PUBLIC HEARING - REVIEW AND MAKE RECOMMENDATION TO CITY
COUNCIL REGARDING ORDINANCE 0-09-05 WHICH PROPOSES TO AMEND
THE LAND DEVELOPMENT CODE RELATING TO THE PARKING AND
STORAGE OF RECREATIONAL VEHICLES
Mr. Ginsburg read the title of Ordinance 0-09-05 and explained that the ordinance is
designed to clarify the code. The term "front building line" used elsewhere in the code
and is being brought into this section to indicate that what it means is where the main
entrance of the building is, not where any projecting garage or carport might be. The
ordinance is directed to the situation where people are using a projecting garage or
carport area to have their recreational vehicles placed closer to the street than its
possible what the city council intended. This ordinance would push the line back to the
main entrance of the main building line of the main front of the structure, clarifying that
those vehicles could not be placed closer to the road than where that main front building
line is. If this ordinance is approved by the city council, then another ordinance would
come before you dealing with the special problems that the city confronts with corner
lots. Staff has provided you with a series of sketches indicating how the ordinance
would be applied in practical effect.
Ms. Grohall added this would better clarify the intent of the existing code. She said staff
worked through a couple of different scenarios showing where the appropriate places
are for a recreational vehicle. Recreational vehicle includes an RV travel trailer, boat,
any sort of trailer in general for outdoor equipment.

Mr. Blais asked if staff had a number of how many residences this would impact. Ms.
Grohall said it would be a very large number of homes where the garage or carport
extended out from the front entrance. He asked what the impetus is behind this change.
Mr. Ginsburg wasn't sure if there were complaints made to the City Manager regarding
recreational vehicles being too close or perhaps code enforcement has said they feel
like they can't issue citations because an argument can be made that the projecting
garage is the front building line.
Mr. Dodd stated he was against this ordinance because we are promoting the fishing
village concept but residents aren't able to put a boat in a driveway. He added he was
not in favor of tightening the code to make us more like the things we don't want to be
like. Mr. Neuberger agreed with Mr. Dodd. Mr. Hepler agreed we are trying to set up a
fishing village atmosphere and welcome this kind of activity. He felt the current setback
for a garage is reasonable for the recreational vehicle. Mr. Hepler also asked what the
rule is currently. Mr. Ginsburg stated currently it still is supposed to be behind the main
line, it doesn't say it clearly enough and people are using their projecting garages as the
demarcation for how close their boat can be to the street. This would put it back, if you
have a projecting garage, to the main line of the house. Ms. Grohall reviewed the
scenario sketches. She explained that the intent is to have the recreational vehicle
behind the principal structure. Mr. Dodd stated he thought there should be a
grandfathering clause to protect residents who have installed recreational vehicle
parking areas correctly and legally.
Mr. Cardinale opened the public hearing for comments from anyone for or against this
proposed change. No one spoke. Mr. Cardinale closed the public hearing.
MOTION by Dodd/Neuberger to not approve Ordinance 0-09-05 as drafted, but in the
event they do approve an ordinance of this type that it contains a grandfather clause.

The vote was 5-0. Motion carried unanimously.
MEMBERS MATTERS:
Mr. Cardinale asked about the progress of the kayak business at the airport and Ms.
Grohall replied he has applied for a sign permit so is moving forward. Mr. Blais asked
when the proposed ordinance would go before city council and Ms. Grohall thought it
would be June 10tH
