Mayor Gillmor called the Board of Adjustment Meeting to order at 6:00 p.m. 2. The Pledge of Allegiance was recited. 3. ROLL CALL City Council Present: Mayor Richard H. ANNOUNCEMENTS -None 5. APPROVAL OF MINUTES: Regular Meeting 12-10-08 MOTION by Ms. Simchick and SECOND by Ms. Coy to approve the minutes carried on a voice vote of 5-0. 6. OLD BUSINESS -None 7. NEW BUSINESS: A. QUASI-JUDICIAL PUBLIC HEARING: STEVEN SANDERS, IN REGARDS TO 1017 FOSTER ROAD, IS REQUESTING A VARIANCE TO ALLOW A ROOM ADDITION TO BE 8 FEET FROM THE FRONT PROPERTY LINE AND 8.7 FEET FROM THE SIDE PROPERTY LINE, WHEREAS THE CODE REQUIRES A FRONT YARD SETBACK OF 25 FEET AND A SIDE YARD SETBACK OF 10 FEET. Board of Adjustment Meeting March 11, 2009 Page Two The City Clerk swore in all those who intended to offer testimony. No ex-parte communication was disclosed. Steven Sanders, 1017 Foster Road, stated that he just wanted to enclose the structure he had prior to the 2004 hurricanes with concrete block so it doesn't happen again. Public Favor Rob Grobeck, 1041 Foster Road, said he, his sister, and mother own four homes on Foster Road and all of them support his Mr. Sanders' request. Public Against None. The Growth Management Manager said the room addition is slightly larger than what it used to be because a concrete footing is needed, and the entire structure does not meet the front yard setback set out in code. MOTION by Ms. Coy and SECOND by Simchick to approve the variance to allow the room addition to be 8 feet from the front property line and 8.7 feet from the side property line. Project Description: a. Narrative of proposed action: Gladys and Inez Accornero are requesting a variance to allow an existing residence to be 7.9 feet from the rear property line, whereas the code requires a 20-foot rear setback. b. Staff Comments: The owners of the subject property have it under contract to sell. The title company handling the transaction discovered the encroachment and will not issue title insurance until the matter is resolved. The residence was constructed in 1961 and is now 48 years old. Due to the age of the building, there are no records regarding its construction in the Building Department. Staff has researched the zoning codes in effect at the time of construction and found that Zoning Ordinance #159 adopted in May of 1958 required a fifteen (15) foot rear setback. Therefore, even at the time of construction, there was an encroachment. The residence, as well as a shed, is encroaching into the 10-foot rear utility easement. The shed will be removed and application has been made to abandon a portion of the rear easement. The resolution to abandon the easement will be heard by City Council on their May 13, 2009 agenda. 9. Board Criteria for Determining Variances: See attached analysis. 2 Staff Recommendation: Staff recommends approval of the variance granting a reduction of the rear setback to 7.9 feet. Board Action: Hold quasi judicial hearing to consider the request for each variance. ~5 - 7- o~ r ared by J ~ng Date rowth Mana ment Department 3 BOARD CRITERIA FOR DETERMINING VARIANCES Section 54-1-2.5 In order to authorize any variance from the terms of the land development regulations, the Board of Adjustment must use the following criteria for approving or denying a variance: a Existence of special conditions or circumstances. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same zoning district. Meets Standard Yes 0~ No ^ The problem has existed since construction of the residence 48 years ago. Subsequent zoning amendments further increased the degree of encroachment. The City has no record of any complaints from neighboring property owners, nor from any other governmental or utility agencies. b Conditions not created by applicant. That the special conditions and circumstances do not result from the actions of the applicant. Meets Standard Yes ~ No ^ The current owners are not responsible for the encroachment. c Special privileges not conferred. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings, or structures in the same zoning district. Meets Standard Yes [~' No ^ There are few houses this old in the Sebastian Highlands. When an encroachment issue is discovered, it is handled on a case by case basis involving staff research of best available records. d. Hardship conditions exist. That literal interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would create unnecessary and undue hardship on the applicant. 4 Meets Standard Yes C~ No ^ Reconstruction of such an old structure is not practical and would seem to serve no purpose. e Only the minimum variance granted. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure. Meets Standard Yes ~ No ^ No additional variance, beyond what is needed to correct the existing encroachment, has been proposed. f Not incurious to public welfare or intent of ordinance. That the granting of the variance will be in harmony with the general intent and purpose of the comprehensive plan and this code, and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. Meets Standard Yes C~' No ^ The encroachment has existed for 48 years without incident. ~ Conditions and safeguards may be imposed. In granting any variance, the board of adjustment may prescribe appropriate conditions and safeguards in conformity with chapter 163 F.S., the comprehensive plan, and any ordinance enacted under its authority. Violation of such conditions and safeguards, when made a part of the terms under which the variance is granted, shall be deemed a violation of the ordinance. The board of adjustment may prescribe a reasonable time limit during which the applicant shall commence and/or complete the subject actions and conditions approved by the board.
