HomeMy WebLinkAbout10082008Separate CoverLAUREL RESERVE SUPPLEMENTAL INFORMATION LAUREL HOMES PLAT SUBMITTAL DOCUMENTATION PLEASE BRING THIS INFORMATION TO THE WEDNESDAY, OCTOBER 8, 2008 REGULAR MEETING TO: Members of the City FROM: AI Minner, City Mana RE: LAUREL RESERVE FINAL PLAT DOCUMENTATION DATE: Monday, October 6, 2008 On Friday, a Laurel Reserve representative submitted documentation, which would be needed to plat Phase II. This documentation supports Option #3 presented in the Council Agenda packets. The options enumerated to Council were: - Option #1 -Plat Phase II as agreed between Rich Stringer and Bruce Barkett. This option platted the phase as previously approved by Council with the road ROW. - Option #2 -Suggests that the plat be amended properly by removing ROW, amending supporting ordinances, and granting required variances. - Option #3, preferred by Laurel Homes is to immediately plat the documentation submitted. This memo is a supplement to the Council Agenda Transmittal. Commentary is provided on the documentation submitted. While most of the information was received there still remain some outstanding issues, which would prohibit the plat from being recorded. Below are the issues at hand. The red script is from the applicant's submittal letter; the black italic comments are City responses. 1. An updated completed notarized Development Order Application This was provided by the applicant and is complete. 2. A copy of the original $500.00 Check dated 11/16/05 The City received a check for their original platting request. That process never was completed because of the dedication dispute. City Attorney Rich Stringer and applicants counsel Bruce Barkett, agreed that the materials submitted at that time should be platted. However, that never occurred. The documents submitted herein are different than the original request. The biggest change is they do not include dedication of Fleming Street and that issue is addressed in the agenda transmittal. In short however, for this plat or other applications, Council may choose to waive further platting/application fees. 3. An updated completed checklist for final plat recording along with the required materials including: a. New Executed mylar Most of the documentation was delivered early on Friday, October 3"`'. By late afternoon the mylar was provided. Hence, the mylar has not been reviewed by Growth Management, Engineering or the City Attorney and not signed. That is a plat requirement. b. New Certificate from the Clerk of the Court approving the mylar C cil r P EII- A certificate from the Clerk's office has been received. However it does seem to be incomplete and was not attached to a mylar, which is standard operating procedure. These issues should also be pointed out concerning the plat: 1. The plat has been signed and sealed by David Taylor as City Surveyor. Mr. Taylor is an associate of City Surveyor Rod Reed. Mr. Reed had reviewed the 2005 submittal and approved it for signature. David Taylor has reviewed the new submittal and inspected the site and accepted same. 2. No official seal has been placed on the plat for the Bank. 3. In text on the plat, it states that the document is in compliance with the City's Land Development Regulations. Per other documentation submitted to Council, this statement, if accepted by Council in its present form, would not be correct as the plat is not in compliance with the City's LDR. Should Council approve the submittal "as is" this statement should be removed from the plat. c. New Copy of the Homeowner's documents with exhibit This has been received and refers to the Covenants of Phase 1 to guide Phase 11. d. 10 new sealed copies of the plat 10 copies have been reviewed -see City comment 3. B e. 10 new handsets of the plat for your convenience Enclosed for Council review - not a requirement for platting f. Statement of Developer: "All required improvements are complete" This has been received by City -Not reviewed by City Engineer 4. A copy of the Engineer of Record's Certification of final improvements This has been received by City -Not reviewed by City Engineer Based on this review, staff has not fully reviewed, signed the documentation. There are also some procedural steps missing if this plat is to be approved. Therefore, at this time, staff cannot recommend approval of this option and suggests that the other two options provided above are considered by Council.
