MINUTES
BOARD OF ADJUSTMENT
REGULAR MEETING
WEDNESDAY, JULY 22, 2009 - 5:30 P.M.
The Mayor called the Board of Adjustment meeting to order at 5:30 p.m.
2. The Pledge of Allegiance was recited.
3. ROLL CALL
City Council Present:
Mayor Richard H. Gillmor
Council Member Andrea Coy
Council Member Eugene Wolff
City Council Absent (Excused):
Vice-Mayor Jim Hill
Council Member Dale Simchick
Staff Present:

City Attorney, Robert Ginsburg

Growth Management Director, Rebecca Grohall
Growth Management Manager, Jan King
4. ANNOUNCEMENTS -none.
5. APPROVAL OF MINUTES: Regular Meeting 5-13-2009
MOTION by Mr. Wolff and SECOND by Ms. Coy to approve the May 13, 2009 minutes
with a unanimous voice vote of 3-0.
6. OLD BUSINESS -none.
7. NEW BUSINESS:
Ms. Coy called for a point of order and suggested that perhaps they didn't make a
good decision at the last meeting to open a quasi judicial hearing with only three
members of Council. She explained that the City Attorney advised that all three
members would have to confirm or deny what went on at the hearing which was very
unfair to the applicant and she suggested Council consider moving the hearing to July
29, 2009 when there will be a full Council with a full hearing for the applicant.

Mayor Gillmor said it would have to be up to the applicants and he was for it.
Mr. Wolff said he was fine either way.
Ms. Coy said she would like to make a motion to adjourn the meeting until July 29tH
and asked the City Attorney if that was correct. He advised it should be a motion to
defer each of the applications until the 29th at 5:30 p.m.
She asked him to state it again for the record. The City Attorney said the proper
motion would be to defer the two quasi-judicial public hearings until July 29th at 5:30
p. m.
Ms. Coy MOTIONED "so moved," in response to the City Attorney and Mayor Gillmor
SECONDED the motion. There was a unanimous voice vote of 3-0.
The Mayor adjourned the Board of Adjustment meeting at 5:31 p.m.
A. QUASI-JUDICIAL PUBLIC HEARING:
SEBASTIAN CHARTER JUNIOR HIGH SCHOOL, IN REGARDS TO
PROPERTY LOCATED AT 782 WAVE STREET, HAS REQUESTED A
VARIANCE FROM A SCHOOL CONDITIONAL USE REQUIREMENT THAT
NAY MAIN OR ACCESSORY BUILDING BE LOCATED AT LEAST 100 FEET
FROM ANY PROPERTY LINE, PROPOSED SETBACKS ARE 10 FEET FROM
THE NORTH (SIDE), 25 FEET FROM THE WEST (REAR) AND 50 FEET
FROM THE NORTH (SIDE), 25 FEET FROM THE WEST (REAR) AND 50
FEET FROM THE SOUTH (SIDE) PROPERTY LINES.
B. QUASI-JUDICIAL PUBLIC HEARING:
DR. HADI SHALOUB, IN REGARDS TO PROPERTY LOCATED AT 13100
U.S. 1, HAS REQUESTED A VARIANCE TO ALLOW A STRUCTURE TO BE
15 FEET FROM THE REAR PROPERTY LINE, WHEREAS THE CODE
REQUIRES SUCH STRUCTURE TO BE A MINIMUM OF 30 FEET FROM THE
REAR PROPERTY LINE WHEN ABUTTING A RESIDENTIAL DISTRICT OR
USE.
