN THE CONTRACTOR LICENSING
OFFICE LOCATED IN THE BUILDING DEPARTMENT.
If the Board finds that you have committed a violation, it may order immediate
compliance with the Code a nd provide in the order, in-The event of failure to
comply with the order within a period of time set forth therein, that a fine NOT I0
EXCEED $500.00 be imposed for the period of non-compliance, and /or suspend
certificate holder, revoke a certificate, place certificate holder -on probation as
well as file a- complaint with DBPR.
If any decision of the Board affects you and you decide to appeal any decision
made at this meeting with respect to any matter considered, you will need a
record of the proceedings and for such purposes, you may need to ensure that
a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is based.

Screen Wall on Entry Way. White in color Elite Roof, 1 door, 19 Linear ft of Super Gutter, 36

supporting uprights, beams notched to accept uprights built to 150 M.P.H. wind engineering.
We propose hereby to furnish material and labor complete in accordance with above
specifications, for the sum of: $5520.00 This Price Includes all Permit and Engineering fees.
Payment to be made as follows: $1,000.00 deposit, $2260.00 at the time of laser measure, with balance of $2260.00 due
upon completion of construction. You have a 48 hour grace period after the completion of job, if home owner is not home.
Every 24 h ours after this time $50 a day will be added on each day until remaining balance is paid. However you may with
hold 10% of final remaining balance for a punch list or final inspection! If you plan to be absent for any payment, please
make some type of arrangement for timely payment.
All material is guaranteed to be as specified. All work to be completed in a workmanlike manner according to standard
practices. Any alteration or deviation from the above specifications involving extra costs will be executed only upon written
orders, and will become an extra charge over and above the estimate. All agreements are contingent upon strikes, accidents
and delays beyond our control. !further understand and agree that any cost incurred by Lundy's Screen Rooms caused by
collection action on my account, including attomey's fees, court costs and interest due to delinquency, or retum check fee
($50.00) will be my responsibility and will be paid by me as part of my balance. If this is a corporation, the undersigned
agrees to be personally responsible for any purchase made by the corporation pursuant to this agreement. Any non-

where no inspections were ever scheduled and the permits have expired.

Summary of Violation Hearings:
The following addresses represent where work has taken place and it was
discovered that contracts were written by Lundy's Screen Rooms while license w as
suspended These violations have not previously been presented to the board
1. 368 Toledo ST. Owner came in for an owner/ builder permit on 11/20/06. Owner
stated Lundy Screen Rooms built the screen enclosure. Owner provided a copy of
the contract that was written on 5/18/05. Plans that were provided with permit
application were insufficient for review. Owner stated this is the plan that was
given to her from Lundy. No permit has ever been issued.
2. 565 Joy Haven Dr. Lundy Screen Room contract was written and executed on
10/25/06 while license was under suspension. Permit application was submitted
under Clark Contracting on 11//16/06. A Recorded Notice of Commencement was
modified from Lundy Screen Rooms to Clark Contracting. It is believed that the
plans were prepared for Lundy Screen Rooms and was modified to read Crark
Contracting. Building Permit was issued to Clark Contracting, inspections were
completed and closed.

3. 862 Salem Ave. Lundy Screen Room contract was originally written and
executed on 1/25/07 while license was under suspension. A Recorded Notice of
Commencement has Steve Lundy's name as the contractor. Keith Clark of Clark
Contracting applied for permit on 2/8/07. Permit fees were paid with a Lundy Low
Cost Screen Repair check.
Upon further investigation, and speaking with Keith Clark from Clark Contracting.
He admittedly had an agreement with the Lundy's to help them out until their son;
Matt Lundy obtained his license, which was not until 3 /1/2007. Mr. Clark is
handicapped and confined to a wheelchair and is unable to write. Mr. Clark stated
that he gave the Lundy's his signature stamp to use for permitting. He had no prior
knowledge of the contract at this address. Mr. Clark was warned of the penalties
for aiding and abetting an unlicensed contractor. He then had a new contract drawn
up on his letterhead and submitted new plans prepared for Clark Contracting.
Permit was issued, completed and closed.
These cases were turned over to the Sebastian Police Dept. for criminal
investigation. After a very lengthy amount of time, the Police Dept. reported that
they had insufficient evidence for a criminal case.

We propose hereby to furnish material and labor complete in accordance with above
specifications, for the sum of: $9500.00 This Price includes all Permit and Engineering fees.
Payment to be made as follows: $1,000.00 deposit RECEIVED, $4250.00 at the time of laser measure, with balance
of $4250.00 due upon completion of construction. You have a 48 hour grace period after the completion of job, if
home owner is not home. Every 24 hours after this time $50 a day will be added on each day until remaining balance is
paid. However you may with hold 10% of final remaining balance for a punch list or final inspection! If you plan to be
absent for any payment, please make some type of arrangement for timely payment.
All material is guaranteed to be as specified. All work to be completed in a workmanlike manner according to standard
practices. Any alteration or deviation from the above specifications involving extra costs will be executed only upon
written orders, and will become an extra charge over and above the estimate. All agreements are contingent upon
strikes, accidents and delays beyond our control. I further understand and agree that any cost incurred by Clark.
Contracting Construction Corp. caused by collection action on my account, including_ attorneys fees, court costs and
interest due to delinquency, or return check fee ($50.00ywill be my responsibility and will be paid by me as part of my
balance. If this is a corporation, the undersigned agrees to be personally responsible for any purchase a th
